Special Dispensation for BPS-1 to BPS-16
The conditions include that the dispensation is only for civil servants in BPS-01 to BPS-16 excluding those paid out of Defence Estimates and who receive Disparity Reduction Allowances, except certain high offices like the President's Secretariat. Employees drawing the pay of BPS-17 by any means are not eligible. Availing this dispensation means one chance of grant of higher time scale under the Time Scale Policy-2022 will be considered lapsed. There is no involved upgradation of posts except for LDC/UDC. No premature increment is granted, and beneficiaries continue receiving allowances according to their substantive scales .
The memorandum specifies that incumbents in BPS-01 to BPS-05 will receive two higher pay scales as a one-time dispensation if they have not benefited from the Time Scale Policy-2022, with their substantive pay scales remaining unchanged. Those in BPS-06 to BPS-15 will be granted the next higher scale if they have not availed themselves of the time scale under the Time Scale Policy-2022, also without change to their substantive pay scales. If they have already availed of the time scale, they will only receive one additional increment on their current pay scale as a one-time dispensation .
The memorandum specifies that the dispensation is only admissible to civil servants receiving Disparity Reduction Allowances. However, this condition is omitted for certain high offices like the President's and Prime Minister's Secretariats, indicating a partial addressal of disparity concerns by focusing on average civil servants rather than top offices .
The posts of Lower Division Clerk (LDC) and Upper Division Clerk (UDC) are upgraded from BPS-09 to BPS-11 and BPS-11 to BPS-13, respectively. The incumbents benefit from this upgradation, which contrasts with general conditions that avoid post upgrading. The Establishment Division will amend Recruitment Rules as per the upgradation policy .
The Anomaly Committee is tasked with addressing issues arising from the implementation of this dispensation, with its decisions being final. However, any amendments to this dispensation require the recommendation of the Anomaly Committee and Prime Minister's approval .
The special dispensations are effective from January 01, 2023 .
The conditions ensure financial sustainability and organizational consistency. For employees in BPS-16, the memorandum provides that they will be granted one additional increment as a one-time dispensation .
The Recruitment Rules will be amended by the Establishment Division according to the upgradation policy. Specifically, these changes will reflect the upgradation of Lower Division Clerk from BPS-09 to BPS-11 and Upper Division Clerk from BPS-11 to BPS-13 .
Civil servants in BPS-06 to BPS-15, who have already availed themselves of the time scale benefit under the Time Scale Policy-2022, will receive only one additional increment as a one-time dispensation, rather than a higher pay scale .
