DECISION
Stand charged before this court is herein accused, REYNALDO
ERASQUIN JR. y FAUSTINO for VIOLATION OF SEC. 5 (a) of R.A
9262 in a Criminal Information dated May 7, 2021 committed as
follows:
“That on or about the 5th day of May 2021, in the
City of Las Piñas, Philippines and within the
jurisdiction of this Honorable Court, the above-named
accused, the previous live-in partner of the
complainant AAA with whom he had sexual or dating
relationship, did then and there willfully, unlawfully and
feloniously cause said complainant physical harm by
punching complainant in different parts of her body;
hitting her head several times; and dragging her by the
hair while slapping her, to her damage and prejudice.”
CONTRARY TO LAW”.
Pursuant to Republic Act No. 9262 or the “Anti-Violence
Against Women and Their Children Act of 2004” and its implementing
rules, the real name of the victim as well as those of her immediate
family members are withheld and fictitious initials instead are used to
represent them to protect their privacy.1
On July 29, 2021, accused Reynaldo Erasquin Jr. y
FAUSTINO was arraigned, and with the assistance of his counsel de
oficio Atty. Quennie Agnes Somera of the Public Attorney’s Office
entered a plea of GUILTY to the aforesaid criminal information.

The court conducted a searching inquiry on the voluntariness of
his plea of guilty to Violation of Section 5 (a) R.A 9262. That despite
the admonition given to him by the court on the effects of a plea of
guilty, accused insisted and reiterated his plea of guilty to the
aforesaid criminal information.
The accused plea of guilty shall be considered as a mitigating
circumstance because it was made prior to the presentation of
prosecution evidence.
WHEREFORE, by his voluntary and spontaneous admission
accused REYNALDO ERASQUIN JR. y FAUSTINO is found
GUILTY beyond reasonable doubt for Violation of Section 5 (a) R.A.
9262 and hereby imposes a straight penalty of imprisonment for
THIRTY SIX (36) DAYS of ARESTO MAYOR.
In addition, accused shall pay a FINE in the amount of FIFTY
THOUSAND PESOS (Php 50,000.00) and to indemnify the private
complainant AAA moral damages in the amount of FIVE THOUSAND
PESOS (Php 5,000.00). Moral damages is awarded even without
proof after the court has considered the nature of the offense.
The period during which accused has remained under detention
shall be credited to him provided that he complied with the terms and
conditions of the City jail.
Let a copy of this Decision be furnished the accused and his
counsel, the private complainant and the prosecution for their
information and guidance.
