AFFIDAVIT OF COMPLAINT

The UNDERSIGNED, Mark Anthony L. Cerujano, accuses Antonio T.


Baltazar, of Murder under Article 248 of the Revise Penal Code, committed as
follows, to wit:

1. That on the 14th day of November, 2024, around 8:30 o’clock in the evening,
at Barangay Rawis Laoang, Northern Samar, Philippines, the said accused
did then and there willfully, lawfully, feloniously, and by means of Treachery,
committed Murder under Article 248 of the Revised Penal Code, upon the
undersigned directly by overt acts to wit:
2. Last November 14, 2024, on or about 6:00 o’clock in the evening, the elder
son of the complainant, Jomar B. Cerujano, asked for permission to attend the
birthday party of his best friend, Juan de Luna. Because of the assurance that
the birthday celebrant was his best friend and a nephew of his father, he
allowed to go.
3. Around 8:00 PM, one of the friends of Jomar said that Jomar is already
around, walking alone and seems to be heading home.
4. After a while, a commotion broke at a near distance, which was followed by
shouting and crying so the complainant, Mark Anthony L. Cerujano, quickly
went to the place. Upon arrival, he saw his son lying in the ground and bathe
of his own blood.
5. According to the eyewitnesses, Antonio, hidden in the shadows, approached
Jomar from behind. Taking advantage of the darkness and Jomar’s
unawareness, Antonio attacked and stubbed him with a knife, inflicting fatal
wounds. The attack was swift and brutal, leaving Jomar no opportunity to
defend himself. Antonio then fled the scene immediately, leaving Jomar alone.
The motive was explicitly jealous over perceived romantic relationship
between Jomar and Antonio’s girlfriend.
6. Meanwhile, upon arrival at the Laoang Hospital, Dr. Dora D. Explorer
immediately attended Jomar and after a thorough examination, declared him
dead on arrival.
7. The stubbing incident was reported on or about 9:00 o’clock in the evening at
nearest police station, at Laoang Municipal Police Station.
8. However, the two witnesses testify and give their oral evidence about the
entire incident.
9. Therefore, the undersigned executed this affidavit freely and voluntarily to
attest the truthfulness of the foregoing facts and to support the filing of
Criminal Case against Antonio T. Baltazar for violation of Article 248 of the
Revised Penal Code.
