1. The information contained in this Tender is being provided by IRCTC for the open tender
purposes of enabling the Bidders to participate and submit a bid in response to this tender for the
appointment of On-board Service Provider for the tourists of AC Deluxe Tourist Train. In no
circumstances shall IRCTC, or its respective advisors, consultants, contractors, servants, and/or
agents incur any liability arising out of or in respect of the issue of this Tender, or the Bidding
Process.
2. The objective of the Bid document is to provide the prospective Bidder(s) with all the relevant
information to assist in formulation of proposals or bids.
3. This Tender may not be appropriate for all persons, and it is not possible for the IRCTC, its
employees or advisors to consider the investment objectives, financial situation and particular
needs of each party who reads or uses this Tender. The assumptions, assessments, statements and
information contained in this Tender may not be complete, accurate, adequate or correct. Each
Bidder should therefore, conduct its own due diligence, investigations and analysis and should
check the accuracy, adequacy, correctness, reliability and completeness of the assumptions,
assessments, statements and information contained in Tender and obtain independent advice from
appropriate sources.
4. Nothing in Tender shall be construed as legal, financial or tax advice. IRCTC will not be liable
for any costs, expenses, however so incurred by the Bidders in connection with the preparation or
submission of their Bid. IRCTC reserves the right to amend this Tender or its terms and any
information contained herein or to cancel the Bidding Process or altogether abandon the Project
at any time by notice, in writing, to the Bidders. Further, it may in event be assumed that there
shall be no deviation or change in any of the herein-mentioned information.
5. IRCTC may, in its absolute discretion but without being under any obligation to do so, update,
amend or supplement the information, assessment or assumptions contained in this Tender.
6. Laws of the Republic of India are applicable to this Tender.
7. Each Bidder’s acceptance of delivery of this Tender constitutes its agreement to, and acceptance
of the terms set forth in this Disclaimer. By acceptance of this Tender, the recipient agrees that
this Tender and any information herewith supersedes document(s) or earlier information, if any,
in relation to the subject matter hereof.

PREAMBLE
Indian Railway Catering & Tourism Corporation Limited (IRCTC) is a Mini Ratna PSU under the Ministry
of Railways. Promotion of rail based tourism is one of the foremost line of business for IRCTC, amongst the
many mandates given by the Ministry to Railways, which include off board and onboard catering, production
and distribution of packaged drinking water (Rail Neer) and Internet ticketing.
The AC Deluxe Tourist Train is run by IRCTC covering the Pilgrimage and Tourist destinations in India. AC
Deluxe Tourist Train is arguably the only train in its segment.
Through this E-tender, IRCTC wishes to appoint a Service Provider for providing comprehensive on-board
services including catering, housekeeping, security services, station arrangement etc.
Since a large number of tourists from all over the world travel on this train, all services on the AC Deluxe
Tourist Train are of the best standards in keeping the package up to the international standard so as to
maintain the image of country, IRCTC as well as Indian Railways, associated with it.
The AC Deluxe Tourist Train has a composition of 12 coaches with different 04-FAC (First AC) and 02- 2nd
AC, 02- Dinning Cars, 01- state of the art electric based kitchen car, 01- 3rd Ac Staff Coach along with 02
generator power cars.
The AC Deluxe Tourist Train is operational generally for the entire year on Pan India basis on
schedule/special/customized itineraries & charters. During this run, full scale services on the lines of a
Star category deluxe hotel shall be provided to the guests of AC Deluxe Tourist Train. Onboard Service
Provider is expected to provide comprehensive onboard services as per standards of a star category deluxe
hotel.
Intending bidders are requested to thoroughly read the contents of the document before bidding. Although, all
efforts have been made to incorporate the necessary details, standards of service in the document, the Service
Provider shall undertake to provide all onboard services in the spirit that the services are of the standards of a
star category deluxe hotel for tourists.

