Under the instructions and authority given by my client,
1. Sarpanch, Gram Panchayat Sirsoli,
I serve you with the following notice on behalf of my client to do the
needful.
1. That, my client has filed an appeal before the Collector
Bhandara against the order dated 29.06.2019 by which the
SDO Tumsar wrongly allotted the plot no. 1 in your favour.
2. That, said appeal is pending, but you have illegally brought
construction material on the site of the aforesaid plot, and
you do not have any permission from the Gram Panchayat for
any type of construction, so also such dumping of material
on the site of plot may obstruct the natural flow of rain
water, due to which nuisance may likely to cause, due to you
wrongful act of dumping the material, and in such
circumstance, the action may be taken against you.
3. You are also noticed that, you do not have permission to
construct anything and in such circumstances, putting
material on the road at this stage when the appeal is
pending, such act of yours, is nothing but creating a
nuisance during the pendency of appeal.
4. It is hereby informed to you that, subject to any outcome of
pending appeal before the Collector Bhandara, if any adverse
orders are passed, the Gram Panchayat may likely to
challenge the said order before the appropriate authority
forum. It is therefore noticed to you not to construct during
the subsistence of appeal period of any order passed by the
collector. Do not indulge into hasty actions of illegal

construction and that too without any permission; otherwise
you have to face consequences as per the provisions of law.
5. That, the manner in which you put materials on plot no. 1, it
seems that, you are preplanning to make illegal construction
without any permission, without waiting for appeal period,
your actions suggests so, and you have already started
construction.
6. It is therefore noticed to you not to indulge into illegal
construction, without permission. You are hereby noticed to
stop construction on plot no. 1immediately. So also, kindly
take note that, you have created a nuisance for the villagers
by putting construction materials on and around the Abadi
plot no. 5, and if you continue with such act, action will be
taken against you. By your act the peace and law and order
situation in the village will be disturbed for which you will be
held solely responsible. It is therefore noticed that, remove
the building material as early as possible, most probably
within 3 days from the date of receipt of this notice, or else
my client has instructed me to initiate immediate appropriate
legal action in the courts of law against the wrongful and
illegal act if you continue with. Kindly take note and act as
per law.
