MOOT PROBLEM: 1 (one)

A Company with the name Orchid Pvt. Ltd operates in Men's ware. It earned huge profits
over the years and eventually decided to expand its business by introducing a number of
varieties in Ladies and kids wear. In order to achieve the above objective , they approached
the Rainbow Pvt. Ltd ., a large manufacturer of garments in Ladies and kids wear garments.
Orchid Pvt. Ltd entered into a contract for the purchase of kids and ladies wear garments .
The contract price was Rs12,00,000 / and both the parties agreed upon a payment schedule .
Orchid Pvt. Ltd agreed to pay Rs 8,00,000/ partially upon the delivery of kids and ladies wear
clothes on 1st March 2020 and a full and final payment of Rs 4,00,000 on 1st May 2020 .
Rainbow Pvt. Ltd delivered the garments to Orchid Pvt. Ltd on the agreed date i.e. 1st
March 2020 per the contract. However , shortly after taking the delivery of the clothes ,
Orchid Pvt. Ltd looses a profitable contract with its large booking agents which resulted in a
significant down in the demand for their Ladies and kids wear garments. Rainbow Pvt. Ltd ,
was also suffering from financial difficulties due to a number of legal actions brought against
it.
It was realised by Rainbow Pvt. Ltd that Orchid Pvt. Ltd would be unable to pay the
remaining amount of Rs.4,00,000 on 1st May 2020, Rainbow Pvt. Ltd agreed to accept Rs.
2,00,000 in full satisfaction of the debt Orchid Pvt. Ltd duly paid such amount on 1st May
2020. On 3rd May 2020 Rainbow Pvt. Ltd delivered the rest of the clothes to Orchid Pvt. Ltd.
On delivery it was found that the clothes were of poor quality . On 4th May a notice was sent
to the Rainbow Pvt. Ltd., to exchange the clothes the notice was acknowledged and accepted
by Rainbow Pvt. Ltd. However , no exchange took place . On 20th May second notice was
sent which was neither acknowledged nor replied.
Hence Orchid Pvt. Ltd filed a suit against Rainbow Pvt. Ltd and claims Rs. 2,00,000 for
breach of contract . Rainbow Pvt. Ltd contended that it was not bound to pay the amount
claimed in the suit because the clothes were of good qualities.

MOOT PROPOSITION: 2 (two)

Ramdev, a farmer, is living with his wife Radha, Son Shivraj and Daughter Sitha in a remote
village of Karnataka. Ramdev with his little source of income was managing his family needs
respectfully, while his wife Radha and his Son helped him in his day to day work. His son,
Shivraj could not go to school because of his father’s poor financial position.

However, his daughter, Sitha joined a reputed college, in the nearby town, with the financial
support from the local business men. Sihta's college is about 15 km away from her house. She
used to go by public transport.

Sunil a boy living in the same village, is working as a Supervisor in a private company in the
town, where Sitha's College is located. Incidentally, both Sunil and Sitha go to the town in
the same public transport. While going to town and coming back home, both got access and
rapport to speak to each other, and eventually, both have become good friends and started
liking each other.

On 20th June, 2019 Ramdev after coming to know the intimate relationship that has
developed between Sunil and his daughter, discussed the matter with his brother Tulsidas.
Upon his advice, Ramdev warned Sunil with severe consequences and severely admonished
him. Ramdev also scolded his daughter to refrain from meeting Sunil.

Before this, Shivraj on an occasion took Rs1,00, 000/- from Sunil for some personal reasons.
On October 15th, 2019,Shivraj called Sunil to his house to repay the loan amount of Rs.
1,00,000/- as full and final settlement. At about 7:30pm, on the same day, when Sunil came
to Shivraj's house, everybody finished their dinner and waiting for Sunil. Shivraj gave
Rs1,00, 000/- to Sunil and asked him to leave immediately.

While Sunil was about to leave the place, Sitha suddenly came running out of the house and
held his hand. She was crying loud, requesting him to take her with him away from her
father’s house. Before Sunil could gain his senses from such a sudden incident, Ramdev
rushed to his daughter and dragged her inside the house and bolted the doors from outside.

Tulsidas (brother of Ramdev), in a fit of anger, brought a lathi, which was lying in the house,
and started beating Sunil with lathi on his head and chest. Ramdev, shouted ‘kill him’.
Shivraj caught hold of Sunil to prevent his escape.
In the meantime, Sita managed to escape from an open window and rushed to protect Sunil.
Unfortunately, she also received three serious blows on her head and collapsed unconscious.
With the intervention of neighbours, both were taken to the hospital where Sunil
survived but Sita died after 15 days of her admission in the hospital.

The Post-Mortem Report confirmed that she suffered injuries on head and fracture of 3 ribs.
According to the Post-Mortem Report ‘none of these injuries independently was sufficient to
cause her death’, while ‘they cumulatively were sufficient to cause death in the ordinary
course of nature’.

The charges were framed against all the three accused under S. 302 r/w section 34 of Indian
Penal Code, 1860 in relation to the death of Sitha, And they were also charged under Sec. 307
r/w Sec. 34 Indian Penal Code, 1860 for attempt to commit murder of Sunil.

Seema and Surya (a Major in Indian Army), both resident of Bangalore. Both are Hindus

by religion, got married in 2012 according to Hindu religion. The couple got their marriage

registered as per the provisions of the Hindu Marriage Act, 1955 and in effect a marriage

certificate was issued by the authorities. Out of this wedlock two children were born in the

year 2013 and 2017 respectively. In 2014, after taking retirement from Indian Army, Surya

went to England for higher studies and stayed there for one years. Then in April 2015, he

moved to Australia and called his wife to join him along with their first child. In January

2017, their second child was born in Australia. After the birth of second child relationship

between seema and surya got strained. Seema started suspecting surya and often quarrelled

with him unnecessarily. In February 2018, he went to New York. Thereafter he asked Seem

to go back to India. In March 2018, Seema along with her children came back to Karnataka

(India). After moving to New York, Surya severed all his contacts with Seema. He has

developed an extra marital affair with a lady named Deepa .In January 2019, Seema wrote a

letter to Surya expressing her willingness to join Surya in New York. Surya in reply wrote to

Seema that she should not come to New York, as he was interested in getting their marriage

dissolved. In April 2019, he came back to India and started to live with Deepa at Delhi.

When seema tried to contact surya over phone he used to avoid her. One fine day he has send

50,000/- Rs with his relative to be given to seema. He called her and told not to disturb him.

Since Surya failed to Maintain wife and children. In April 2020 , Seema filed a petition under

Section 9of the Hindu Marriage Act, 1955 for Restitution Of Conjugal Rights .
