1 Introduction

1.1 Project Introduction

Background:

ELCITA was established in 2013 under the Karnataka Municipalities Act,1964. The township is spread over 903 acres
and over 2,00,000 employees currently work in Electronics city. One of the primary responsibilities of ELCITA is to
supply water to the companies which is located within the juristic area of township.

Presently, ELCITA sources freshwater from BWSSB. Apart from this, ELCITA has a few borewells which yield limited
quantity of water. In the recent past, BWSSB has reduced the quantity of water supplied to ELCITA. With the
reduced quantity of water, ELCITA is not able to meet the demands from member companies.

It is possible for ELCITA to buy water from local suppliers who supply water through tankers. ELCITA is now
planning to procure freshwater from local suppliers. Since the quality of water supplied locally does not meet
freshwater standards, it has become necessary to install water treatment facilities to treat the locally supplied
water before it is supplied to member companies.

The advantage of this project is to enhance the supply and meet the demand within the township. It is to also
reduce our dependency on one source.

1.2 The Objective of the Assignment

The overall objective of this assignment is to provide assistance to ELCITA to implement a suitable Water Treatment
Plant at its facility, including all aspects of design, drawing and Estimation, procurement, and successful
commissioning of the Project in accordance with the KTPP Policies and Rules (the “Rules”).

The Consultant shall also recommend necessary strengthening measures to ensure that ELCITA has at its disposal
the requisite skills to carry on the management of the Project at the end of this assignment and work to raise
implementation capacity within the Company, who will operate the Project upon completion.

Through the Consultant, ELCITA shall have access to best practice in the implementation of the Project and
procurement of works, as well as advice on specific technical issues. The Consultant shall help in procurement of
good, works and services completely in accordance with the procedures, specifications, and documentation of the
project.

1.3 Recommendations

1. Water Quality Analysis: Conduct a comprehensive analysis of the source water to determine its
impurities, contaminants, and characteristics. This analysis helps in selecting appropriate treatment
processes.

2. Regulatory Compliance: Familiarize yourself with local, national, and international regulations
governing water quality and treatment standards. Ensure the plant design meets these requirements.
3. Treatment Processes: Select appropriate treatment processes based on the contaminants present in
the water source. Processes might include coagulation, filtration, sedimentation, disinfection, and
more. Consider factors like cost, efficiency, and environmental impact of these processes.
4. Capacity and Demand: Assess the required capacity of the plant, considering current and future water
demands. Design the plant to accommodate variations in demand and growth of the community it
serves.
5. Resilience and Redundancy: Plan for redundancy in equipment and treatment processes to ensure
continued operation in case of equipment failure or maintenance. Resilience is crucial in maintaining
consistent water supply.
6. Site Selection and Design: Choose an appropriate location for the plant, considering proximity to the
water source, accessibility, environmental impact, and community needs. Ensure the design integrates
well with the surrounding area.
7. Energy Efficiency: Consider the energy requirements of the treatment processes and explore ways to
optimize energy use. Implement energy-efficient technologies and processes where possible.
8. Maintenance and Operation: Design the plant for ease of maintenance and operation. Accessibility of
equipment, monitoring systems, and ease of repairs are critical for smooth operation.
9. Cost Considerations: Develop a budget for the project, considering construction costs, ongoing
operational expenses, and potential future upgrades or expansions.
10. Safety and Emergency Preparedness: Implement safety protocols and emergency response plans to
address potential hazards or unforeseen events. This includes dealing with chemical spills, equipment
failure, and natural disasters.
11. Environmental Impact: Assess and mitigate the environmental impact of the plant's construction and
operation. Consider water discharge, waste management, and ecological considerations.

1.4 Project Data

1.4.1 General Site Conditions

ELCITA pumphouse located in Phase I Electronics city has a 1.5 MLD (1.2 MLD BWSSB+ 300 KLD Borewell)
capacity water storage sump with 3 nos. of 15HP Booster pumps and have installed 100 KLD Softener system
in Electronics city.