3. All bid documents like Check list, Technical bid and commercial bid will be submitted concurrently
in the website [Link]
4. No claim shall be entertained on account of disruption of internet service being used by bidders.
Bidders are advised to upload their bids well in advance to avoid last minutes technical snags.
6. It is mandatory for all the applicants to have Class III Digital Signature Certificate (in the
name of person who will sign the bid documents) from any of the licensed certifying agency.
7. To participate in the e-tendering submission, it is mandatory for applicants to get registered their
firm/company in e-tendering portal of IRCTC [Link] to have user ID
& password.
8. Bidders shall ensure to quote rate item. If any cell is left blank and no rate is quoted by the bidders,
the rate of such item shall be treated as “0” Zero.
9. Complete tender paper shall be received online as per date and time mentioned above. Tender
shall be opened through e-tendering system.
10. An online pre-bid meeting shall be held at 1200 hrs on 20.09.2021, the link for which shall be shared
on [Link] one day prior to the date of pre-bid meeting. The bidder is required to submit
its questions/suggestion/clarification (if any)) within a period of three days after pre bid meeting at
asingh4734@[Link] for decision by the IRCTC. The queries received after stipulated time will not
be entertained.
11. Technical bid (Part A) and Financial bid (Part B) should be uploaded prior before tender closing by
15.00 hrs. on 28.09.2021.

12. Tenders should be filled with neat, legible and correct entries. Indistinct figures should be avoided.
The amount/rates should be filled in figures as well as words. In case of any discrepancy in the
amount quoted by the bidder in figure and words, the amount which results in lowest/unit payable by
IRCTC will be taken in to consideration.
13. Tenders should be filled in the Excel format provided on web: [Link]/IRCTC. Make
sure to click on the submit button and acquire acknowledgment.
14. Each page of the tender documents is required to be digitally signed by the authorized person/persons
submitting the Tender in token of his/their acquainted himself/ themselves with the Instructions to
tenderers, schedule of works, and conditions of the Tender. Any tender document not digitally
signed shall be liable for rejection. No addition/alteration/material cutting shall be accepted.
15. The Tender shall remain open for acceptance for 120 days from the date of opening of tender.
16. Joint Venture (JV)/ Consortium Bidders are not eligible to participate.
17. IRCTC reserves the right to reject any/all Tenders without assigning any reason.
18. The Notice Inviting Tender and the enclosed instruction to tenderers, schedule of work, price
schedule and conditions shall form part of the tender document. This document consists of 54 pages
including one Index page and one cover page.’

• The firm should own or operate at least one hotel having minimum 50 rooms and attached multi-cuisine
restaurant operational for a period of two years in the last five years.
• Should have turnover of at least Rs. 2 crore in each of the preceding three Financial Years (2017-18, 2018-
19 and 2019-20) and aggregate turnover of Rs. 6.70 Crores in the last three financial years (2017-18, 2018-
19 and 2019-20) from hotel operations.
OR
Category 2
• The firm should have experience of providing onboard hospitality services for a period of two
years/seasons in the last five years on any one or more tourist trains – Buddhist Circuit Tourist Train,
Maharajas’ Express, Golden Chariot Train, Deccan Odyssey, Palace on Wheels
or
• The firm should have experience of providing onboard catering/hospitality services on at least one
Rajdhani/Shatabdi/Duronto/Tejas/Gatimaan trains of Indian Railways for a period of two years in the last
five years.
• Should have turnover of at least Rs. 2 crore in each of the preceding three Financial Years (2017-18, 2018-
19 and 2019-20) and aggregate turnover of Rs. 6.70 Crores in the last three financial years (2017-18, 2018-
19 and 2019-20) from catering/hospitality services from the business of onboard hospitality services in
trains mentioned in the above criteria.
Note:
"The data submitted by the successful bidder, in compliance of the above qualification Criteria shall be
subject to verifications by IRCTC itself or through an agency (expert in forensic audit) appointed by IRCTC,
for which all necessary documents shall have to be essentially provided by the bidder, if so required. If the
successful bidder is found to be ineligible on such verification, the letter of award will be terminated along
with forfeiture of Security Deposit. In such eventuality the successful bidder will also be debarred for 3 years
from participating in the future projects of IRCTC."

