NOTICE INVITING e-TENDER


e- tenders are invited on two-bid system (Part „I‟ – Techno-Commercial Bid and Part „II‟ - Price
Bid) from competent, quality conscious, experienced, financially and technically sound Vendors
meeting Qualifying Parameters along with other details given below for the following work.

Tenderers are advised to download „Notice Inviting Tender‟ along with other tender documents
from the e-tendering portal [Link] the tender shall be submitted
online in soft copy on our e-tendering portal [Link] , the Earnest Money
Deposit in the sealed envelope has to be submitted by dropping it in the IS Department, Level-
2 Tender-box, 139, IndianOil Bhavan, Nungambakkam High Road, Chennai before the due
date and time failing which the tender shall be summarily rejected. A scanned copy of the EMD
by way of DD or exemption certificate in case of NSIC or exempted category has to be
uploaded along with clear scanned copies of required documents to substantiate the claim
towards their credentials along with the tender documents in the appropriate link.

DURATION OF CONTRACT : THREE YEARS FROM THE DATE OF ISSUE OF THE WORK ORDER.

WORK ORDER WILL BE ISSUED ON YEARLY BASIS.

ESTIMATED COST OF
CONTRACT : ` 21,92,155/- PER YEAR.

SECURITY DEPOSIT : 10% OF ONE YEAR WORK ORDER VALUE (WHICH EVER YEAR VALUE IS
HIGHER) SHALL BE DEPOSITED AS SECURITY DEPOSIT.

EARNEST MONEY DEPOSIT : ` 21,922/- (PAYABLE BY WAY OF DEMAND DRAFT) CENTRAL/ STATE
PSUs, NSICs & JVs OF INDIANOIL ARE EXEMPTED FROM PAYMENT
OF EARNEST MONEY DEPOSIT.

PRICE ADJUSTMENT : ½% OF WORK ORDER VALUE PER WEEK OF DELAY OR PART

MINIMUM QUALIFYING PARAMETERS:


I. The tenderer should have Minimum Average Annual Financial
Turnover of Rs. 19.73 Lacs during last three financial years ending
March’2011.
II. The Tenderer should have successfully completed similar work(s) of
minimum value, as described below during last 7 years ending
31/03/2012:
 One single work order (completed value) of Rs. 17.53 Lacs or
 Two work order (each completed value) of Rs. 10.96 Lacs or
 Three work order (each completed value) of Rs. 8.77 Lacs
ONLY WORKS AS DESCRIBED BELOW WOULD BE ACCEPTED AS
SIMILAR WORK: The definition of similar work would be successful
execution of “Annual Maintenance Contract of various capacities of UPS at
different Locations in any of the Four Southern States”.
III. Applicants not fulfilling above qualifying parameters need not apply.
IV. MODE OF SELECTING THE PARTIES:
a) The Technical/ Commercial bid of only those parties submitting their
tenders and EMD before due date and time, shall be opened on the due
date & time of opening.
b) The offers shall be evaluated based on the qualifying parameters
mentioned above.
c) The Price Bid of only those parties shall be opened who will be qualified
as per parameters mentioned above.
d) After opening of the Price Bids, the list of parties shall be made in the
ascending order of their offers received. In case, two or more parties
quote same amount, the party with higher annual turnover shall be
preferred in the list made above. For this purpose, tenderer are

required to enclose a certified copy of their audited balance sheet for


last three financial years along with this tender.
e) The lowest rate shall mean the lowest acceptable rate quoted by the L-
1 party on the overall tender amount (with or without negotiations as
the case may be), after following the Corporations‟ rules on the
procedure of bid comparison.
V. TERMS AND CONDITIONS:
a) Tender document: Tenderers can download the tender from our e-
tendering portal [Link] free of cost using their
Digital signature certificate and registered login ID.
b) Tender document are non-transferable and tender has to be
uploaded by the party in whose name tender has been downloaded
from tender website.
c) Tenderers who do not meet the qualifying norms mentioned
above need not upload their offer as their offer will be
summarily rejected without any further reference to them.
VI. Tenderers are advised to submit EMD of ` 21,922/-, by Demand Draft in
favor of Indian Oil Corporation Limited, payable at Chennai. The EMD
(Original DD) must be submitted in a sealed envelope and dropped in the
tender box before due date and time at the office of:

Entities exempted from submission of EMD: As per MSMED Act, 2006


(or erstwhile NSIC Registered Parties), Central / State PSUs and JVs
of IOC.
A scanned copy of the EMD instrument or exemption certificate in case of NSIC
or exempted category has to be uploaded along with the tender in the
appropriate link.
Successful Tenderers shall be required to submit Security Deposit of 10% of
the value of the work order, whichever year value is higher in the form of Bank
Guarantee/ Demand Draft.

