A. BACKGROUND
1) The Indonesian government has set a target of 100% access to safe drinking
water by 2030 (in line with UN SDG 6: Clean water and sanitation). Data in 2017
shows that the coverage of national clean drinking water supply is around
72.04%, consisting of urban coverage of 80.82% and rural coverage of 62.58%.
Meanwhile, challenges in developing a clean water supply system include an idle
capacity of 37,900 liters/second1, 33% non-national income water, raw water
needs for drinking water supply of around 128 m3/second. Low commitment to
funding water supply by Local Governments (Pemda) by only allocating 0.04% of
their Regional Budget (APBD), the 'healthy' amount (measured through several
indicators set by Improvement of the Implementation of Water Supply System
Agency (BPPSPAM) and documented in the annual Performance report) 2
Municipal Waterworks (PDAMs) is 30%, and only a 4.5% increase in access to
safe drinking water in the last 5 (five) years.
2) A platform to achieve 100% access to clean water for both urban and rural areas
require 60% piped water with more than 27 million house connections, 40% safe
and protected non-piped drinking water supply for 2 million households, and
100% healthy PDAMs '. In this context, the rationale for preparing Raw Water
(RWS) readiness is based on: (i) inadequate upstream and downstream water
allocation planning; (ii) utilizing new dams to achieve sustainable and optimal use
and development of raw water sources; and (iii) geographical availability of raw
water availability which is geographically uneven. It further aims for the outcomes
of (a) continued readiness in water supply investments; (b) increasing resilience
to climate change; (c) integration in overall upstream (supply-based) and
downstream (demand-based) water supply investments with a sourcing
framework at the basin scale. Raw water supply infrastructure works are
proposed to be financed by ADB under the Enhanced Water Security Investment
Project (EWSIP) 3.
3) Regarding the above conditions, in the 3 (three) RWS areas of the RWS 2
Package1 Project, the service conditions still need to be improved, and the
condition of supplying raw water as a supplier of clean water to PDAMs in their
respective regions certainly requires improvement as well.
4) The service area conditions of this project are divided in 3 (three) sub projects,
which are:
a. Lau Simeme Reservoir in North Sumatera Province
This system will supply raw water to Medan City and Deli Serdang Regency.
b. Jatigede Stage II in West Java Province
This system will supply raw water to areas that inclue Cirebon City, Cirebon,
Majalengka, Indramayu, and Sumedang Regency.
c. Kertasari System in West Java Province
This system will supply raw water to Bandung City and Bandung Regency.
5) The condition of piped clean water services in the three regions is shown in Table
1, with the number of people serve is still low, except for the areas of Medan City
and Cirebon City.

6) To support optimal service improvement in the three areas of the raw water
supply system, it is necessary to develop infrastructure such as intake buildings,
water treatment plant (WTP), offtake and transmission pipes from WTP to offtake.
Also, the additional capacity that RWS wants to achieve in the three locations is
as follows. Moreover, there are target for the additional capacity of Raw Water
Supply at the three locations are as follows:

7) RWS infrastructure development will require land, permanent and temporary. As

expected by Law No. 2 of 2012 and Government Regulation No. 19 of 2021, the
affected land must be identified for their ownership and status. In addition, the
situation above and below the ground also needs to be known about any assets,
such as buildings, plants, and trees. If the infrastructure development plan has
an impact on people's houses, the identification and consultation process with
the affected people needs to be carried out as early and as well as possible.
8) In the planning stage of land acquisition, it is necessary to draft a Land Acquisition
and Planning Document (DPPT) in the context of Government of Indonesia
regulations and the Land Acquisition and Resettlement Plan (LARP) in
accordance with ADB's 2009 Safeguard Policy Statement (SPS). The
preparation needs of these two types of documents is necessary depends on the
results of the screening of involuntary resettlement and indigenous people.

B. PURPOSE AND OBJECTIVE OF LARP ACTIVITIES

9) The preparation of LARP is the initial stage or the planning 4 stage of land
acquisition in accordance with the Law and Government Regulation on land
acquisition for development for the public interest. The purpose of this work is to
obtain data on ownership of Land, Buildings and Plants, and information needed
in detail for the Implementation of Land Acquisition and Resettlement in the raw
water supply system planning area in Lau Simeme Reservoir (North Sumatera
Province) and Kertasari (West Java Province).