The entire process of evaluation of the Bids / offers shall be in two stages:
(i) I
Stage The Technical bid- Tender shall be opened through e-tendering system.
(ii)
Step 1: Scrutiny of Complete tender paper, as per date and time mentioned above.
Step 2: The physical verification of technically qualified bidders credentials (office premises/
original documents/financials/ vehical contract etc.) by IRCTC officials
The financial bid of only those Bidders shall be opened who are shortlisted in Technical Bid as per
documents submitted and result of physical verification.
Stage II The Financial bid will be opened only after qualifying for Technical Bid. Tender shall be opened
through e-tendering system
(iii) The lowest financial quote (Lowest Consolidated Total Rate = (A+B+C+D+E+F+G), subsequent to
successful technical eligibility will be considered for tender execution. (As given in financial bid, Annexure
I). Pattern for Calculation of financial bid to arrive at L1 as given in Annexure H.
The AC Deluxe Tourist Train may be operational for the entire year or part thereof on Pan India basis on
schedule/special/customized itineraries & charters for different packages/ itinerary of domestic tourist
destination for different duration as decided from time to time. The menu for the domestic circuit packages
(other than Buddhist circuit) is shown at “Annexure E” and payment of meal/services on the domestic sector
itineraries shall be made on actual during the journey. The rate of services on domestic sector shall be based
on the fixed percentage of the rates quoted for Buddhist Circuit itinerary “Annexure H”. The evaluation of
tender (L1 bidder) will only be done only on the basis of rates quoted for Buddhist Circuit itinerary.
3. Tender Clarification:
During tender evaluation, IRCTC may, at its discretion, ask the Bidder for a clarification of its tender. The
request for clarification and response shall be in writing, and no change in the price or substance of the tender
shall be sought, offered or permitted in response.

29. In case IRCTC is required to meet any liability in respect of any person(s) engaged/employed by the Service
provider by virtue of their working at the premises of IRCTC, it would be open and lawful for IRCTC to
deduct the amount(s) of any such liability from and out of dues payable to the Service provider.
30. All preventive and safety measures shall be taken by the personnel to ensure that no damage to
material/train/person(s)/machinery and or to equipments take place during the course of performing their
duties. The Service provider shall indemnify/compensate IRCTC fully in respect of such
losses/damages/claims/demands. The loss/damage so occurred will be assessed and calculated after joint
investigation/inquiry by authorized representatives of both the parties and the same will be recovered from
the Service provider or deducted/adjusted from/against the bills.
31. The Service provider shall be responsible for all types of injuries and accidents to staff, employed by him.
32. The Service provider shall be responsible for the conduct and behavior of his employees. If any employee
of the Service provider is found misbehaving with the tourists or staff of IRCTC, the Service provider shall
take necessary and appropriate action immediately including replacement.
33. In the event of any loss/damage being occasioned to IRCTC on account of the negligence of the Service
provider's employees, the Service provider shall make good the loss sustained by IRCTC either by
replacement of the material/equipment or payment of compensation.
34. The Service provider shall take proper instructions from time to time from IRCTC for the execution of the
contract at the different places and will faithfully comply with the same during the currency of the contract.
35. If the IRCTC notices that the personnel of the Service provider has/have been negligent/careless in
rendering the said services, the same shall be communicated immediately to the Service provider who will
devise corrective steps immediately to avoid recurrence of such incidents and report to the IRCTC its action
plan.
36. If any of the personnel of the Service provider indulges in theft or any illegal/irregular activities,
misconduct, the Service provider will take appropriate action required as per law against its erring
personnel and intimate accordingly to the IRCTC. If any theft or loss of any of the items of the IRCTC
occurs during the period of this Contract, the Service provider shall be liable for the same and shall make
good the loss.
37. The Service provider shall at all times indemnify and keep indemnified the IRCTC against any/all claims
of/by its employees including but not restricted to the claims under the Workmen's Compensation Act,
1923; Payment of Wages Act; Payment of Bonus Act; Employees' Provident Funds & Miscellaneous
Provisions Act; Payment of Gratuity Act, Minimum Wages Act, Employees' State Insurance Act or any
other Act(s) or statutory modifications thereof or otherwise for or in respect of any claim for damage or
compensation payable in consequence of any accident or injury sustained by any worker or other personnel
of the Service provider or in respect of any claim, damage or compensation under Labour Laws or any other
laws or rules made there under, by any person whether in the employment of the Service provider or not,
who provided or provides the said services under this Contract.
38. The employees/agents of the Service provider shall never be considered to enjoy any right to enter the
Train by virtue of this Contract or otherwise at any time except with the prior permission of the IRCTC.
39. In the event of failure of the Service provider to provide the services or part thereof, as mentioned in this
Contract for any reasons whatsoever, the IRCTC shall be entitled to procure services from other sources and
the Service provider shall be liable to pay forthwith to the IRCTC, the difference of payments made to such
other sources, besides damages at double the rate of payment for the period of failure in providing the
services or part thereof.
40. If, at any time, during the operation of this Contract or thereafter the IRCTC is made liable in any manner
whatsoever by any order, direction or otherwise of any Court, Authority or Tribunal, to pay any amounts
whatsoever in respect of or to any of the present or ex-personnel of the Service provider or to any third
party, the Service provider shall immediately pay to the IRCTC all such amounts and costs also and in all
such cases/events the opinion of the IRCTC shall be final and binding upon the Service provider. The

