The training period is generally one year unless stated otherwise in the curriculum for Sandwich students. If the training gets interrupted—due to conditions such as securing employment or health issues—apprenticeship arrangements can be legally concluded, though this impacts the contractual obligations and might necessitate compensation or a formal agreement on the part of the employers or apprentices .
An apprentice undergoing training is considered a trainee rather than a worker, meaning labor laws that apply to employees do not apply to apprentices. This status highlights that the primary purpose of the apprentice is to receive training rather than contribute as an employee, thus distinguishing them from regular workforce members .
An apprenticeship contract can be terminated without compensation if the apprentice secures gainful employment elsewhere, provided they produce the appointment order as proof, or if they are unable to continue training due to medical reasons, substantiated by a certificate from a civil surgeon or higher medical authority .
Apprenticeship training plans must be revised if initial conditions or mutually agreed terms in the apprenticeship contract change. Also, based on apprentice performance or when breaches of the training contract occur, adjustments may be required to realign with original objectives, or adaptations might be necessary in response to regulatory changes or feedback from the Regional Central Apprentice Adviser .
The primary obligations of an apprentice include abiding by the rules and regulations of the establishment in all matters of conduct, discipline, and safety. The apprentice is required to diligently learn their subject field, attend practical and instructional classes regularly, and maintain a record of work during the apprenticeship period. Additionally, apprentices must carry out all lawful orders from the employer and superiors in the establishment .
Employers must formulate a comprehensive training programme for apprentices that is approved by the respective Regional Central Apprentice Adviser. They must also appoint a suitable person to oversee the training process to ensure compliance with the provisions of the Act and proper skills transfer to the apprentices .
An apprentice becomes ineligible to enter a new apprenticeship contract if they fail to comply with the terms of the current contract and it gets terminated. Additionally, the apprentice must refund any training costs incurred by the employer as determined by the apprenticeship advisor, which further restricts re-entry into a new apprenticeship agreement .
Maintaining detailed records enables apprentices to track their progress and helps ensure that training experiences align with program requirements. This practice is crucial for both apprentice assessments and for the employer to furnish accurate reports to regulatory bodies, thus reinforcing discipline and providing an accountability framework during the training period .
If an employer breaches the contract, they are required to compensate the apprentice with an amount equivalent to the last three months of the stipend. This compensation is due when the contract is terminated due to the employer’s failure to fulfill the agreed terms .
The contract does not obligate the employer to offer employment post-training, nor does it require the apprentice to accept such an offer unless a prior agreement has been documented in the apprenticeship contract mandating post-training employment. In such cases, the employer must offer and the apprentice must accept employment under specified terms, pending approval from the Central Apprenticeship Adviser .
