1.1 INTRODUCTION TO EMPLOYEE RIGHTS AND


RESPONSIBILITIES

A workplace or an organization is generally a place of diverse people having


diverse regions, backgrounds, expertise, degrees, communities, and cultures.
They all join hands together and are expected to work to the fullest by 100% to
achieve a company’s common goal as a whole. There are few Employee Rights
and Responsibilities for every employer and employee in an organization.

It structures the entire system in a relatively straightforward manner. Every


employee and the employer working with the company is assigned certain
rights and specific responsibilities. Each member of the company has the
clarity of what they are supposed to do after coming and putting attendance at
the organization.

The Roles, employee Rights and Responsibilities of each working with the
organization hold the vitality to a point where if disturbances occur due to the
undefined roles and responsibilities, the results are cumbersome and difficult to
manage.

It is true because all the people, departments, or teams made in the future hold
the common goal, and they all are interested and interdependent. If there is a
delay in the work done from one end, it might badly affect the
other department’s tasks and responsibilities

Employee Responsibilities

Every employee linked with the company is allocated specific responsibilities


to accomplish daily, weekly, or monthly. This responsibility defines the precise
path that needs to be followed by an employee daily. Employees get paid by
working successfully on such duties. Defining commitments also help the
organization avoid chaos or confusion among employees regarding what needs
to be done. This clarity indeed also helps the company in achieving its goals
faster than expected.

Employee rights

Employee rights refers to a variety of measures that safeguard employees in the


workplace. Employee rights vary depending on the company and the industry
in which it operates. However, every employee, in any company, is entitled to
certain benefits. At the workplace, all employees have basic rights such as the
right to eat, the right to be safe, the right to be paid for the work they do, the
right to join trade unions, and the right to gather – including the right to
privacy, fair compensation, and freedom from discrimination, and the right to
seek access to justice.

1.1.1 The Rights of Employees in India

Right to complain or protest about work- 

Every employee has a right to protest or complain about the working


conditions this is provided by the Factories act, 1948.

The law says that every worker has the right to protest and object against
improper working conditions.

Right to get equal pay for equal work-

According to the Equal Pay Act 2010, every employee, whether a man or
woman, has the right to get equal pay for the equal amount of work they do.
There should not be any bias done while paying the employees based on their
gender, caste, creed. 

Right against sexual harassment at work –

Sexual harassment is unwanted sexual behavior towards another person. A


man or woman both have the right to be free from harassment at work. The
employers are responsible to take necessary steps if any complaints of sexual
harassment are reported to them.

Right to workplace health and safety

-Safe and healthy working conditions are vital for an individual to work
efficiently and be free from dangerous haphazard.

Right to gratuity-

Gratuity is a benefit provided to the employees at the time of retirement,


termination, or employees death. An organization is supposed to pay gratuity
to its employees who have worked for a continuous prolonged period with the
same organization i.e. 5 years or more.

Right to maternity benefit-

The Maternity Benefit Act 1961 provides rights and benefits of maternity to
women employees. It helps women to maintain a balanced family and work
life.

Right to timely salary- Many employees depend on their salaries to run their
houses. Providing a timely salary not only encourages an employee to toil hard
but also protects their rights and maintains a sense of security.

1.2 SIGNIFICANCE OF THE STUDY

The study has been undertaken to examine the employee rights and
responsibilities and how its impact on employees in the organization. The main
purpose of this study is to get deep into the different types of rights that exist in
companies that are medium-sized and how the rights are put into action. This
study is concerning Emami limited

1.3 OBJECTIVES OF STUDY

To study the employee rights and responsibilities of the company.

To study the structure and function of rights and responsibilities in the


company.

To equip us with experience and learning about how we can apply our
classroom knowledge in reality. Learning the concept is very different from
experiencing them at a concrete level.

To find out the key techniques that make the rights effective and valuable in
the company.

Suggest strategies to improve rights of this company.

To identify the various avenues for improving the rights and responsibilities of
this company.

To know about the various situations by establishing relationships between real


and significant factors in a situation.

To study how consistently rights have been implemented.

1.4 SCOPE OF STUDY

The study will be conducted in the account department, registry and main court
administration in the Court of Appeal Complex. The study will be designed to
sample the view so employees and management within the departments.

1.5 RESEARCH METHODOLOGY

METHOD OF DATA COLLECTION

The researcher has chosen the questionnaire method of data collection due to
limited time in hand. While designing data-collection procedures, adequate
safeguards against bias and unreliability must be ensured. Researchers have
examined the collected data for completeness, comprehensibility, consistency,
and reliability.