41. The Service provider further agrees to absolve the IRCTC from all the liabilities in regard to any statutory
enactments to the extent applicable to the service provided by the Service provider. It is clearly
understood that should the IRCTC be called upon to make any payment to any authority, the Service
provider shall reimburse such amounts to the IRCTC whether such liability arises during the currency of
this contract or after expiry of the period of this contract. If there would be any claim on the IRCTC for
any default of the Service provider or its employees committed during the operation of this Contract, the
Service provider shall pay the IRCTC such amount on demand without protest.
42. Payment and Taxes
i) All applicable taxes and billing procedures should be complied by the Service Provider.
ii) Billing to customers for optional/extras/supplements if any shall be done by IRCTC.
iii) The Service Provider will quote rates for providing services, exclusive of GST. The quote should be
made in terms of Indian rupees. Quote should be in absolute terms without any alteration/ over writing
and should be specific for each item.
iv) At any later stage, if the Govt. brings about any changes in Taxation laws, IRCTC shall pay taxes as per
the revised tax structure.
v) The Service Provider will raise the bill on IRCTC for service provided issued/ delivered to the
passengers.
vi) Bill/Invoices shall be raised in GST invoice (as applicable).
vii) Tax at source will be deducted as per the Income Tax Rules applicable from time to time.
43. Quality & Hygiene and Fines
i. In order to maintain excellent quality of the Products, Service Provider will strictly comply with the best
industry practices and standards regarding the Quality & Hygiene Procedures.
ii. All ingredients for preparation of meals used by the Service Provider should be of international quality at
par with best in the industry with AGMARK, ISI, FSSAI, etc. certifications/classifications/approvals.
iii. Service Provider shall use the best cleaning material using the best industry practices for housekeeping
activities.
iv. The quality of onboard services including food and beverages, housekeeping should conform to AC
Deluxe hotel standards and should be to the satisfaction of the passengers and IRCTC. IRCTC will obtain
feedback from the passengers and the performance of the Service Provider may be reviewed on the basis
of the same. IRCTC reserves right to take action against the Service Provider based on the feedback of
the passengers.
v. During official inspection(s) by IRCTC/Railway Officers, any complaints/shortcomings may also attract
penalty up to 20000/- including termination of contract.
vi. IRCTC may impose down a penalty up to 20000/- depending upon the level of complaint for each
occasion. On repeated substantiated complaints IRCTC may terminate the contract.
44. DISPUTE REDRESSAL MECHANISM
1. In the event of any dispute or difference between the parties hereto as to the construction or operation of this
contract, or the respective rights and liabilities of the parties on any matter in question, dispute or difference
on any account or as to the withholding by IRCTC of any certificate to which the contractor may claim to
be entitled to, or if IRCTC fails to make a decision within 120 days, then and in any such case, but except in
any of the “excepted matters”, the contractor, after 120 days but within 180 days of his presenting his final
claim on disputed matters shall demand in writing that the dispute or difference be referred to arbitration.
2. The demand for arbitration shall specify the matters which are in question, or subject of the dispute or
difference as also the amount of claim item-wise. Only such dispute(s) or difference(s) in respect of which
the demand has been made, together with counter claims or set off, given by the IRCTC, shall be referred to
arbitration and other matters shall not be included in the reference.