10) The purposes of this work are:

a. Obtain land acquisition planning documents as one of the requirements for
the implementation of the raw water supply infrastructure development
process in Lau Simeme and Kertasari;
b. Minimize the negative impact of raw water supply infrastructure
development activities in Lau Simeme and Kertasari;
c. Facilitate meetings for affected residents and all parties/stakeholders
related to the development of raw water supply infrastructure in Lau
Simeme and Kertasari so that they have the same perception of land
acquisition and resettlement actions. This activity includes providing
information to residents through brochures and other materials that can be
read by affected residents;
d. Deliver all findings and information at each location to parties who need
land, especially for lands other than those belonging to residents;

 e. Make documents compatible with international standards by including
grievance mechanisms, institutional arrangements, restoration of income
recovery, monitoring and evaluation, and other important matters as stated
in ADB's 2009 SPS.

11) Also, the objective of this work is to develop policies in decision making related
to land acquisition plans, both pre and post-construction implementation with the
process of obtaining land, building and plant ownership data and the required
information in detail which will be used as a referenced for the Government to
develop policies for the management of residents and community land in the area
of the raw water supply system planning in Lau Simeme (North Sumatera
Province) and Kertasari (West Java Province).

12) While the objectives of this activity are:

a. Identifying and inventorying data of land ownership and growing crops
affected by the project at the planned locations of the Kertasari System in
West Java and Lau Simeme Dam in North Sumatera
b. Identifying and inventorying data of population displacement at the
locations of the Kertasari System in West Java and Lau Simeme Dam in
North Sumatera
c. Obtain an overview of the assets and socio-economic conditions of the
community that will be affected by the development of the Kertasari
System in West Java and Lau Simeme Dam in North Sumatera
d. Obtain a map of the land ownership of each resident affected by the
development of the Kertasari System in West Java and Lau Simeme Dam
in North Sumatera
e. Obtain information from the affected community about forms of
compensation in order to determine the estimated value of the cost of land
acquisition and building and plant replacement
f. Provide an overview of the stages of land acquisition in a structured
manner according to the prevailing law.
g. Delivering the feasibility of the project based on the results of the previous
feasibility study and knowing the suitability of the project location with the
current Regional Spatial Plan.
h. Obtaining additional regulatory forms or mechanisms, such as complaint
mechanisms, institutional arrangements, resettlement, income recovery
restoration, monitoring and evaluation, and other necessary
arrangements.

C. OUTPUT
13) The output of this activity is the availability of the LARP Reports document (in
English) and the Land Acquisition Planning Document reports for each sub
project.

E. LARP AND SCOPE OF ACTIVITIES

15) The scope of LARP activities consists of few activities, namely the Preparation,
Survey and Public Consultation Meeting (PCM) Stages, then Data Processing
and Analyzing, Report Preparation Stages. The stages of the activities as figure
in below.

Preparation Stage
16) Preparatory work is the initial stage of work including:
a. Office and Field Admnistration Preparation Work
i. Administrative and Technical Preparation
The consultant will carry out administrative and technical preparatory
work which includes:
- Mobilization of resources, such as personel, equipment, and
preparing for field operational needs.
- Preparation of office work involving data processing, secondary
data analysis, and administration.

 b. Preparation for Preliminary Report
This report contains a framework to be carried out regarding preparation,
licensing arrangements, mobilization of teams of experts and support and
equipment, work plans and organization of personnel or experts and plans
for secondary and primary data collection and data sources.

Preliminary Survey an Secondary Data Inventory

a. Pleminary/Initial Survey
This activity is the initial stage of work implementation and for
orientation/introduction of the study location, at this stage the consultant will
coordinate with related parties by discussing closely related to regulations
and policies that apply in the region in relation to the LARP. Some of the
applicable regulations and policies include national and regional laws and
regulations concerning the maintenance of the surrounding environment
and social considerations which include:
 Management of population shelters and monitoring.
 Rights of minorities and indigenous peoples.
 Procedures for obtaining information and involving local residents.
 Land acquisition process and procedures (National and regional level
decrees).
The regulations and policies mentioned above, especially those related to
LARP, are needed by collecting data and maps of the locations to be
released, including new areas and/or locations for replacement.

b. Data and Map Inventory

This activity will carry out an inventory of data, types, data sources and the
period for collection, carried out according to the needs of the analysis to be
carried out in the affected study area, including the following:

c. Field Inventory and Secondary Data

This activity will carry out:
i. Field Inventory
Detailed field reviews are part of the planning stage. For the problem
identification stage, the consultant is expected to be able to take an
inventory of every problem that exists in the area concerned, both the
current problems and the potential that can be developed in the future
in the relocated area. Some of the important aspects that exist and
must be identified include:
 Inventory and evaluation analysis of the results of data collection
and community input in the study location.
 Inventory of existing Infrastructure around the planned area of
Raw Water Supply Intake and Transmission Project.
 Inventory of demographic data (population structure based on
gender, age group, education, religion, population density, and
number of family heads) especially for residents living in shelter
areas and landowners.
 Inventory of economic activities (Agriculture, forestry, fisheries).
 Inventory of processing and planting land and landowners in the
planned area of Raw Water Supply Intake and Transmission
Project.
 Inventory of procurement and plans to fulfill land needs needed
for the implementation of Raw Water Supply Intake and
Transmission Project development and relocation based on the
General Spatial Planning (RUTR) that has been determined.

