Explain whether the Consumer Protection Act 68 of 2008 would apply to the following
scenarios. Explain your answer with reference to appropriate authority.
2.1 Yummy Baked Goodies (Pty) Ltd, located in Parktown Johannesburg, is a bakery that
specialises in baked breads, cookies and cakes. Yummy Baked Goodies (Pty) Ltd has
seen a significant increase in its business and during 2019 had an annual turnover
exceeding R3 000 000. Yummy Baked Goodies (Pty) Ltd purchases sugar and yeast
from their main supplier, Tekkan CC, on a regular basis to make their specialty breads,
cookies and cakes. Tekkan CC fails to deliver the sugar and yeast order that Yummy
Baked Goodies (Pty) Ltd ordered on 1 April 2020.
2.2 David purchases a vacation package from Great Vacation Trips (Pty) Ltd on 1 October
2011 for R8,000. Great Vacation Trips (Pty) Ltd fails to book the airline tickets and refuses
to refund the R8,000 to David.
2.3 Bontle, Travis and Rakesh practice as a partnership providing brokerage services for
equipment in the medical sector and practices under the name of “Safety-First Medical
Suppliers”. The partnership owns assets of R100,000 and earns around R500,000 per
annum. Safety-First Medical Suppliers purchases from Scanners (Pty) Ltd equipment to
the value of R30,000, which was never delivered.
2.4 Yummy Baked Goodies (Pty) Ltd, located in Parktown Johannesburg, is a bakery that is
only in the business of selling baked cookies and cakes. Yummy Baked Goodies (Pty)
Ltd decides to lease the apartment above its bakery to a tenant for R5,000 a month.