c) IRCTC shall submit its defence statement and counter claim(s), if any, within a period of 60 days of
receipt of copy of claims from Tribunal thereafter, unless otherwise extension has been granted by
Tribunal.
d) Place of Arbitration: New Delhi.
3. No new claim shall be added during proceedings by either party. However, a party may amend or
supplement the original claim or defence thereof during the course of arbitration proceedings subject to
acceptance by Tribunal having due regard to the delay in making it.
4. If the contractor(s) does/do not prefer his/their specific and final claims in writing, within a period of 90
days of receiving the intimation from the IRCTC that the final bill is ready for payment, he/they will be
deemed to have waived his/their claim(s) and IRCTC shall be discharged and released of all liabilities
under the contract in respect of these claims.
45 (II) Obligation during Pendency of Arbitration:
Work under the contract shall, unless otherwise directed, continue during the arbitration proceedings, and no
payment due or payable by IRCTC shall be withheld on account of such proceedings, provided, however, it
shall be open for Arbitral Tribunal to consider and decide whether or not such work should continue during
arbitration proceedings.
46 (III) Appointment of Arbitrator:
1. In cases where the total value of all claims in question added together does not exceed Rs. 25,00,000
(Rupees twenty five lakh only), the Arbitral Tribunal shall consist of a Sole Arbitrator who shall be
nominated by the CMD/IRCTC. The sole arbitrator shall be appointed within 60 days from the day when
a written and valid demand for arbitration is received by CMD.
2. In cases not covered by the Clause above, the Arbitral Tribunal shall consist of a Panel of three
arbitrators. For this purpose, IRCTC will send a panel of more than 3 names of Officers which may also
include the name(s) of retired Railway Officer(s) empanelled to work as Arbitrator to the
contractor/licensee/service provider within 60 days from the day when a written and valid demand for
arbitration is received by the CMD/IRCTC.
3. Contractor/licensee/service provider will be asked to suggest to CMD at least 2 names out of the panel
for appointment as contractor’s nominee within 30 days from the date of dispatch of the request by
IRCTC. CMD/IRCTC shall appoint at least one out of them as the contractor’s nominee and will, also
simultaneously appoint the balance number of arbitrators either from the panel or from outside the panel,
duly indicating the ‘presiding arbitrator’ from amongst the 3 arbitrators so appointed. CMD/IRCTC shall
complete this exercise of appointing the Arbitral Tribunal within 30 days from the receipt of the names
of contractor’s nominees.
4. If one or more of the arbitrators appointed as above refuses to act as arbitrator, withdraws from his office
as arbitrator, or vacates his/their office/offices or is/are unable or unwilling to perform his functions as
arbitrator for any reason whatsoever or dies or in the opinion of the CMD/IRCTC fails to act without
undue delay, the CMD/IRCTC shall appoint new arbitrator/arbitrators to act in his/their place in the
same manner in which the earlier arbitrator/arbitrators had been appointed. Such re-constituted Tribunal
may, at its discretion, proceed with the reference from the stage at which it was left by the previous
arbitrator (s).
5. The Arbitral Tribunal shall have power to call for such evidence by way of affidavits or otherwise as the
Arbitral Tribunal shall think proper, and it shall be the duty of the parties hereto to do or cause to be
done all such things as may be necessary to enable the Arbitral Tribunal to make the award without any
delay. The Arbitral Tribunal should record day to-day proceedings. The proceedings shall normally be
conducted on the basis of documents and written statements.

