To secure the return of their security deposit, lessees must provide the lessors with clearances from Meralco, the Water District, and any telephone/internet companies confirming that all bills have been fully paid. Failure to present these clearances may result in the forfeiture of the deposit .
In cases of rental default, the lessor has the right to immediately reclaim the leased premises and terminate the lease agreement. The lessees are considered in default despite the existence of a deposit if they fail to pay the rent as it becomes due, which allows the lessor to enforce the contract's penalties .
The lease agreement allows the lessor or their agents to enter and inspect the premises at reasonable hours and in a manner that does not inconvenience the lessees. This right ensures the property is maintained in accordance with the terms of the lease .
The lease agreement explicitly states that the premises must be used exclusively for residential purposes. Use of the property for any other purpose or business requires prior written consent from the lessors. If the premises are used for non-residential purposes without this consent, the lessors have the option to either terminate the lease or charge an additional rent of PHP 1,000 per person .
The lessees are responsible for all charges related to water, electricity, telephone/internet, and other utilities within the leased premises. They are also required to pay all government taxes associated with the lease contract .
If the lessees vacate the leased premises prior to the expiration of the contract, the initial deposit—equivalent to two months’ rent—is forfeited in favor of the lessors. This clause acts as a penalty for early termination by the lessees .
Lessees cannot make alterations or improvements without the written consent of the lessor. Any approved improvements become the property of the lessor upon lease expiration unless otherwise agreed. If the lessor opts for removal, this must be done at the lessees' expense to restore the premises to its original state .
The lease contract ensures that the lessees have the right to peaceful possession and enjoyment of the premises. This includes protection from unlawful entry by the lessor unless under stipulated reasonable conditions for maintenance and inspection .
The lessor can terminate the lease if the lessees use the premises for purposes other than residential without prior consent, or if any other terms are violated, such as subleasing without permission or creating disturbances. The contract provides the lessor with grounds to terminate for any breach .
The lessees are responsible for maintaining the leased premises in a clean, orderly, and sanitary condition, free from obnoxious odors, oil leaks, noises, and nuisances. They are also prohibited from storing inflammable materials and are required to repair any damages beyond normal wear and tear at their own expense .
