SUBJECT : Investigation Report on Rape with Homicide
Victimizing, Yhasmine Balos Intong
DATE : November 10, 2024
I. AUTHORITY
1. Memo from the Director, dated November 10, 2024. Directing an
investigation of Rape with Homicide incident reported on November
10, 2024 at Prk.18 Juan Dela Cruz, St., Toril Davao City.
2. Inherent authority under the Philippine National Police (PNP)
instructing the Special Investigation Task Group to conduct an in-
depth investigation of the case involving rape and homicide.
II. MATTERS TO BE INVESTIGATED
3. To determine the surrounding circumstances of the killing of the
said person
4. To identify the suspect, and potential causes of why he committed
that crime, and develop a plan to address the incident.
III. FACTS OF THE CASES
5. On November 10, 2024 at 5:00 pm, a rape incident
happened in Prk. 18, Juan Dela Cruz St., Toril, Davao City. The
victimization of Yhasmine Balos Intong, a female, 19- years- old, a
student of Davao Central College, Single.
6. Based on the initial investigation of the DTPO, according to the
witness Ms. Mary Ann Bibat, she stated that the victim Ms. Intong
was alone and going home from her friend’s house; while heading
home Mr. Francisco suddenly approached her and talked about
some random things while walking. While they walk around Mr.
Fransisco led Ms. Intong into a place where less people go and
pass by, Ms. Mary Ann did not think of any possible danger to
come because she knew that those two (Mr. Francisco and Ms.
Intong) are close friend because she frequently see them hanging
out in her sari-sari store.
7. Mr. Mark Joshua Torino, a local who was passing by, saw a man
fleeing the desolate house. The man looked messy, had a missing
slipper, and was coated in blood. Mr. Torino called for the running
man right away, but it kept running instead of stopping.
8. The witness shouted for help and a local police man patrolling the
said area hear him shouting and immediately go to the place where
the calling for help is coming. After arriving at the spot where the
crime occurred, the first responder or the police man immediately
noted the time of his arrival, the location of the crime scene, and
he use of tape or rope to secure the scene. It is the first responder's
responsibility to secure the crime scene after declaring the victim
dead.
9. When the IOC (Case Investigation) arrives. The IOC assumes full
responsibility for the crime scene search after asking the first
responder to provide a prompt assessment, and shall conduct a
thorough assessment of the scene and inquiry into incident.
After investigation and evidence collection, the Police Station
Operation Center (PSOC) will request that the SOCO team will
respond to the crime scene area. The IOC will give the SOCO a
briefing when the SOCO team arrived.
10. A few minutes later, the SOCO Team showed up, and the
IOC gave them a thorough briefing on the incident and the case's
background. The SOCO Team Leader conducted a preliminary
walkthrough with the IOC. After that, the entire SOCO Team got to
work processing and recording the scene, which included taking
notes, taking pictures, and drawing the crime scene.
A. One pair (2) of pink slippers that used by the victim, one piece
was on her naked feet and the other was hanging on one of her
feet.
B. One (1) knife
C. One (1) piece of broken glass
D. One (1) Black short
E. One (1) Black slipper
F. One (1) Pink underwear
11. Operation Manhunt is being undertaken, and there is one
local person who lived near in the incident area that recognize the
physical features of the suspect and claimed that he had seen it
roaming around the area. Immediately, after receiving the
Information Report the Police of Toril District led by P02 Luchavez
together with PO2 Aboluyan and the witness go to the place where
the local give them.
12. At exactly 8:30 pm, the suspect was seen in his house
preparing things such as rope and a chair to end his life by doing
suicide but the police make it on time and stop the suspect for
doing his plan he has. By the effort done by PO2 Luchavez and his
buddy PO2 Aboluyan the suspect was caught.
13. The arrested suspects were identified as follows.
A. YUVY D. FRANCISCO, 35 years old, married, Food Panda
Rider, currently residing at Purok 4 Juan Dela Cruz St. Toril
Davao City
IV. INVESTIGATION/FINDINGS
1. The body of the victim carefully examined by law enforcement and
forensic personnel.
2. Forensic Pathologist will perform an autopsy to determine the cause and
manner of death.
3. The witness will be interviewed and will be questioned for some helpful
information to the case.
4. The suspect claimed that he drinks a lot of alcohol before the crime
happens and when he will about to go home, he happens to see her close
friend and that is Ms. Intong walking alone and he approach. He doesn’t
have the plan on raping her but because of the amount of alcohol her
intake the flesh is being lustful. He did not think of killing Ms. Intong but
due to Ms. Intong resisted, he accidentally stabs her in her neck.
5. Forensic Pathologist claim that the victim suffered from the forced entry
of the suspect’s private part that causes bleeding in her private part.
6. A death certificate issued from the Local Civil Registrar was already
taken. This is to prove the death of Yhasmine Intong.
7. Arrested suspects are detained at Davao City Jain pending the filing of
appropriate charges in court.
8. On December 5, 2024, a criminal charge for Rape with Homicide against
the suspect was filed at the Office of the Provincial Prosecution
V. CONCLUSION
10 . According to the results, there is enough circumstantial evidence to
hold Yuvy D. Francisco responsible for any additional proceedings
pertaining to Yhasmine Intong's rape and homicide case.
11 . Confession of the suspect would disclose that he did not intend to
kill the victim.
