Diamond Concept is constructing an office tower and shopping mall project in


Taman University. On the left side of the site is the Central Park, a favourite spot for
children to play. On the right side is nursery. In the course of the construction,
several incidents had happened and Mr. Dunan, the Project Manager now wants
your expert opinions on the issues:

One, Iskandar Puteri City Hall (MBIP), the local authority complained that the arm
of the overhead crane over sails into the Central Park; two, Aiman, a six year old
kid had sneaked into the site, climbed up the scaffolding and fell down injuring his
ankle; three, the retaining wall was constructed three feet into the nursery land;
and four, a subcontractor whose contract had been terminated had removed the
goods that it has delivered to site.

Explain to Mr. Dunan the legal principles relating to those events and advise him
accordingly.

Topic 4

DJ Development advertises in newspapers inviting contractors to tender for its 20


storey shopping and office building. Contractor X visits the site and notices that it
is situated along the busy city centre Main Road. The construction involves the
whole of the site with little no space of anything else. He also notices that there is
a vacant lot across the road that he thinks may be used as the space he needs for
the preparatory works, storage, site office, etc. Contractor X thinks it would make
the work faster and cheaper if tower crane is used to transport materials and
prefab works from the work site to the construction site, particularly, during peak
hours.

You as his quantity surveyor, advise Contractor X the issues that may arise if he is
to use that method.
