A. COURSE DESCRIPTION

The course is a study on the interplay of procedural laws


in the resolution of civil disputes with an in-depth focus on the
jurisdiction in civil actions including the recent rules providing
for the expanded jurisdiction of first level courts (R.A. 11567)
and Expedited Procedures in First Level Courts (A.M 08-8-7- SC)
effectively amending the 1991 Revised Rule on Summary
Procedure and 2016 Revised Rules on Small Claims Cases.

The course covers Rules 1 to 39 of the Rules of Court as


amended by the 2019 Amendments to the 1997 Rules of Civil
Procedure (A.M. No. 19-10-20-SC).

The course also includes discussion of appropriate modes


of dispute resolution such as mediation, barangay conciliation
and Court-Annexed Mediation and Judicial Dispute Resolution
(2020 Guidelines for the Conduct of the Court-Annexed Mediation
[CAM] and Judicial Dispute Resolution (JDR) in Civil Cases); Revised
Guidelines of Continuous Trial in Criminal Cases (A.M. No. 15-
06-10-SC).

The study of the rules is supplemented by a study of


applicable jurisprudence.

The course also develops familiarity with relevant legal


forms.

B. COURSE OBJECTIVE

The course endeavors to provide the students with the


fundamental knowledge of Civil Procedure — relevant rules,
concepts and principles as well as a familiarization with related
jurisprudence that interpret, refine and illustrate the rules.