 Preparation and use of maps include:

- Using the high-resolution satellite image maps at selected
locations.
- Preparation of a base map of 1:50,000 scale (region
orientation) and 1:5000 (selected region).
- Map / aerial photo scale 1: 10,000 (if available)
- Land use and ownership maps and other maps needed to
support the implementation of field measurements
- Interpretation, evaluation, and analysis of satellite imagery in
the entire area of the Raw Water Supply Intake and
Transmission plan.

 - Analysis and evaluation of selected locations for the
preparation of technical materials for zoning regulations using
arc Editor and Ermapper.

 Conduct discussions with the Technical Team before

discussing the Preliminary Report, Intermediate Report and
Final Report.

Detailed Survey an Public Consultation Meeting

a. Socialization and Public Consultation Meeting (PCM)
The purpose of these activities are to obtain input, responses, and
corrections from the community, and all stakeholders on the overall data in
the inventory, identification of environmental conditions and identification of
problems that have been carried out in order to build an agreement from all
interested parties in the effort to release land and relocation of Raw Water
Supply Intake and Transmission Project. Also, these will carried out with the
intention of social preparation in order to the stakeholders and the
community support LARP activities.
The consultant facilitate the socialization and consultation activities from
various relevant Cross-Sector Agencies through BAPPEDA, elements of the
District, Non-Governmental Organizations (NGOs), Village Apparatus and
the community in obtaining input, community responses, all
stakeholders/policies. These activities are carried out at 2 (two) levels,
namely:
i. Socialization
Socialization will be held from local government officials to institutional
stakeholders who are expected to be involved in supporting the
implementation of LARP activities, including provincial government
agencies, local BWWS and Regency/City, sub-district heads and village
heads.
ii. Public Consultation Meeting
This activity enganged with communities who has potential to be
affected by land acquisition from this project. This includes local
community leaders to provide support for LARP activities.

These activities, not only at the 2 levels mentioned, but can be carried out
in an informal form in limited meetings with the target group to support and
complement the public consultations conducted at the 2 (two) levels above.
To accommodate the aspirations of the interested parties, the consultant
must carry out the Socialization and Public Consultation activities on the
LARP at the Regional/Regency level, especially involving stakeholders, as
well as the community in the planned area of the Raw Water Supply Intake
and Transmission Project.

b. Mapping of Land Acquisition Plans
This activity needs some primary data that will be collected by the following
surveys:
i. Asset Survey / Inventory of losses (IoL)
Conducting census data collection on affected residents, especially
data collection on land, buildings and plant data belonging to residents,
government, business entities, village treasury, and others as personal.
The survey was conducted using a questionnaire from the Q-LARP
application
ii. Socio-Economic Survey
Collecting socio-economic data for affected residents, to obtain a profile
of the socio-economic conditions of the families of project-affected
residents, as data in handling social impacts caused by project work.
The survey was conducted using a questionnaire from the Q-LARP
application.
iii. Focus Group Discussion (FGD)
Conduct discussions with various special groups and stakeholders, to
obtain data or information that is impossible to obtain through the Q-
LARP application questionnaire. Meetings will be held with vulnerable
groups and severely affected households, including:
• Female Family Heads Group;
• Group of Family Heads with special needs;
• Group of heads of families with special needs who live below the
poverty line;
• Elderly or elderly family heads;
• Stakeholders related to project activities.

