1. What changes shall be incorporated in the present Mooting structure in the Indian legal
system? Answer as per your own understanding.
In present mooting structure in India the changes that are incorporated is students cite the
relevant cases decided by the courts along with authentic copy of the reports or journals one
to each judge. Citing of cases always enhances the credibility of the mooter and give strength
to his argument. In present mooting system addressing the court with due respect and
courtesy are seen. Most importantly proper dress code for boys and girls are seen. Students
keep their reference material flagged and cases flagged so, they refer and make their
arguments authentic. The mooting structure of present time has changed a lot from earlier
times. Now students gets a lot of opportunities for enhancing their skills by participating in
these moot courts. It has made the youth to practice in a virtual courts like they are practicing
in real courts. Mooting has provided a way to enhance the speaking skills and enabled
students to work in a group as a team.
2. What all Sources should you focus on while Researching for a Moot and what all Sources
should you discard?
Sources that should be focused while researching for a Moot is going through the moot
problem at least twice, as many times one goes through the moot problem one will find new
thing and can relate to law. The moot preposition generally deals with the cases that are
famous or the issue is famous. As the relevant case one finds can start the work on laws that
can be used. Being able to comprehend judgments quickly. Having efficient skills in
formatting as well as a good researcher on database. Knowing the required citation methods
like the bluebook is also necessary to convince the judge. Both Manupatra and SCC Online
are very useful to find relevant case laws. There need to be two sets of compendiums- one for
the speaker at the dais and one for the judges.
Sources that should be discarded is that one should not use unauthentic data in the moot that
can create problem while the argument. An unauthentic use of data can lead the case go
against. Always listen the judge and don’t interrupt the judge while speaking.

Question:- Imagine you were a Judge at a National Moot Court Competition. You are to
judge the participants on a score out of 100. Answer the following questions :-
i] On what all criteria will you judge the participant?
ii] Allot number of marks for each criteria out of 100.
iii] Analyze as a student, as to which criteria they usually may miss out and thus not perform
to their best of the skills.
YOU MAY CHOOSE TO ANSWER THIS QUESTION IN THE FORM OF VIDEO AS
WELL. While Submission, attach the Link of the Video. It completely depends upon you
whether you wish to answer in the form of a video or a textual format.
Answer-
i) When assessing any participant in the oral argument, my judgement will be based on the
memorial, participant's Knowledge how the participant is using the Facts, Knowledge of
the Law, Structure of Argument, Quality of Argument, and Overall Presentation skills like
the Style, Articulation, Time Management during the moot. On dress code as well as on
etiquettes judging will be done because there are the primary things that are seen.
ii) There are six categories on which marks are allotted. First is Legal arguments which is of
30 marks. Marks are allotted on the basis of understanding and analysis of the issues
presented, Knowledge of the facts of the case, choice of arguments most relevant to the case.
Range of scores are done on different levels as for Poor performance: 0-6, Below Average: 7-
12, Average: 13-18, Above Average: 19-24, Exceptional: 25-30.
Second is Organization of Presentation that is of 20 marks. Marks are allotted on the basis of
Structure and clarity of presentation, Ability to synthesize factual material with legal
argument, Use of time and on Claim of relief.

Third is General Evaluation that is of 15 marks. Marks are allotted on the basis of
persuasiveness, ability to maintain line of argumentation following interruptions and
originality.
Fourth is Responsiveness to Opponents that is of 10 marks. Marks are allotted on the basis of
ability to respond to opponent’s arguments, ability to counter each of the opponent’s
arguments and the ability to anticipate opponent’s arguments.
Fifth is Responsiveness to Judges that is of 10 marks. Marks are allotted on the basis of
ability to respond to judges, thoroughness in answering the questions presented and the
ability to deal with hypothetical questions.
Sixth is Delivery that is of 15 marks. Marks are allotted on the basis of body language, tone
of voice means ability to be heard and most essential is eye-contact.
iii) Analysing as a student, they can miss out and does not perform their best because of
certain things like-
They would have expressed my personal opinion on the case.
They would have cited text books as final authority, or have not cited appropriate cases by
honourable courts.
They would have interrupted a judge while speaking.
They would have replied in hurry.
They would have cited cases without having law reports or at least its photocopy.