7. The arbitral award shall state item wise, the sum and reasons upon which it is based. The analysis and
reasons shall be detailed enough so that the award could be inferred therefrom.
8. A party may apply for corrections of any computational errors, any typographical or clerical errors or
any other error of similar nature occurring in the award of a Tribunal and interpretation of a specific
point of award to Tribunal within 60 days of receipt of the award.
9. A party may apply to Tribunal within 60 days of receipt of award to make an additional award as to
claims presented in the arbitral proceedings but omitted from the arbitral award.
10. In case of the Tribunal, comprising of three Members, any ruling on award shall be made by a majority
of Members of Tribunal. In the absence of such a majority, the views of the Presiding Arbitrator shall
prevail.
11. The cost of arbitration shall be borne by the respective parties. The cost shall inter-alia include fee of the
arbitrator(s), as per the rates fixed by IRCTC from time to time and the fee shall be borne equally by
both the parties. Further, the fee payable to the arbitrator(s) would be governed by the instructions issued
on the subject by IRCTC from time to time irrespective of the fact whether the arbitrator(s) is/are
appointed by IRCTC Administration or by the court of law unless specifically directed by Hon’ble court
otherwise on the matter.
12. Subject to the provisions of the aforesaid Arbitration and Conciliation Act 1996 and the rules thereunder
and any statutory modifications thereof shall apply to the arbitration proceedings under this Clause.
All disputes arising out of or in regard to the tender, the courts at New Delhi/Delhi shall alone have the
jurisdiction to resolve.
47. FORCE MAJEURE
In the event of any unforeseen event directly interfering with operation of Service Provider arising during the
currency of the agreement such as war, insurrection, restraint imposed by Govt., act of legislature or other
authority, explosion, accidents, strike, riot, lockout, act of public enemy, acts of God, sabotage, flood,
earthquake etc, the Service Provider shall immediately from the commencement thereof notify the same in
writing to IRCTC with reasonable evidence. No compensation shall be claimed from the affected party in
such a situation.
If such force majeure conditions are in force then any cancellation of AC Deluxe Train
itineraries/journeys/part journey, no payments are liable to be paid to the service provider by IRCTC.
If the force majeure conditions as mentioned be in force for period of 15 days or more, IRCTC will have the
option to terminate the agreement on expiry of 15 days of commencement of such force majeure by giving 3
days notice to the Service Provider in writing. In case of such termination, no damage shall be claimed by
either party against the other except those which had accrued under any other clause of this agreement prior
to such termination.
48. WRONG INFORMATION:
If the tenderers/s deliberately give/s wrong information in his/their tender, create/s circumstances for the
acceptance of information in his/their tender, the IRCTC reserves the right to reject such tender at any stage
and in that eventuality Security Deposit lying with IRCTC shall stand forfeited and the bidder shall be
debarred from taking part in future projects for a period of two years.
Any information regarding the examination and evaluation of bid, clarifications sought thereof and
recommendation of the short listed bidder shall not in any case be disclosed to any person or employee not
officially concerned with the process of bidding.

28. Furniture and Furnishing - IRCTC shall at its costs provide Furniture and Furnishings.
29. Initial inventory of Items
IRCTC shall at its costs provide the initial inventory of equipments and other items to be detailed in an
inventory list signed off by both parties. Service Provider shall be responsible to properly manage such
stock, place it or make it available to tourists at designated places and maintain proper registers to give an
account of the stock to IRCTC, as per instruction of IRCTC. The on board Service provider is accountable for
all linen, crockery / cutlery/flatware/glassware, misc. items and kitchen items (except procured by service
provider if any) for the train.
The handed over items shall be the responsibility of the successful bidder and will do the necessary top-up /
replenishments for all breakages or losses in the stock / inventory of the same type, brand & quality and are to
be returned in same quantity at the end of tenure / pre-mature termination, whichever is earlier of contract.
30. Graphics and Consumables
Service provider shall procure the following items after approval from IRCTC - Complete Uniforms
{separately area wise, i.e. Kitchen, Dining Car, Public Area (House Keeping) & Security}, shoes,
badges, facial tissues for public areas etc.
Service Provider shall man facilities on board, as per requirements of itinerary, including magazines and
newspaper etc.
IRCTC may provide audio CDs, video DVDs etc which shall be displayed by Service Provider.
For convenience and coordination, the Service Provider shall design separate ‘control office’ based at
Delhi with store and in any other city as deemed fit for the prevalent itinerary if required, meant
specifically for discharge of the Hospitality Services and shall operate from this control office/stores.
31. Preparing train for Operation from Delhi: The Service Provider should be in preparedness to
commence services at short notice during all these periods. The train would generally be in full
operation during the specified season as per the scheduled itineraries or customized itineraries / charter.
The service provider shall have the train rake 02 days prior to the departure dates of the train for setting
up the materials and fixtures etc. and period of 01 day post termination dates of itineraries for cleaning
/sanitizing and wind up the whole train for next departure if train operates after 15 days from the
termination of last tour. In case train operates less then 15 days from previous trip then train rake will be
given for 02 days (1 day pre & 1 day post). Payment for these days day shall be made as per the rate
approved for Fixed Cost per day (Empty coaching rake)-(F).
32. Fixed Cost per day In case Train operate/moves as Empty coaching rake (ECR):-
The approved rates shall be payable for the days, when the train moves as Empty Coach Rake (ECR)
from Base (Delhi) to any required station from where next itinerary is to be operated.
The approved rates shall be payable for the days when train halt without any major meal service
(Breakfast/ lunch/ dinner) during tour.
33. The Rates at (E) for On-Board security Personnel should be quoted for 06 staff per month. These shall
be engaged for the duration of the contract and IRCTC shall pay to the service Provider the quoted
amount per month (Taxes extra as applicable) irrespective of operation/ non-operation of the train.
However the requirement of security personnel may be reviewed as per peak season and lean season and
charges for security personnel shall be paid on pro-rata basis
34. Rates: The Rates quoted by the bidders will be for initial two years of the contract from date of
commencement of services, However the rates shall be enhanced by 5% of the base price (quoted
in the Performa for Financial Bid) for the third year of the contract. If the contract is considered for
further extension, the rates shall be enhanced every year by 5% over the base price (quoted in the
Performa for Financial Bid).
35. Payments: IRCTC shall release payments on submission of bills within 15 working days from the
receipt of bill and on bills GST should be separately mentioned.

