Acts commited:
Atty. Edgar R. Navales failed to pay monthly rentals in the aggregate
amount of P139,000.00 and to vacate the leased apartment owned by the
spouses Lamberto and Gloria Eustaquio despite repeated oral and written
demands. This prompted complainants to refer the matter to barangay
conciliation, where the parties agreed on an amicable settlement, whereby
respondent promised to pay complainants the amount of P131,000.00 on
July 16, 2009 and to vacate the leased premises on July 31, 2009.
Respondent eventually reneged on his obligations under the settlement
agreement, constraining complainants to file an ejectment case. The
spouses contend that respondent miserably failed to exemplify honesty,
integrity, and respect for the laws when he failed and refused to fulfill his
obligations to complainants.
Canon/s Violated:
Canon 1 of the Code of Professional Responsibility - A lawyer shall
uphold the constitution, obey the laws of the land and promote respect for
law and for legal processes
Rule 1.01 - A lawyer shall not engage in unlawful, dishonest, immoral
or deceitful conduct.
Rule 1.02 - A lawyer shall not counsel or abet activities aimed at
defiance of the law or at lessening confidence in the legal system.
Penalty imposed:
Suspension from the practice of law for an additional period of six (6)
months from his original six (6)-month suspension, totaling one (1) year
from service of this Decision, with a stern warning that a repetition of the
same or similar acts will be dealt with more severely.