 The estimated total quantity of the contract shall be as per the BOQ referred to in Annexure
1. (Uploaded in KPPP Portal)
 The quantities given in the BOQ referred to in Annexure 1 are approximate guidelines for
estimation purpose only.
 Bidders need to submit a self- declaration that they have not been blacklisted by any
Government agency or any Company / Government department or agency at any point of
time. Certificate format attached (Annexure 2). Such self-declaration shall be given by the
Successful Bidder on an annual basis to ELCITA.
 Payment will be made after the submission of Detailed project report as per scope and joint
review by BIDDER and ELCITA Project Engineer & Chief Executive Officer ELCITA/AO.
 The terms and conditions mentioned in the BOQ in Annexure 1 are an integral part and parcel
of this Agreement.
 The work will be started within 03 days from the date of signing of the agreement.
 BIDDER shall ensure that the correct specifications and make of items as specified in the BOQ
referred in Annexure 1 are maintained/ utilized and bills pertaining to procurement are
submitted to ELCITA.
 BIDDER shall make their own arrangements for labor hutments outside ELCITA estate if
necessary. The welfare and all other statutory measures shall be implemented at their own
cost by BIDDER.

1.5 Evaluation Process

Eligibility Criteria

The proposal failing to meet any of the below pre-qualification eligibility criteria shall be disqualified
and will not be considered for technical evaluation process.

Eligibility Criteria

Financial position: Average annual financial turnover (during the last three financial years) ending 31 st March every
year should be at least Rs. 7 LAKHS (Rupees Seven Lakh only). IT returns or Audited balance sheets in support of
the three years’ financial status of the company shall be submitted.

The technical bid document submitted by the bidders will be evaluated on a maximum of 100 marks. Against this
marking, those bidders who secure 65 marks or above will be invited to participate in Presentation.

1.5.2 Technical Evaluation Criteria

Presentation (Only for the bidders qualified in the Technical Bid):

The bidders will have to give a presentation before the committee exhibiting their company profile on the date and
time intimated by ELCITA. Separate slots will be awarded to each bidder for presentation.

Such of those technically shortlisted applicants will be evaluated by the Evaluation committee to rank their
designs based on the quality and type of presentation based on the below listed parameters.

1.5.3 Technical Scoring and Evaluation

i. This is a Quality & Cost Based Selection (QCBS)

ii. Technical Score (Ts) carries 70% of the weightage.
iii. The Total Technical Score (Ts) will be calculated out of 100 Marks, and shall be evaluated as
below:
iv. The Bidder must score Minimum Qualifying Marks of 70 Points, The Bidders scoring marks
less than the minimum qualifying marks as mentioned above shall be disqualified for
Commercial Bid Opening.

1.5.4 Commercial Scoring and Evaluation

i. This is a Quality & Cost Based Selection (QCBS)
ii. The Financial Score (Fs) carries 30% of the weightage.
iii. The Commercial Bids of Technically Qualified bidders will be opened on the prescribed date
in the portal.
iv. The Financial Score (Fs) of the bidder for the Commercial Bid Component as calculated
below.
a) The bidder with Lowest Qualifying Commercial Bid (CL) will be awarded 100 marks.
b) The Financial Score of other qualifying bidders shall be computed as below.
v. Financial Score of the Bidder (Fs) = (CL/ Commercial Bid of the respective Bidder) X 100
(Adjusted to two decimal Lakh)
vi. The bid price will include all taxes and levies and shall be in Indian Rupees and mentioned
separately.

1.5.5 Final composite bid score and evaluation

i. Technical Score (Ts), as per Section – 2.3, and Financial Score (Fs), as per Section – 2.4,
secured by each bidder will be considered for computing the Final Composite Bid Score.

ii. The bidder securing the highest Composite Bid Score will be adjudicated as the most
responsive Bidder for award of the Project.
iii. The overall score will be calculated as follows: -

viii. The preferred bidder shall be the agency securing the highest Final Composite Score.
ix. In the event of two or more Bidders securing the same composite score, then ELCITA
reserves the right to Declare the bidder whose technical score is highest, among the bidders
who have secured the same composite score as preferred bidder or adopt any other method
as decided by ELCITA.
x. ELCITA reserves the right to confirm the preferred bidder as successful bidder subject to
negotiations and approval of competent authority.
xi. The decision of the ELCITA in selection of the Firm shall be final and binding on the
participating applicants.

xii. ELCITA decision in the selection process is final and ELCITA will neither entertain any
correspondence in this regard nor will be bound to furnish any explanation. The acceptance
of an offer will rest with ELCITA, which does not bind itself to accept the lowest offer and
reserves to itself the authority to reject any or all the offers received without assigning any
reason.

