The termination clauses allow either party to independently terminate the employment by giving one month's notice or paying salary in lieu, which balances rights by providing reasonable exit flexibility to both parties . However, the employer holds additional rights to summarily dismiss without notice if misconduct or negligence is found, thus slightly favoring the company's interests in specific circumstances .

The contract allows both the employer and the employee to terminate the employment with one month's prior notice or salary in lieu thereof . The company also reserves the right to summarily terminate the employment without notice or termination payment if misconduct or negligence is evidenced . Upon termination, the employee must return all company property and confidential information .

The contract stipulates that Anurag Rajbhar must maintain company property in good condition and return all property prior to leaving the company. Non-compliance can result in the cost being recovered from him . Failure to return company property at the termination of employment can also lead to further actions by the company, affecting the final settlement .

Anurag Rajbhar, as a Graphic Designer at ADKRITI, is expected to perform duties inherent in his post to the best of his ability and any additional duties as required by the company . In terms of confidentiality, he is required to maintain the highest degree of confidentiality regarding company records, documents, and other confidential information, which includes customer lists, employment policies, and products . Breach of confidentiality obligations can lead to summary dismissal and legal actions .

The contract limits Anurag Rajbhar's engagement in any other business activities by requiring that during his employment he devotes his whole time and attention to the company . He cannot associate himself with or engage in additional work, be it part-time or any other business, without prior permission from ADKRITI .

The contract states that company policies can be declared and altered by ADKRITI at its sole discretion . Such policy alterations are binding on the employee and may override previous terms of the employment agreement to the necessary extent, which implies that Anurag must adhere to updated company policies regardless of initial agreement terms .

The probationary period serves as a trial phase, effective for 90 days from October 15, 2020, which determines whether Anurag will become a core team member of ADKRITI after its successful completion . This period allows assessment of his performance and fit within the organization, impacting his long-term employment status and leading to either confirmation as a permanent employee or potential termination if found unsuitable .

The contract ensures the safeguarding of confidential information by extending the duty of confidentiality beyond the termination of employment . Breaching confidentiality at any time, during or after employment, can lead to summary dismissal and legal action, emphasizing the perpetual commitment to safeguarding company secrets .

The jurisdiction clause specifies that any legal disputes will fall under Indian laws and be subject to the jurisdiction of the High Court in Lucknow . This centralizes potential legal actions to this specific court, shaping legal proceedings by providing a clear legal venue, which can impact logistical and strategic planning for both parties in the event of a dispute .

The contract entitles Anurag to one day of casual leave per month, which must be compensated by working on a non-working day if required . This provision recognizes employee welfare while maintaining flexibility for business demands, impacting work-life balance and operational availability .