VII. INSTRUCTIONS TO BIDDERS FOR PARTICIPATION IN e-TENDERING:


Indian Oil Corporation Ltd. has developed a secured and user friendly system
through National Informatic Center, which enables Vendors/ Bidders to Search,
View, Download tenders directly and also, enables them to participate & submit
Online Bids on the e-tendering site [Link] in a secured
and transparent manner maintaining confidentiality and security throughout
the tender evaluation process.
All interested bidders are requested to register themselves with the portal
indicated above and enroll their digital certificate with the user id for
participation in the tender.
Bidders are requested to read following conditions in conjunction with various
conditions, wherever applicable appearing with this bid invitation for e-
Tendering. The conditions mentioned herein under shall supersede and shall
prevail over the conditions enumerated elsewhere in the tender document.
a) Procedure to submit On-line Bids / Offers electronically on e-
tendering portal
For this purpose, Vendors / Bidders are advised to read the instructions
available in the homepage of the portal where detailed procedure for
submission of bids is available under the section “Bidders’ Demo Kit”.
b) The bidders should note the following:
i. Late and delayed Bids / Offers after due date / time shall not be
permitted in e-tendering system. No bid can be submitted after
the last date and time of submission has reached. (However if
bidder intends to revise the bid already submitted, they may
change / revise the same on or before the last date and time of
submission of bid). The system time (IST) that will be
displayed on e-tendering web page shall be the time and
no other time shall be taken into cognizance.
ii. Bidders are advised in their own interest to ensure that bids are
uploaded in e-tendering system well before the closing date and
time of bid.
iii. No printed or posted Bids / Offers shall be accepted.
c) Bidders need to have Digital Signature Certificate
Digital Signature Certificate is a unique digital code which can be
transmitted electronically and primarily identifies a unique sender. The
objective of digital signature is to guarantee that the individual sending
the message is who he or she really claims to be just like the written

signature. The Controller of Certifying Authorities of India (CCA) has


authorized certain trusted Certifying Authorities (CA) who in turn allot
on a regular basis Digital Certificates, Documents which are signed
digitally are legally valid documents as per the Indian IT Act (2000).
In order to bid for IndianOil e-tenders all the vendors are required to
obtain a legally valid Digital Certificate as per Indian IT Act from the
licensed Certifying Authorities (CA) operating under the Root Certifying
Authority of India (RCAI), Controller of Certifying Authorities (CCA) of
India. The Digital Certificate is issued by CA in the name of a person
authorized for filing Bids / Offers on behalf of his Company. A Vendor /
Bidder can submit their Bids / Offers On-line only after digitally signing
the bid / documents with the above allotted Digital Signatures.
Bidders have to procure Digital Certificate (Class III) on their own from
any of the Certifying Authorities in India.
d) Submission of Documents
The Unpriced Technical Bids and quoted Price Bid have to be uploaded
online only. However, documents which necessarily have to be
submitted in originals like EMD and any other documents mentioned in
the tender documents have to be submitted offline. Indian Oil shall
not be responsible in any way for failure on the part of the
bidder to follow the instructions.
e) It is advised that the bidder uploads small sized documents (preferably
upto 10 MB) at a time to facilitate easy uploading into e-tendering site.
IndianOil does not take any responsibility in case of failure of the bidder
to upload the documents within specified time of tender submission.
Indian Oil will not be responsible for any delay under any circumstances
for non-receipt of Tenders/submission of filled in tender document by
due date & time.
f) Submission and Opening of Bids
Bid along with all the copies of documents should be submitted in the
electronic form only through IndianOil e-tendering system. Before the
bid is uploaded, the bid comprising of all attached documents should be
digitally signed using digital signatures issued by an approved Certifying
Authority (CA) in accordance with the Indian IT Act 2000. The bidder
should go through the detailed instructions available in the homepage
of the portal for enrolment and online bid submission process. Bidder
has to ensure that their bid is complete in all respect before pressing on
the “FREEZE BID” button. Any revision or amendment in bid shall be

