This examination is conducted over the person of MA. MESALINA
M. RUIZ, Filipino, married, and a resident of Polanco, Zamboanga del
Norte. The examination was conducted by Atty. Kwin Loch O. Febra in her
temporary law office address at Suite 1&2 Ranillo Building, Malvar Street,
Miputak Dipolog City on the 27th day of December 2020.
MA. MESALINA M. RUIZ is answering the questions asked of her,
fully conscious that she does so under oath, and that she may face criminal
liability for false testimony or perjury.
After MA. MESALINA M. RUIZ was sworn to an oath in
accordance with law, the following are her answers to the questions asked of
her.
JUDICIAL AFFIDAVIT
I, MA. MESALINA M. RUIZ, Filipino, married, and a resident of
Polanco, Zamboanga del Norte, after having been sworn to an oath in
accordance with law, do hereby depose and say:
1. QUESTION: Do you prefer this examination to be conducted in
English or in Bisaya?
ANSWER: For purposes of this Affidavit, I prefer the examination to
be in English.
2. Q: Why are you executing this instant affidavit?
A: I am executing this instant affidavit to tell the truth about what
actually happened when the Acknowledgment Receipt in issue was
signed.
3. Q: Were you there when the Acknowledgment Receipt was signed by
the parties?
A: Yes, I was present. In fact, I am a signatory to the
Acknowledgment Receipt in issue being the witness thereof. Hereto
attached is the subject Acknowledgment Receipt as Annex – “1”, and
my signature thereon is marked as Annex – “1-A”.
4. Q: There is a signature here on top of the name Teresa Briget Kuan.
Whose signature is that?
A: That is Briget’s signature.
5. Q: How did you know?
A: I know because I saw her affixed her signature on said document.
And I know it to be the same person because I personally know
Briget, I am a friend of the Kuan family for a very long period of
time.
6. Q: When was the document signed?
A: Although I cannot recall the exact date thereon, I know for a fact
that it was during the execution of the Contract to Sell between Briget
and Jose Kuan (“Dodoy” for brevity).
7. Q: Do you have anything more to add?
A: None ma’am, unless further asked.
