Subject:- Final seniority list of the officers of the Jammu and Kashmir
Administrative Service (KAS).

Government Order No.743–GAD of 2011

Dated:24.06.2011

Whereas, the final seniority list of the officers appointed to the

Jammu and Kashmir Administrative Service (KAS) upto 31.12.2003 was
notified vide Government Order No. 1206-GAD of 2008 dated 16.09.2008;
and

Whereas, a tentative seniority list of 239 officers (including two

adhoc inductees), appointed to the Time Scale of the Jammu and Kashmir
Administrative Service between 01.01.2004 to 01.12.2008, and, as it stood
on 01.01.2010, was notified vide Government Order No. 485-GAD of 2010
dated 21.04.2010 for inviting objections, the officers having been assigned
position in the tentative seniority with reference to the occurrence of
vacancies; and

Whereas, 110 representations were received against the said

seniority list in which substantial issues were raised, for the examination of
which, the Government appointed a three member Committee headed by
Shri Verghese Samuel, the then Chairman, J&K Special Tribunal (now
retired) vide Government Order No. 1076-GAD of 2010 dated 24.09.2010;
and

 Whereas, the Committee submitted its report alongwith
recommendations to the Government on 15.02.2011; and

Whereas, the Committee has, inter alia, made the following

observations/recommendations:-

i. Seniority can be reckoned only from the date of appointment

or date of placement to a post or service and it cannot be
reckoned retrospectively from the date of occurrence of
vacancy. The Supreme Court in landmark judgments of
State of J&K Vs Javed Iqbal Balwan and State of J&K Vs
Suraj Prakash Gupta, has further clarified the position by
holding that appointments take effect from the date, a person
physically joins the post and that a person cannot claim his
appointment from the date when he was not borne on the
service to which he has been appointed. Hence, the seniority
of an officer has to be determined with reference to the date
of appointment and not with respect to the date of
occurrence of a vacancy;

ii. The service rules and conditions of service of an

employee(s) can be amended or altered but not amended or
altered retrospectively to his/their disadvantage;

iii. The Jammu and Kashmir Administrative Service Rules,

2008 came into force on 01.12.2008 and, therefore, will
apply only to inductions to the KAS which were done on or
after 01.12.2008. All the officers who were inducted before
01.12.2008 will necessarily have to be governed by the
provisions of KAS Rules, 1979;

 iv The tentative seniority notified vide Government Order No.
485-GAD of 2010 dated 21.04.2010 has been drawn in
terms of the provisions of KAS Rules, 2008 which is
incorrect. The seniority of an officer appointed under the
KAS Rules, 1979 has to be determined in terms of the
provisions of Rule 16 of these rules and not under Rule 18
of the KAS Rules, 2008;

v. The Junior Scale KAS officers cannot be given appointment

in KAS from a date prior to the date when they had not
acquired eligibility for such appointment in terms of the
provisions of KAS rules as were in vogue at the relevant
point of time. Modification of the provisions of KAS rules
by inserting an explanation through a Government order to
facilitate the promotion of Junior Scale KAS officers of
2004 batch, cannot have an overriding effect on the basic
rule. The said explanation was totally uncalled for.

Whereas, the Government has considered the recommendations

of the Committee and further examined the issue in consultation with the
Department of Law, Justice and Parliamentary Affairs and found that the
date of placement can (and does) vary with the efficiency with which the
respective departments complete the formalities for induction and that the
different dates of induction during the course of a year have essentially
resulted from administrative reasons rather than on account of any rational
sequencing. Under these circumstances, the date of induction referred to in
Rule 16 of KAS Rules, 1979 and to which the aforesaid Committee has
referred, should be read as the year of induction in the specific context and
circumstances of induction of these officers into KAS subject to fulfillment
of their eligibility on such date(s); and

 Whereas, while the issue of determination of seniority was
under examination in the General Administration Department, some officers
approached the Hon’ble High Court through the medium of writ petition
SWP No. 1215/2011 read with CMP No. 1782/2011. The Hon’ble High
Court in its interim orders passed on 7.6.2011 has directed as under:-

“The contention of the petitioners is that in terms of Rule 15(4)

of the Jammu and Kashmir Administrative Service Rules, 2008,
the seniority of the members of the feeding cadre into KAS is to
be fixed from the date of their entering into service. The
petitioners state that their services are to be governed strictly in
consonance with the aforesaid rules but the respondents are not
fixing their seniority in terms of the aforesaid rule.

Notice in the CMP also as aforesaid.

In the meanwhile, it is provided that respondents shall consider

the case of the petitioners for fixation of their seniority in terms
of Rule 15(4) of the Jammu and Kashmir Administrative Service
Rules, 2008. This order is, however, subject to objections from
the other side.”

Whereas, the issues raised by the petitioners have already been

critically analyzed by the Committee referred to in para 5 above; and

Whereas, on further examination, in compliance to the aforesaid

directions of the Hon’ble High Court, it has been found that these petitioners
have been appointed to the Time Scale of KAS under the KAS Rules of
1979 and not under the Rules of 2008 and as such, they are entitled to
seniority in terms of KAS Rules of 1979 and not in terms of KAS Rules of
2008; and

 Whereas, the Government in deference to the directions of the
Hon’ble High Court considered the plea of these petitioners under the KAS
Rules of 2008 and found that the same is void of any merit or justification,
and is accordingly rejected; and

Whereas, after the issuance of the tentative seniority list under

Government Order No. 485-GAD of 2010 dated 21.4.2010, some more
officers have been appointed to the service with effect from 25.9.2008; and
after their induction into KAS, their seniority is required be notified in
pursuance to Rule 16 of the Jammu and Kashmir Administrative Service
Rules, 1979; and

Whereas, as per the recommendations of the Committee

constituted, and based on the opinion of the Department of Law, Justice and
Parliamentary Affairs, necessary changes, wherever required in the tentative
seniority list, have been made and the officers inducted after issuance of the
tentative seniority list with effect from 25.9.2008, have also been reflected in
the seniority list appropriately.

Now, therefore, a final seniority list of the officers appointed to

the Time Scale of the Jammu and Kashmir Administrative Service between
01.01.2004 to 01.12.2008, as it stood on 01.01.2010, forming “Annexure” to
this order is hereby notified for information of all the concerned officers.
The seniority list shall be without prejudice to the cases of officer/officers
pending in any court of law for one or the other reasons and also without
prejudice to any writ petition/petitions pending before any competent court.
Any officer who may feel aggrieved with his placement in the seniority list
may file a Review Petition before the Government through General
Administration Department within a period of 15 days from the date of the
issue of this order.

 The date of birth recorded in the seniority list shall not be taken
as authentic but shall be subject to verification from service-
book/matriculation certificate of the concerned officers.