2 Scope of Work

TENDER FOR DETAILED PROJECT REPORT (Detailed Project Report (DPR) for supply, installation,
and commissioning of water treatment plant at Electronics City Industrial Township.

2.1 Objective:
To appoint a competent agency for the preparation of a Detailed Project Report (DPR) for supply,
installation, and commissioning of water treatment plant at Electronics City Industrial Township.

SCOPE OF WORK

1. Successful Bidder should have adequate qualification and technical experience and expertise
towards said work.
2. Bidder should Inspect the site for detailed study for the site conditions.
3. Bidder should examine the raw water quality and set the design criteria for design of water
treatment system.
4. Bidder should prepare suitable capacity of “water treatment” & suitable Treatment methods.
5. Bidder should provide desirable design concept & Design Engineering
6. Technology assortment & finalization of the treatment scheme
7. Reviewing & finalization of the plant layout with respect to site conditions
8. Bidder should provide detailed BOQ.
9. Bidder should assess the vendor capabilities and should provide recommendations.
10. Bidder should Review and approve the good for construction drawing.
11. Bidder should carryout project management consultancy for execution of work and assisting the
execution vendor in selection and procurement of electromechanical Equipment’s.
12. Reviewing the installation & Commissioning activities of the plants
13. Monitor project execution and completion activities and handover procedures
14. Performance analysis and successful commissioning approval of the plant against the successful
installation and commissioning.
15. Bidder should be responsible for offering guidance on documents which are pertaining to effective
maintenance as well as effective operations.
16. Implementation or guidance for best practices to optimize the plant operations.
17. Submission of detailed report on integrity of the plant/ project completion report
18. Site visit while executing the project and provide guidance.

3. Reports and time schedule

4. Terms and Conditions

A. General Conditions:

i. The estimated total value of the contract as per the BOQ updated in Annexure 1.
ii. Technical & Commercial Bid Document uploaded in KPPP portal.
iii. Submit a self- declaration that at the time of submission, they have not been blacklisted by
any Government agency or any Company / Government department or agency in India.
Certificate format attached (Ref: Annexure II). Such self-declaration shall be given by the
Successful Bidder on an annual basis to ELCITA
iv. Payment will be made after the Certification and recommendation by ELCITA Project Engineer
& Chief Executive Officer ELCITA/AO.
v. The terms and conditions mentioned in the BOQ in Annexure 1 are an integral part and parcel
of this Agreement.
vi. The work will be started within 03 days from the date of signing of the agreement/LOI.
vii. BIDDER shall ensure that the correct specifications and make of items as specified in the BOQ
referred in Annexure 1 are maintained/ utilized and bills pertaining to procurement are
submitted to ELCITA.
viii. Before submitting the price bid, bidder should visit the site.

B. Variations & Additions:

i. This is a fixed rate contract & rates will remain constant for the entire Agreement period and
till the completion of the work from the date of Agreement. If there are any additional non-
tendered items of works during execution beyond the tender items, this will be calculated and
paid as per mutual discussion with the BIDDER.

C. Delivery Schedule:

BIDDER shall complete the above-mentioned work within a period of Sixty (60) Days.

D. Payment Terms:

Milestone payments

 On submission of Draft Project Report, 40 % of the Total contract value will be paid.
 On successful submission of the final Detailed Project Report and other deliverables as
per contract and on acceptance by ELCITA, the balance 60 % of contract value will be
paid

i. All bills to be raised in the name of "Electronics City Industrial Township Authority."

E. Taxes:

i. All rates quoted by BIDDER and accepted by ELCITA are inclusive of all taxes.

ii. Any new levies / taxes with respect to the works contract after the tender submission date
will be in the client’s account.
iii. Taxes and levies as applicable will be deducted from invoices.

F. Termination of Contract:

If at any stage after the signing of the agreement, it is noticed that there is a substantial delay of
more than fifteen (15) days from the schedule agreed as per the contract, ELCITA will have the
option to terminate the contract by forfeiting the EMD without assigning any reasons

G. Insurance:

BIDDER shall not have any claim regarding the safety of their tools, plant, workmen which is not
attributable to ELCITA, its employees or representatives, or third parties working or present at
ELCITA site. BIDDER shall take care of all such claims and not raise the same to ELCITA. BIDDER
shall take workmen compensation policy for its workers and a copy of the same shall be provided
to ELCITA.