possible after the “FREEZE BID” button is pressed only till the due date
and time of submission of tender.
g) Last Date for Submission of Bids
Bidders are advised in their own interest to ensure that bids are
uploaded in e-Procurement system well before the closing date and
time of bid. Vendors / Bidders must use any computer having Windows
XP versions or higher operating system and an Internet web browser
version internet explorer V8.0 or higher recommended.

Note: Bidders are requested to go through the “Bidders Manual Kit”


available in the homepage of the e-tendering portal i.e.
[Link] to have a clear understanding of the
steps to be followed for bid submission. The “Bidders Mannual kit” is
for general reference only and the tenderers have to abide by the
terms and conditions of this tender.

VIII. VERIFICATION OF DOCUMENTS

a) For verification of original documents tenderer or their authorized


representative shall be required to come to our office on 29.05.2012
to 31.05.2012 between 10:00 Am and 5.00 Pm. Parties shall report
with all originals to our office on specified date and time. Failure on
part of the tenderer to report on specified date and time may result in
rejection of the tender submitted without further communication.
b) Authorized representative of IndianOil, if required, prior to Techno
commercially qualifying may carry out field visits to verify the
credentials claimed by the tenderer. The tenderer shall extend
necessary co-operation to facilitate the visits.
c) Tenderer should be in a position to produce all the original documents
and/or any other information with regard to fulfilling the pre
qualification criteria as and when required by Indian Oil.
d) Incomplete Tenders are liable for rejection without any further
communication to the tenderer and decision of Indian Oil in this respect
will be final.
e) Indian Oil reserves the right to reject the Tender of any or all the
tenderers without assigning any reason whatsoever at its absolute
discretion.

f) IndianOil will not be responsible for delay in submission of on-


line tender & Physical copy of EMD Instrument by due date &
time by any party.

IX. ENCLOSURES: THE TENDER SHOULD, INTER-ALIA, BE ACCOMPANIED


WITH THE FOLLOWING:

a) Soft copies of statement of credentials with scanned copies of


supporting documents pertaining to its constitution, like Partnership
Deed or Certificate of Incorporation & Power of Attorney in favor of
person signing the document.
b) Similar work completed during in last 7 years ending
31.03.2012 along with this tender pertaining to qualifying
parameters with scanned copies of work order and completion
certificate for satisfactory completion and required amount.
c) Scanned copies of Latest Income Tax PAN card No and IT returns filed
for the preceding three financial years.
d) Scanned copies of Audited Profit & Loss Account, turnover and balance
sheet for the preceding three financial years 2008-09, 2009-10 &
2010-11 or as applicable.
e) Scanned copy of an affidavit duely Notarised that party is not
black/holiday listed in the enclosed Performa - Annexure-L and
declaration as per Annexures O, P & Q.
f) Scanned Copy of Original EMD instrument.
g) Tenderer having PF Registration number and ESIC Registration Number
must submit the scanned copies of documents.
X. The tender shall stand summarily rejected inter-alia on
following grounds:
a) Party not meeting tender qualifying norms.
b) Non-withdrawal of conditions & non-acceptance of IndianOil's offered
rates during negotiations post Price Bid opening.
c) Tenderer submitting fabricated/forged documents along with tender
documents.
d) Party not worked in their own name for work experience order.
e) Non-submission of Original EMD within due date and time.
f) Party is holiday listed or black listed.

XI. Tender is also liable for rejection:

a) If the tenderer does not submit the following documents:


i) Undertaking on Tenderer‟s letterhead as per Annexure-I
(original may be handed over at the time of Document
verification)
ii) Supporting documents for meeting the Qualifying norms as per
tender.
b) Stipulates the validity period less than what is stated in the Tender
Form.
c) Stipulates his own conditions.
