ENFORCEMENT OF PRE-APRIL 1ST, 1999 NWT JUDGEMENTS
IN NUNAVUT S.76.12 (3) OF THE NUNAVUT ACT
In the interest of ensuring that the Nunavut Court of Justice Registry and the Sheriff’s
Registry accurately reflect the authority for the filing of pre-April 1st, 1999 NWT
Judgements in Nunavut, the following fees and documents will be required for the named
purpose(s):
Filing of the Judgement/Order in the Nunavut Court of Justice Registry only:
1. Certified copy of the Judgement or Order made by the NWT Court;
Filing of the Judgement/Order in the Nunavut Court of Justice Registry and
Issuance of a Writ of Execution:
2. Certified copy of the Judgement or Order made by the NWT Court;
3. Writ of Execution based on the Judgement or Order (available electronically upon
e-mail request to: [Link]@[Link])
4. Fees for issuance of the Writ of Execution;
Filing of the Judgement Order, Issuance of Writ and Issuance of Garnishee
Summons:
5. certified copy of the Judgement or Order made by the NWT court;
6. Writ of Execution in the form attached;
7. Fees for LTO certification by the Sheriff (if requested);
8. Certificate of Subsisting Execution from the Sheriff of Nunavut;
9. Fees for the issuance of a Certificate of Subsisting Executions;
10. Garnishee Summons (available electronically upon e-mail request to:
[Link]@[Link])
11. Fees for the issuance of Garnishee Summonses;
Notices of Seizure and other Enforcement Documents:
12. Certified copy of the Judgement or Order made by the NWT Court;
13. Writ of Execution issued by the Clerk (available electronically upon e-mail
request to: [Link]@[Link])
14. Fees for issuance of the Writ;
15. Fees for filing of Writ with the Sheriff of Nunavut;
16. Certificate of Subsisting Executions;
17. Fees for issuance of Certificate of Subsisting Executions;
18. Fees for effecting seizure (including removal expenses, where applicable);
19. Letter of Instruction and indemnity;
20. Notice of Seizure and any other enforcement documents relating to s.76.12(3)
judgments and orders may also be filed, issued or otherwise used with such
modifications, as the circumstances require.
Certificates of Subsisting Executions:
21. Certificates of Subsisting Execution may be requested by telephone provided that
the creditor/solicitor has fees on account with the Sheriff.
22. Certificates of Subsisting Executions will be telecopied to the requesting
creditor/solicitor to facilitate the timely preparation of garnishee summonses and
seizure documents. Original certificates will be mailed in the usual fashion. The
Sheriff’s Fee Schedule for telecopies will apply.
