Lusaran Cebu City Wellness Center Report

An inspection was conducted of illegal earthmoving and concrete structure development for a wellness center in Sitio Pinigturan, Brgy. Lusaran, Cebu City. The development was found to be located within the Central Cebu Protected Landscape without the required endorsements. It is recommended that the owner, Mrs. Ivy Binatero, be invited to a technical hearing and issued a Notice of Violation for violating protected area rules. Photographic evidence of the illegal development was collected and certified.

The undersigned conducted an ocular inspection regarding the development of wellnessland


wellness center on the aforementioned subject, details and information gathered are to wit;

1. The location of the illegal earth-moving activity and concrete structure for landscape is
specifically situated at Sitio Bombil, Brgy. Lusaran Cebu City and formed part of Lusaran
Forest Reserve;

2. Per GPS reading, the area was found to be within Central Cebu Protected Landscape
(CCPL) with a specific geographical coordinate of Latitude: 10.475377 Longitude:
123.888233, WGS 84;

3. According to the caretaker the said earth-moving activity and structure are intended for a
garden landscape owned by Mrs. Ivy Binatero. The dimensions of the structure are
approximately 10x15. The caretaker mentioned that there are no specific details in the
document held by the owner regarding the construction of a structure in the area.

4. During our inspection, we observed that the illegal earth moving and concrete structure for
landscape had already started without the endorsement from SMU-IV and Clearance for
PAMB EXECOM;

5. Based on the management zoning of CCPL, the illegal structure is inside the Multiple Use
Zone (MUZ) based on a WGS84 projection; and

6. Based on the record of SRPAO, Mrs. Ivy Binatero is not a tenured migrant.

Recommendation: Based on the above-mentioned findings, it is recommended that Mrs. Ivy


Binatero be invited for a technical hearing at the soonest possible time and issue a Notice of
Violation (NOV) for violating the PA rules and regulations.