H. Security and Safety:

BIDDER shall be entirely responsible for the security and Safety of their Employees/Equipment
during and until the completion of the Project.

I. Observance of Labour Laws:

BIDDER shall be fully responsible for observance of all applicable labor laws and other laws
applicable during the execution of the work and shall indemnify and keep ELCITA indemnified
against any effect that it is likely to suffer due to the non-observance of any such laws by BIDDER.
Bidder shall be liable to make payment to all employees and make compliance with all applicable
labor laws.
If ELCITA is held liable as Principal Employer to pay any amounts under the Provident Fund (PF) Act
or ESI Act or any other legislation of Government or Court decision in respect of the employees,
employed.
By BIDDER or their sub-contractor then BIDDER shall reimburse any such amount or such
contributions so
Paid by ELCITA.

J. Confidentiality:

Both Parties hereby undertakes and assures that any data, information and documents, trade
secret, design, financial information relating to both parties shall always be kept confidential by
both parties and shall not be divulged or cause or allow the same to be disclosed to any
person/persons whatsoever whether in the employment of the parties or otherwise (except the
specified employees of the parties having need to know and who are aware that it is confidential

and bound to treat it as such) without the express, prior written permission and consent of the
other party. However, either party may disclose the information, which is available either in the
public domain or the other party is required to disclose by law.
This section shall not apply to information which is (i) in the public domain, (ii) already known to
the recipient and the recipient can show that it was in possession of such information prior to
receipt of such information from the disclosing Party, (iii) developed independently by the
receiving Party without the benefit of any confidential information of the disclosing Party. The
confidentiality obligation shall continue for one (1) year after the expiry/ termination of this
Agreement.
In the event of disclosure by any party being not within the exceptions hereinabove mentioned,
the disclosing party shall be liable for damages suffered by the other party, arising out of such
disclosure as finally awarded by the competent court of law or dispute resolution authority.
K. Indemnity:

Either party shall indemnify, defend, the other party, its employees, representatives, other
consultants etc. from and against all actions, suits, claims, costs, fines, judgments, liabilities and
demands brought or made against such party in respect of violation of applicable laws and
regulations of all government authorities.
ELCITA shall indemnify and hold harmless the Bidder for all loss or injury, or damage caused to
property/any third party/person/Bidder’s employees, representatives, agents etc. by ELCITA or
any third-party present at its site, or otherwise occurred during the performance of services under
this contract due to reasons attributable to ELCITA or any third-party present at its site.
L. Jurisdiction & Governing Law:

This Agreement shall be governed by the laws of India and the Courts at Bangalore alone shall
have sole and exclusive jurisdiction over matters connected to/in relation to this Agreement. The
proceeding shall be in English language only. In the event of any dispute arising out of the
Agreement, the same shall be settled by binding arbitration conducted by a sole arbitrator
appointed jointly by both Parties and governed by the Arbitration and Conciliation Act, 1996. The
venue of arbitration shall be Bangalore. The language of the arbitration proceedings shall be
English. Any dispute arising in relation to this Agreement shall be subject to the jurisdiction of the
courts at Bangalore.
M. JV/Subcontracting & Assignment:

Joint venture/ Consortiums are not allowed.

BIDDER shall not assign or subcontract the Services to any third party without the prior written
consent of ELCITA.

N. Succession:
This Agreement shall be binding upon and inure to the benefits of respective successors and
Permitted assigns of the Parties.

O. Amendment Etc.: No modification, alteration, or amendment of this Agreement or any of its terms
or provisions shall be valid or legally binding on the parties unless made in writing duly executed by
or on behalf of both the Parties hereto.

P. Counterparts:
The Agreement will be executed in original in two sets and both the Parties shall keep one copy.

Q. In the event of inconsistencies between the BOQ in Annexure 1 and this Agreement, the terms
and conditions of the Agreement shall prevail.

R. Entire agreement:
This Agreement shall continue the entire agreement with respect to the subject matter hereof, and
May be modified or amended by the mutual written consent of the Parties.

SELF DECLARATION CERTIFICATE

1. I, Director/authorized signatory of the company,

mentioned above, is competent to sign this declaration and execute this tender
document.

2. I have carefully read and understood all the terms and conditions of the tender and
undertake to abide by them except the changes suggested by using our proposal.
