companions.
ISLAMIC MARRIAGE CONTRACT/ PRENUPTIAL AGREEMENT
Allah says, “O you who believe, fulfill [all] contracts”(Al Qur’an 5:1) Prophet Muhammad said,
“The conditions that are more deserving of being fulfilled are those by which marital relations
become permissible [Halal]” (Bukhari and Muslim)

________. I, _____________________ , have agreed to officiate the marriage of the following
couple in accordance with the Islamic guidelines delineated in the Qur’an and authentic
practices of Prophet Muhammad (Sunnah).
Husband:
I, Brother _____________________________, solemnly propose to marry sister
_____________________________ and take her as my wife in accordance with the guidelines
of the Qur’an and the Sunnah of Prophet Muhammad. I offer to her as a dowry (i.e. mahr),

Wife:
I, Sister _____________________________, accept your solemn proposal to take me as your
wife in accordance with the Islamic guidelines of the Qur’an and the Sunnah of Prophet
Muhammad. I also accept the dowry (mahr) proposed by you without compulsion or contest.
Basic Declarations:
1. We declare here that this Marriage Contract/ Prenuptial Agreement will act as an
integral and inseparable part of our marriage agreement, so as long as we remain
husband and wife.
2. We declare that the husband is solely responsible for providing adequate housing,
clothing, and food for the wife and children born from this union, as outlined in the
legislation of Islam. These provisions will be based upon what is fair, reasonable and in
accordance with the financial capacity of the husband, unless otherwise stipulated and
agreed upon by both spouses. We declare that all monies used by the husband to carry
out these responsibilities shall be earned and spent through halal (i.e. Islamically
permissible) means.
3. We declare that our children, whether born to either spouse before this marriage or born
to us during this marriage, shall be raised as Muslims under any and all circumstances,
to include but not limited to death, incarceration, or long-term hospitalization. We declare
that both spouses shall agree upon a designated Muslim guardian who is financially
stable and of sound mind to care for the children in the event of our demise or mental
and/or physical inability to do so.
4. We declare that all money and/or property of the wife, which she brings with her at the
onset of the marriage or that which she earns during the course of the marriage, is her
own property requiring no consultation with anyone concerning its disposal, and not to
be infringed upon except with her permission exclusively. In the event of her demise, all
monies and/or property belonging to the wife shall be dispersed according to the
stipulations of her waseeyah (i.e. final bequest and/or will) and the laws of Islamic
inheritance outlined in the Quran and the Sunnah.
5. We declare that this marriage contract remain effective for the entire duration of the
marriage unless otherwise agreed upon by both spouses. The effectiveness of this
contract also includes periods in which we may have been separated but not divorced,
as well as the time during the waiting period (i.e. iddah).
6. We declare that we enter into the marriage with the intention of a permanent union, with
hopes of pleasing Allah (God).
7. We declare that we will commit ourselves to promoting equity and harmony between us
and our entire extended family, to mutually supporting one another, leading each other
to become more obedient to Allah while protecting ourselves from what is wrong and
unlawful.
8. We declare that we will equally avoid abusing one another mentally, emotionally,
verbally and/or physically.
9. We declare that in the event of any marital disagreement(s), on the part of either spouse,
we will follow the guidelines specified in verse 34 of Surah An-Nisa in the Qur’an (4:34).
If reconciliation cannot be achieved, we will make use of the marital counseling services
provided by our local Masjid or any other marital counseling services offered where both
spouses feel they will receive adequate and equal attention to their issue(s).
