Said Executive Order can be considered as violative of the Constitution, specifically the right to life
of both the mother and the unborn and the duty of the the duty of the State to protect both the life of
the mother and the life of the unborn from conception. Said Executive Order also denies the general
public the right to health and access to medicines and access to contraceptives. Further, said Executive
Order also denies a person's right to due process of law as the aforementioned rights were deprived to
the inhabitants of Cagayan De Oro City without observing due process of law.
These rights are found in the Constitution which can be enjoyed by the general public for their
protection and benefit subject to certain limitations as provided under the law. Hence, the deprivation
of these Constitutionally enshrined rights are violative and constitutionally infirm.