These surveys to obtain the necessary data and information as follows:

i. Carrying out KADASTRAL measurements of land acquisition in the
area of the Raw Water Supply Intake and Transmission Project plan
and relocation (resettlement action plan). Some of the things that need
to be done for this activity include:
 Preparation of a team led by experts in their field.
 Conducting orientation and field surveys.
 Inventory, problem identification, analysis, and evaluation.
ii. The Implementing Personnel (Consultants) will conduct land ownership
mapping as well as acquisition and relocation with a scale of 1: 50,000
and/or with other instructions with the approval of the Board of
Directors.
iii. The results of the field survey, the consultant team in this case the
experts involved will conduct an analysis/study of the efforts and plans

 for the acquisition and relocation of the community and land in the
planned area of the Raw Water Supply Intake and Transmission
Project. In conducting this study, these experts require the following
basic considerations:
 Existing conditions and problems in the area of the Raw Water
Supply Intake and Transmission Project plan area.
 Analysis and evaluation of the results of data collection and
community input in the study location including the issue of
compensation in the context of land acquisition for:
- Land rights.
- Buildings.
- Plants.
- Other objects related to land.
 The existing infrastructure around the planned area of Raw Water
Supply Intake and Transmission Project.
 Demographics (population composition by sex, age group,
education, religion, population density, and number of household
head) especially for residents living in shelter areas and landowners.
 Economic activities (Agriculture, forestry, fisheries) in the planned
area of Raw Water Supply Intake and Transmission Project.
 Processing and planting of land and landowners in the area of the
Raw Water Supply Intake and Transmission Project plan.
 Procurement and plans to fulfill land needs needed for the
implementation of Raw Water Supply Intake and Transmission
Project development and relocation based on the existing General
Spatial Plan (RUTR), and for regions that have not yet established
RUTR land acquisition is carried out based on existing regional or
city spatial planning.

Furthermore, the results of the processing/analysis of the census/survey

data display the required information, i.e.:

In addition, the topographic data are required for LARP work interest, will
use data and result topography survey. The topography survey will be
conducted by Sub Consultant of RWS2 Project as Topography Survey
Team. Cooperation and support from the Topography Survey Team to the
LARP Survey Team are as follows:
i. The Topography Survey Team conducted a measurement and survey
of land/area that be acquired for construction of intake/wear
infrastructure, transmission pipes and WTP. Furthermore, these data
will be poured into a Topographic Map.
ii. The LARP survey team, in this case the Public Appraisal of Land/Asset
Specialist, the Assistant of Appraisal of Land and Assistant of
Appraisal of Building/Agriculture Asset collect the data and land
ownership map (land parcel) data
iii. The data and maps of land ownership parcels which collected by the

in each parcel of land ownership.

 Data Processing and Analyzing
17) There are 10 (ten) step in data processing and analyzing stage including:
a. Performing Inventory Analysis and Identification of LARP
The LARP study is mainly for communities directly affected by the project
which is prepared as a LARP report. Analysis and data collection will be
carried out in the environment around the Study Area that has been
determined, with the size according to the regulations in force in Indonesia.
The analysis carried out by the consultant team includes the following:
i. Land procurement for the implementation of development in the public
interest, including basic regulations on land principles.
ii. Principal policies for land acquisition.
iii. Committee, Deliberation, and compensation.
The results of the analysis will be used as the basis for the preparation of the
LARP report.

b. Relocation Plan Preparation Program Preparation (if needed)

The results of the inventory and identification that have been carried out, the
Consultant Team conducts analysis and prepares a location plan preparation
program for business assistance and shelter for communities directly affected
by the Raw Water Supply Intake and Transmission development project.

c. Compile Procedures for Land Acquisition

The Consultant Team conducts analysis and prepares recommendations or
procedures for land acquisition and signs the compensation and repair
agreement. Recommendations for procedures and mechanisms for land
acquisition/procurement are very much needed by policy makers to obtain
land by providing compensation to those who are entitled to the land in an
effort to plan for the development of the Raw Water Supply Intake and
Transmission Project.

d. Compile Procedures for Compensation and Alternative Business

Opportunities
Compensation is the replacement of the value of the land and buildings (if
any), plants and/or other objects related to the land because of the
relinquishment or surrender of land rights. The Consultant Team is required
to analyze and develop compensation procedures including alternative
business opportunities and training recommendations for communities directly
affected by the raw water infrastructure development project. The preparation
of this compensation procedure is very necessary to obtain land by providing
compensation to those entitled to the land where the release or surrender of
land rights is an activity to release the legal relationship between the holder of
land rights and the land, they control by providing compensation expected for
the land rights the basis of deliberation.

