FR 22B
It was first introduced in 1983 with effect from 23.08.1983 vide [Link].239,
Fin.&Plg. ([Link]) Dept., Dt.23.08.1983.
Later it was made applicable from 25.12.1982 with monetary benefit from
23.08.1983 vide [Link].332, Fin.&Plg. ([Link]) Dept., Dt.13.12.1983 and
[Link].359, Fin. & Plg. ([Link]) Dept., Dt.28.12.84.
Upto Dt.30.06.03, FR 22 B is made applicable for those who are promoted from
ordinary scales only. Not applicable to the employees who are promoted from
SGP/SPP I/SAPP I/SPP II/SAPP II scales vide [Link].290, Fin. & Plg.
([Link]) Dept., Dt.22.07.93,[Link].358, Fin. & Plg. ([Link]) Dept.,
Dt.25.10.93 and G.O.s issued from time to time.
If an employee drawing pay in SGP/SPP I/SAPP I scales is promoted before
01.08.93 and exercises his option for fixation from the date of earning increment in
lower post which falls after 01.08.93, he is eligible for fixation under FR 22 B vide
Govt. Memo No. 00769/76/[Link]/94, Dt.07.02.94 of Finance ([Link]) Dept., G.O.(P)
No. 362, Fin. & Plg. ([Link]) Dept., Dt.28.10.94 and [Link].366, F&P
([Link]) Dept., Dt.11.11.94.
After 01.07.03, FR 22 B is made applicable for those who are promoted from
SGP/SPP IA/SAPP IA/SPP IB/SAPP IB scales also vide [Link].241,
Fin.(PC.I) Dept., Dt.28.09.05 read with [Link].399, Fin.([Link]) Dept.,
Dt.18.11.05.
FR 22 B is not applicable for those employees who are promoted while drawing
SPP II/SAPP II scales. Their pay has to be fixed in the promotion category vide
FR 22 (a)(i) read with FR 31(2).
If the scale of the employee in the lower category and the promoted category are
identical, then the pay shall not be fixed under FR 22 B, the pay has to be fixed
under FR 22 (a)(i) vide Govt. Memo No.36525-A/462/PRL-2/183-1, Dt.21.01.84
and Govt. Memo No.26378/B/660/PRC/82, Dt.24.06.82.
If any employee reaches maximum of time scale and exhausts all the stagnation
increments, he is not eligible for pay fixation under FR 22 B, his pay should be
fixed under FR 22(a)(i) read with FR 31(2) vide Govt. memo No.40304/692/A1/FR
II/2001, Dt.16.01.2002.
The employee has to exercise his option whether to fix his pay on
i) the date of promotion (or)
ii) the date of accrual of next increment in the lower cadre.
The option should be exercised within 30 days from the date of promotion. If an
employee does not exercise option within this time limit, his pay should be fixed
from the date of promotion itself upto 18.05.09.
If the employee does not exercise his option, in writing, within the stipulated
period from the date of promotion, the competent authority (Head of the

Office/DDO etc.,) shall fix the pay by adopting the method which may be most
beneficial to the employee vide [Link].145, Fin.([Link]) Dept., Dt.19.05.09. It is
also stated that the cases already settled need not be reopened, the change will
only be prospective and cases under litigation will not be covered.
One can change his option within one year form the date of promotion vide
[Link].102, Fin. & Plg. ([Link]) Dept., Dt.19.03.91.
If the date of increment is changed retrospectively, he may exercise revised option
within 30 days from the date of such revision vide [Link].145, Fin. & Plg.
([Link]) Dept., Dt.02.04.85.
The date of next increment shall be after completion of one year of service only
from the date the pay fixed under FR 22 B. The provisions of FR 31(2) shall not be
applicable when the pay fixed under FR 22 B.
Rule:
Where a Govt. servant holding a post in a substantive, officiating, or temporary
capacity is promoted or appointed in a substantive, officiating or temporary
capacity to another capacity to another post carrying duties and responsibilities of
greater importance than those attaching to the post held by him, his initial pay in
the time scale of the higher post shall be fixed at the stage next above the pay
notionally arrived at, by increasing his pay in respect of the lower post by one
increment at the stage at which such pay has accrued.
Pay Fixation Procedure:
i) On date of Promotion: Initial pay may be fixed in the higher post on the basis of
FR 22B straightway without any further review on accrual of increment in the pay
scale of the lower post
ii) on the date of accrual of next increment in the lower post: Initial pay in the
higher post may be fixed on the basis of FR 22 (a)(i) and may be refixed on the
basis of the FR 22B on the date of accrual of increment in the pay scale of the lower

The pay can be fixed under FR 22 B on repromotion to a particular post, if the pay
fixed is more than the pay last drawn in that post on the previous occasion vide
Memo No.634/412/[Link]/88, Fin. & Plg. Dept., Dt.30.06.88.
Special pay drawn by a Typist / Senior Stenographer on promotion as Senior
Assistant / Superintendent, without getting conversion as Junior Assistant /
Senior Assistant counts as pay for fixation under FR 22 B. However, this
concession is applicable only to those persons who are already in service and
whose services have been regularized and shall not be apply to the new recruits
who are appointed on or after Dt.24.08.98 ([Link].190, Fin. & Plg. ([Link])
Dept., Dt.24.08.98).