A. Suitable kitchen staff to wash, clean, store, maintain and be responsible and accountable for all cooking
ware, table ware, service ware and any other items such as cutlery, crockery, and glass / crystal wares.
Cleaning of cooking equipment and kitchen cutlery. Keeping the kitchen car clean, hygienic, disinfected
and free of all sorts of pests.
B. Maintain the pantries and service kitchen on board the train in a hygienic manner including the regular
cleaning of utensils and proper storing of all materials and stock.
C. Thoroughly clean the kitchen / pantries premises in the early hours before active work begins and wet
mop the kitchen at least 3 times a day.
D. Keep the shelves, cupboards, other storage racks and refrigerators scrupulously clean and tidy at all
times and ensure thorough cleaning at least once a week.
E. Clean the sink, stoves, used utensils and crockery with a good quality cleaning solution at least once a
day.
F. Ensure no dirty utensils, crockery or any other items lie on the kitchen sink for more than two hours
without being cleaned.
G. Use disinfectants in the kitchen sink and cleaning areas at the end of each day.

Pattern for Calculation of financial bid (Per Trip rate) to arrive at L1:
IRCTC shall calculate the amount payable for one trip on existing Buddhist Circuit Itinerary as under based
on the rates quoted by the bidders in the Financial Bid:-

Bidders are required to quote rates for services in column (I) only. Whereas the Columns (III) and
(IV) are fixed and columns (II) & (V) are auto filled.
The figure 94 guests (60% of train capacity) is a hypothetical figure only for the purpose of deriving
a formula to arrive at the L1 bidder.
Finacial bids of only those Firms who are eligible in technical bids and upon satisfactory result of
physical verification of bidders credentials (office premises/ original documents/financials/ vehical
contract etc.) shall be opened online at a subsequent date. The date shall be notified in writing.
The above quoted rates should inclusive all the statutory levies i.e. minimum wages, PF, ESI, leave
reserve etc but exclusive of Applicable Taxes i.e. GST which would be charged as per applicable
rates.
Evaluation of financial offer shall be done as per the system of evaluation as mentioned above.
The Rates quoted by the bidders in the Performa for Financial Bid should be in absolute terms,
without any overwriting and cutting.
Payment to Service Provider for the first & second year shall be made as per the rates quoted above
as described in the tender document.
In case of any discrepancy in the amount quoted by the bidder in figure and words, the amount which
results in lowest/unit payable by IRCTC will be taken in to consideration.
All bid documents like Check list, Technical bid and commercial bid will be submitted concurrently
in the website [Link]
FAM Tours: All FAM Tours including special FAM trips on special itineraries shall be paid at 75%
of the quoted rates. IRCTC shall intimate the number of FAM guests per trip to the service provider
along with the Guest list.
Child Rate: Children upto 5 years of age shall be termed complimentary and Service Provider shall
not charge for them. Children above 5 years of age upto 12 years shall be paid at 50% of the
approved rates.
The requirement of security personnel may be reviewed as per peak season and lean season and
charges for security personnel shall be paid on pro-rata basis.

