CONTEMPT PETITION UNDER SECTION 2 (B) READ WITH 10 & 12


OF THE CONTEMPT OF COURTS ACT, 1971 FOR WILLFUL NON-
COMPLIANCE AGAINST RESPONDENT IMRAN.

MOST RESPECTFULLY SHOWETH:


1. That the above noted case is pending before this Hon’ble
court and now is fixed for 05/12/2024.

2. That this Hon’ble Court had referred both parties to


mediation to facilitate a settlement. Pursuant to this
mediation, the Petitioner and Respondent entered into a
Settlement Deed dated 25.09.2024, which was duly
recorded before this Hon’ble Court. The said Settlement
Deed included specific terms and conditions mutually
agreed upon by both parties with regard to divorce,
payment, child custody, and other related matters.

3. That as per the Settlement Deed, the Respondent, Imran,


agreed to comply with the following conditions.

• Both parties shall take a divorce by mutual consent


within the jurisdiction of the Delhi Court as per
Shariyat Law.

• The Respondent shall pay the Petitioner a total


amount of Rs. 3,00,000/- (Three Lakhs Only) as full
and final settlement, and return her dowry articles.

• The amount of Rs. 3,00,000/- was to be paid in two


installments:

(I) Rs. 1,50,000/- (One Lakh Fifty Thousand Only) to be


paid by 25.11.2024 along with the pronouncement of
Talaq by 09.10.2024.

(II) Another sum of Rs. 1,50,000/- to be paid at the time


of quashing FIR No. 295/23 before the Hon’ble Delhi High
Court.
• The Respondent was to return the Petitioner’s
dowry articles as per the admitted list on or before
09.10.2024.
The custody of the minor child, Baby Sara, would
remain with the Petitioner, with no visitation rights
to the Respondent.

4. That the Respondent has willfully failed to comply with


the agreed terms and conditions of the Settlement Deed, as
follows:

• The Respondent has not pronounced the final Talaq


by the agreed date of 09.10.2024.

• The Respondent has not returned the Petitioner’s


dowry articles as per the admitted list by
09.10.2024.

• The Respondent has not paid the sum of Rs.


1,50,000/- (One Lakh Fifty Thousand Only) to the
Petitioner by the due date of 25.11.2024.

5. the actions of the Respondent constitute a deliberate and


wilful breach of the Settlement Deed and amount to
contempt of court, as specifically acknowledged under
clause 10 of the Settlement Deed. The Respondent's non-
compliance demonstrates a blatant disregard for the
authority of this Hon’ble Court and the terms mutually
agreed upon in good faith by both parties.
6. That the non-compliance by the Respondent has caused
mental anguish and financial hardship to the Petitioner,
who relied on the terms of the Settlement Deed to ensure
an amicable and conclusive resolution of the matrimonial
dispute. The Respondent’s deliberate failure to comply
with the agreement has compelled the Petitioner to seek
relief from this Hon’ble Court through this contempt
application.

PRAYER:

That this Hon'ble Court may be pleased to:


• Initiate contempt proceedings against the Respondent,
Imran, for wilful disobedience of the Settlement Deed dated
25.09.2024 as recorded in Mt. Case No. 541/2022.

• Direct the Respondent to immediately comply with the


terms of the Settlement Deed, including pronouncement of
Talaq, payment of Rs. 1,50,000/-, and return of the
Petitioner’s dowry articles as per the agreed timeline.

• Impose any other penalties or take any other action it


deems fit and proper to uphold the authority of this Hon’ble
Court and ensure compliance with the court-approved
settlement terms.
• Grant any other relief or order that this Hon’ble Court
deems fit and proper in the interest of justice.
