A Research Paper on Human Rights of Transgender Community
ABSTRACT
Human rights are rights given to all human beings, without discriminating nationality, residence,
sex, origin, colour, religion, language. We all are entitled to our human rights equally without
discrimination. These rights are all interdependent, interrelated and indivisible.
Our society has to recognize the unstoppable momentum towards unequivocal civil equality for
every transgender citizen of the country.
Transgender people are individuals of any sex or age whose personal characteristic, appearance
or behavior differs from stereotypes about how men and women are supposed to be.
Hijras communities face various social security issues. Since most Hijras run away or are evicted
from home, they do not expect support from their biological family in long run. Subsequently,
they face a lot of challenges especially when they are not in a position to earn due to health
issues, lack of employment opportunities, or their image in society. In view of the constitutional
guarantee, the transgender community is entitled to basic rights i.e. Right to dignity, Personal
Liberty, Freedom of expression, Right to Empowerment, Education and, Right against violence,
Discrimination and exploitation and Right to work. Moreover, every person must has right to
decide his gender expression and identity, including transsexuals, Hijras, transgender, and have
right to freely express their gender identity and be considered as a third sex. A 2009 national
survey of more than 6,000 transgender found that forty-seven percent had experienced adverse
job actions because of gender identity and ninety-seven percent had experienced some form of
anti-transgender harassment on job. Clearly there is an urgent need for addressing workplace
inequality for this community.
In this paper we are going to throw some light upon the various aspects of discrimination in
society and employment, transgender community and their law, Transgender children and youth,
Social exclusion of Transgender women, Economic status and civil liberties, Marriage equality,
Diversity and inter sectionalism in the trans population and reforms in current laws, policies and
in mind set of the people towards transgender community.
