Renu is owner of IV bearing registration number:HR-35N-7422
On 31/05/2020 one of his known person Mr. Rambir borrowed the IV and was going
to Najafgarh, Delhi. At around 07:30 A.M while he reached near Nahad village,
Haryana suddenly one rooz came in front of the IV, due to that he lost control over
vehicle and vehicle hit with tree, causing the damages.

8. SCIENTIFIC OBSERVATION
Based on the scientific analysis of the IV damages, injury analysis and accident site
scenario analysis, we have observed the following relevant scientific facts in this case:
8.1. IV LHS is heavily damage due to hitting with tree:
On 31/05/2020 one of his known person Mr. Rambir borrowed the IV and was going to
Najafgarh, Delhi. At around 07:30 A.M while he reached near Nahad village, Haryana
suddenly one rooz came in front of the IV, due to that he lost control over vehicle and
vehicle hit with tree, causing the damages.

As per damage analysis,The major impact is observed on the LHS of IV,LHS front door
damage,roof of the IV also damaged,bonnet and front bumper mounting were also
damaged,IV front windshield damaged,interior of the IV were also damaged,brake lever
and gear shifter were also damaged,front LHS door was crushed towards Co-driver seat
reducing the Co-driver head and leg room.

8.2. The injuries mentioned in the MLR of Rambir are significant to be caused while
driving the IV in a case wherein co-driver seat was unoccupied and driver thrown
towards impact side:
As per damage analysis, Interior of the IV also accrued majorly damaged. Dashboard of
IV also got damaged.

In an accident situation, when a vehicle collides with fix object or another vehicle, it
experiences a huge impact force which causes the vehicle to rapidly decelerate and stop,
but the driver/occupants present inside the vehicle who carries a substantial momentum
same as that of the vehicle, continues to move in forward direction and strikes against the
interior of the vehicle, unless they are restrained.

If co-driver seat is not occupied, than due to momentum IV driver would fling towards
co-driver door and interact with the crushed component, In such a situation, the opposing
force by the interior parts would cause the driver to sustain laceration, abrasion type of
injuries to his upper body parts.
Based on injury analysis, Rambir has sustained Lacerated wound of size approximately
2x0.7 cm on left ear pinna posterior aspect, Multiple small incised wound each of size
approx. 1 x 0.5 cm on left side neck, Abrasions left temporal region, Abrasion left
shoulder, Multiple abrasion right forearm
These injuries mentioned in the MLR of Rambir are significant to be caused while driving
the IV in a case wherein co-driver seat was unoccupied and driver thrown towards
impact side.

9. CONCLUSION
Based on the scientific analysis of the IV damages, Injury Analysis and Accident Site
Scenario Analysis, we have observed the following relevant facts:
IV LHS is heavily damage due to hitting with tree.
The injuries mentioned in the MLR of Rambir are significant to be caused while
driving the IV in a case wherein co-driver seat was unoccupied and driver thrown
towards impact side.
The insurer should take the final decision.