Ï/We hereby understand and accept that if I/we withdraw or modify my /our bids during the period of
validity, or if I/we are awarded the contract and on being called upon to submit the performance
security/Security Deposit, fail to submit the performance security/Security Deposit before the deadline
defined in the request for bid document/Notice Inviting tender, I/we shall be ready to face action as per terms
and conditions of the tender document.

(1) The Bidder declares that no previous transgressions occurred in the last three years with any
other company in any country conforming to the anti corruption approach or with any public
sector enterprises in India that could justify his exclusion from the tender process.
(2) If the bidder makes incorrect statement on this subject, he can be disqualified from the tender
process or action can be taken as per the procedure mentioned in “ Guidelines on Banning of
Business dealings”.
(1) In case of sub-coordinating, the IRCTC contractor shall take the responsibility of the adoption of
Integrity Pact by the sub-contractor.
(2) The IRCTC will enter in to agreements with identical conditions as this one with all Bidders and
Contractors.
(3) The IRCTC will disqualify from the tender process all bidders who do not sign this pact or violate its
provisions.

(2) The IRCTC has appointed Independent Monitors (hereinafter referred to as Monitors) for this Pact in
consultation with the Central Vigilance Commission.

(3) The Monitor is not subject to instructions by the representatives of the parties and performs his/her
functions neutrally and independently. The Monitor would have access to all contract documents,
whenever required. It will be obligatory for him/ her to treat the information and documents of the
Bidders/Contractors as confidential. He/ She reports to the CMD IRCTC.
(4) The Bidder(s)/Contractor(s) accepts that the Monitor has the right to access without restriction to all
project documentation of the IRCTC including that provided by the Contractor. The Contractor will also
grant the Monitor upon his/her request and demonstration of a valid interest, unrestricted the
unconditional access to their project documentation. The same is applicable to sub-contractors.
(5) The Monitor is under contractual obligation to treat the information and documents of the bidder(s)/
contractor(s)/ Sub contractor(s) with confidentially. The Monitor has also signed declaration on ‘Non-
Disclosure of confidential Information’ and of ‘ Absence of conflict of interest’. In case of any conflict
of interest arising at a later date, the IEM shall inform CMD, IRCTC and rescue himself/herself from
that case.
(6) The IRCTC will provide to the Monitor sufficient information about all meetings among the parties
related to the project provided such meetings could have an impact on the contractual relations between
the IRCTC and the contractor. The parties offer to the Monitor the option to participate in such meetings.
(7) As soon As the monitor notices, or believes to notice, a violation of this agreement, he/she will so inform
the management of the IRCTC and request the management to discontinue or take corrective action, or
to take other relevant action. The monitor can in this regard submit non-binding recommendations.
Beyond this, the monitor has no right to demand from the parties that they act in a specific manner,
refrain from action or tolerate action.
(8) The Monitor will submit a written report to the CMD, IRCTC within 8 to 10 weeks from the date of
reference or intimation to him by the IRCTC and should the occasion arise, submit proposals for
correcting problematic situations.
(9) If the monitor has reported to the CMD IRCTC, a substantiated suspicion of an offence under relevant
IPC/PC ACT, and the CMD IRCTC has not, within the reasonable time taken visible action to proceed
against such offence or reported it to the Chief Vigilance Officer, the monitor may also transmit this
information directly to the Central Vigilance Commissioner.
(10) The Word ‘Monitor’ would include both singular and plural.

If any claim made/ lodged during this time, the same shall be binding and continue to be valid despite the
lapse of this pact as specified above, unless it is discharged/determined by the CMD of IRCTC.
(1) This agreement is subject to Indian Law. Place of performance and Jurisdiction is the Registered
Office of the IRCTC, i.e. New Delhi.
(2) Changes and supplements as well as termination notices need to be made in writing. Side
agreements have not been made.
(3) If the contractor is a partnership or a consortium, this agreement must be signed by all partners
or consortium members.
(4) Should one or several provisions of this agreement turn out be invalid, the remainder of this
agreement remains valid. In this case, the parties will strive to come to an agreement to their
original intentions.
(5) Issues like Warranty/Guarantee etc. shall be outside the purview of IEMs.
(6) In the event of any contradiction between the Integrity Pact and its Annexure, the clause in the
Integrity Pact will prevail.

Additionally, service providers must handle conduct-related issues among staff, taking immediate and appropriate measures to replace staff who misbehave .