HYPOTHESIS OF PROJECT

Human Resource Policies provided by the organization of employees work as


an agent for the growth of employees and also motivate the employees to
perform well i.e., employee performance and satisfaction is the valuable
outcome of the sound of Employee right and responsibilities of the
organization.

ABOUT THE QUESTIONNAIRE

In this method, a questionnaire is sent to the HR Manager concerned with a


request to answer the questions and return the questionnaire. The questionnaire
consisted of several questions printed or typed in a definite order. The HR
Manager has to answer the questions on their own.

In the sampling method, data is collected from the sample selected on a


random basis from the given population for examination and conclusion.

Sources of data : There are 2 types of data:

Primary data:

Primary data is the data that has been collected for the first time with especially
a purpose in mind. Primary data is often very time-consuming to assemble, and
generally costs more to create than purchasing secondary data reports. It should
be relevant, current, and as impartial as possible.

Secondary data:

This process involves collecting data from either the originator or a distributor
of primary research. In short, it means finding information from third-party
sources such as marketing, reports, company website, magazines, articles, and
other sources.

Data collection:

For the present study purpose, a total of 60 employees of the company were
approached by using convenient random sampling. Statistical calculations have
been made, with the help of Microsoft word. Appropriate tools for data
analysis have been used as per the requirement of the study.

1.6 LIMITATION OF STUDY

Due to the lack of time with authority, we could not get full information about
the Employee rights and responsibilities in Emami Limited . Sample size
selected may not be the true representative of the company, resulting in biased
results. Lack of cooperation from employees and the workers they do not want
to give their full contribution to the research. The companies are not ready to
disclose each and every rights that they follow in the organisation

3.1 CONCEPTUAL BACKGROUND OF


DEMOGRAPHIC PROFILE

1. The researcher expected that the age group of 30-40 years as most
respondents
2. The researcher expected that males and females are nearly equal
number of respondents.
3. The researcher expected that most of the respondents would have been
post graduation as this questionnaire would be targeting all age groups.
4. The researcher expected that not every employee from the different
departments will respond to the demographic profile but they got a
pretty good response from every department

3.2 ACTUAL WORKING OF DEMOGRAPHIC


PROFILE FOLLOWED BY DATA PRESENTATION

1. The questionnaire was filled out by all age groups & it was quite great
that more than half respondents cooperated properly to fill out the
questionnaire but a few were not interested they just auto-filled the
questionnaire.
2. Most of the respondents were of the age group were between 30-40
years .
3. Male respondents more than female respondents.
4. In terms of qualification, most of the respondents were post-graduated.
5. Most of the respondents were married.
6. Most of the respondents were from the finance department.

5.1Findings

Age of respondents

The highest age group of respondents in the company are below 20


years of 21.7%. ,30% are between 20-30 years,41.7% are between 30-
40 years and 6.6% are above

Gender

From the above graph it is infer that 51.7% of the respondents are male
and 48.3 % of the respondents are female

Educational qualification

In the organization 35% of the respondents have completed their


graduation and 36.7% of the respondents have completed their post-
graduation and 16.7% are professionals. 11.7% of the respondents are
studying

Marital status

From the above graph it is infer that 43.3% of the respondents are
married and rest 56.7% of the respondents are unmarried.

Department

From the above graph it is infer that 48.3% of the respondents are in the
HR Department while 11.7% of the respondents are in the Marketing
department. 18.3% of the respondents are in Production department and
rest 21.7% of the respondents are in the Finance department.

CONCLUSIONS

Based on the results of the analysis that has been done, the managerial
implications of this research for companies on the Emami LTD to make
the employee of the company are mainly employee of part of the
production to be able to further improve its performance in the
company, which can be done by way of improving the recruitment
process is good, the retention of good employee and keeping the labor
relations between employee.

The increase in recruitment can be done by industrial firms at Emami


LTD by creating work environments that are not discriminatory,
because now the results of the research shown, the batik industry
employee in Solo still feel any discrimination in the work environment.
Increased employee retention can be done by the company by creating
comfort for employees, because employee still feels less happy while
working.

The improvement of the working relationship can be done by


improving the quality of communication between employee, as many of
them still feel less receive feedback from other employers.

 Companies on the Emami LTD may consider to improve the


suitability of the recruitment process by the company because of
its links with the retention of employees, in accordance with the
first hypothesis.

 Company may consider increasing employee retention because it has a


relationship with labor relations

 Improve working relationships between employees because it proved to


have a relationship with the employee's performance

 The Training should be mandatory for all levels of employees

 A more transparent and full-proof communication system developed in


the organization

 Wages and salary administration process should have a more scientific


approach laying stress on equal wages for equal work done.
