1. Introduction
This report discusses key concepts related to income tax as outlined in the ICAI book by VK
Singhania (Pages 204-226). It highlights individual conduct and behavior in financial
matters, with a focus on the importance of thought processes in taxation.

2. Profits Chargeable to Tax (Sec 41)


Income from Inoperative Business: If income is earned by a business that is no longer
operational, it is deemed as profit.

Remission of Grading (Sec 41(2)): This involves the balancing charge for the sale of capital
assets used for scientific research or bad debts that are subsequently recovered.

Exchange Rate Changes (Sec 51): Changes in currency exchange rates can affect the
taxability of transactions, and this section addresses the tax implications of such
fluctuations.

3. Case Example: Saniya Gupta


Saniya Gupta acquired an asset from Bangladesh for her business in India. Since
Bangladesh’s currency fluctuates significantly, these fluctuations affect the taxability of the
asset. When making payments toward the asset's cost, several considerations arise:
- The actual cost of the asset.
- Capital expenditure incurred (including for family planning by a company).
- Acquisition cost of non-depreciable capital assets.
4. Adjusted Capital & Deductions
Deductions are allowed only on actual payments (Sec 42(1)). Additionally, any sum payable
for tax duties or any fund set up for employee welfare must comply with relevant
regulations.

Tax Dues: Any tax payable must comply with current laws.

Employee Welfare Funds: Contributions to employee provident or gratuity funds must be


made in accordance with regulations.

Payment Rules: Payment for services rendered, commissions, or interest on loans must
follow specific guidelines, including:
- Interest on loans or borrowings from public financial institutions or state corporations.
- Interest on loans from non-banking financial companies (NBFCs) must adhere to the
agreement’s terms.