 For the basis and procedure for calculating land compensation, it is
determined based on:
i. Land price based on the real or actual value, considering the latest
selling value of the Land and Building Tax object for the land in question.
ii. The selling value of the building which is estimated by the local
government agency responsible for the building sector.
iii. The selling value of the plant is estimated by the local government
agency responsible for agriculture.

e. Compilation and Data Collection of Problems Based on Society Urgency

The Consultant Team conducts an analysis of the results of data collection on
problems encountered at the activity location, as well as drafts a concept of
the level of problems faced based on the urgency of the community directly
affected by the development project.

f. Creating a LARP Problem Solving Scenario

The Consultant Team will create scenarios for solving problems that will arise
as a result of the relocation plan at the level of urgency of the real affected
communities. The preparation of this scenario is needed by policy makers in
the context of efforts to relocate residents from their place of origin to other
places, and this scenario is also required by the land compensation committee
in the context of implementing compensation / land acquisition for
development purposes, so that they are right on target in carrying out their
duties.

g. Compile and Prepare Land Ownership Data

The Consultant Team based on the data collection/inventory of land
ownership must describe each plot (block) of land ownership and prepare a
complete inventory of ownership data. This data is very much needed by the
land acquisition team when the compensation process for land rights,
buildings, plants, and objects related to land will be carried out.

h. Prepare recommendations for solving problems using the priority scale

method.
The Consultant Team, based on the preparation of the scenarios that have
been carried out, are then required to prepare recommendations on how to
resolve the problem of compensation and relocation (LARP) by making a
priority scale method.

i. Compile a budget plan for land acquisition and acquisition and

relocation of residents.
The consultant is required to prepare an estimate of the costs required for the
implementation of land acquisition and relocation of residents according to the
level of urgency. The estimated cost of land acquisition and acquisition is

 based on the results of the inventory or data collection that has been carried
out by the team. Some of the main things that must be considered in the
preparation of these cost estimates including.
 Conduct research and inventory of land, buildings, plants, and other
objects related to land whose rights will be relinquished or handed over.
 Conduct research on the legal status of the land on which it will be
released or handed over.
 Estimate and propose the amount of compensation with the current cost
value or on other indications due to price fluctuations.
 Provide explanations and counseling to land rights holders regarding the
plans and objectives of the land acquisition.
 In the case of the implementation of the acquisition (compensation) and
relocation (land acquisition) it is necessary to form a deliberative
committee for compensation.

j. Compile The LARP Study Results Report

The consultant prepares a report on the results of the LARP study along with
a report listing the identification/data collection of the affected communities
against the development plan related to asset compensation as well as
pictures of the location of the acquisition and relocation.
The results to be achieved in this LARP Study works are:
i. Recommendation of the boundaries (base line) of land acquisition and
relocation locations from the results of the inventory, identification and
analysis and field evaluation.
ii. The proposed problem solving methods of compensation based on the
results of the analysis with several priority scale methods.
iii. The proposed cost of the implementation plan (RAB) for land acquisition
and acquisition as well as population relocation.
iv. Proposed land acquisition for relocating residents (if any) that is
appropriate for the settlement development plan in accordance with the
existing General Spatial Planning (RUTR).

to the Client.

L. GUIDELINE FOR DATA COLLECTION

25) Field data collection must be in accordance with applicable regulations and
directions from the Main Supervisor and Field Supervisor.

26) Primary data collection using the QLARP android application. The surveyor
team will be trained first how to use QLARP. The surveyor team uses an
Android cellphone, no longer using paper questionnaires. QLARP makes it
easier to carry out surveys because it is a real time base, but if there is no
signal in the field, it can still be stored on your phone. Prior to the
implementation of the field survey, online QLARP training will be conducted

M. OCCUPATIONAL, HEALTH AND SAFETY

27) Occupational Safety and Health is:
a. In the implementation of consulting services, service providers are required
to implement a K3 (Occupational Safety and Health) Management system
by arranging a Contract Occupational Safety and Health Plan.
b. Good OSH planning, starting with hazard identification, risk assessment,
and determination of control. The OSH management system will not work
well. It must take into account the various OSH regulatory requirements that
apply to the organization as well as other requirements such as company
standards, codes or guidelines that are related or applicable to the
organization.
c. Outputs produced in consulting services must cover OSH aspects.
d. Related to the current Covid 19 pandemic. During the implementation of the
LARP survey, it is mandatory to follow established health protocols.

N. BUDGET AND SOURCE OF FUNDING

The total cost required for Social Safeguard, LARP and Responsive Gender
Analysis study is One Billion Four Hundred Forty-Five Million Three Hundred
Thousand Rupiah (IDR 1,445,300,000.-) exclude PPN 10%.

financed by Provisional Sum Budget from the contract of Raw Water Supply Intake
and Transmission from Lau Simeme Reservoir in North Sumatera Province,
Jatigede Stage II and Kertasari System in West Java Province, Loan ADB No.3455-
INO.
