BACKGROUND & EVOLUTION


NEC3 was published in 2005, the main focus of it was to avoid or at least reduce
disputes in contracts NEC is now used for many construction and engineering projects
in the UK and oversees. It is endorsed by the institute of civil engineers, the Olympic
Delivery Authority and the office of Government commerce which recommends NEC3
for use on all public sector construction projects. It has taken much more different
approach to the other conditions of contracts. Its main aim is to provide the following:

1. Clarity and simplicity The document is comprised with an additional material which
includes detailed flow charts and guidance notes, this is because NEC3 is intended to
be clear, simple and easy to use. For this reason, the NEC is written in present tense in
plain English to be simple and clear as possible. But this has its own downside the use
of simple English might provide room for ambiguous and much of its terminology is nor
tested in the courts.

2. Stimulus to good management Being written in present tense means that NEC3
focusses on the real time management of the project and not looking back on what the
contract should have done or what the parties should have done but what to do now
that this or that has happened? The only challenge with this is that it requires an
administration that has very good understanding for it to work properly and effective.
3. Flexibility NEC3 has 9 other clauses that are up to promote flexibility and also the
information of the Z-Clause or bespoke amendments. NEC is a modern-day family of
contracts that facilitates the implementation of sound project management principles
and practices as well as defining legal relationships. Key to the successful use of NEC
is users adopting the desired cultural transition. The main aspect of this transition is
moving away from a reactive and hindsight-based decision making and management
approach to one that is foresight based encouraging a creative environment with
proactive and collaborative relationships.

ADJUDICATION UNDER NEC3

Adjudication is the main adopted measure put up to resolve disputes in NEC3


conditions of contract which is separated in two options, option w1 and option w2.
Option w1 is meant to work of the home rather than local contracts while option w2 is
meant for the international contracts.

FEATUERS COMMON TO BOTH OPTIONS W1 and W2.

In both cases the adjudicator will be named under the contract and if for any reason
they resign or otherwise the parties In this case are allowed to either to agree on the
identity of a new one or either party may involve an adjudicating body to appoint one.
NEC3 just like FIDIC the adjudicator must act impartially and decide the outcome of the
dispute, which means that an adjudicator must be independent and not as an arbitrator.
6 In both w1 and w2 it stresses that unless the adjudicator has notified the parties of the
decision all parties are bound to proceed as if the matter disputed were not disputed.

 EARLY INDICATION OF ANY ISSUE THAT MIGHT AFFECT TIME COST AND
QUALITY.
 MULTIPLE QUOTATIONS ARE REQUIRED TO COMPENSATE FOR
CHANGES IN COST.
 PROVIDES A STATE AT COMPLETION WHICH IS DEFINED WITHIN THE
WORKS INFORMATION.
