PROJECT SPECIAL PROVISIONS

I. GENERAL REQUIREMENTS
The Contractor must be familiar with the proposed project’s existing conditions. This incudes,
but is not limited to, difficult construction around existing trees and utilities, connecting to
existing water lines and small vertical and/or horizontal grade adjustments necessary to avoid
construction conflicts.
All work shall be per the City of Durango Development Standards for Public Improvements and
Construction Specifications (DSCS) and General Conditions unless otherwise noted below or in
the Contract Documents. Where conflicts exist between the DSCS and these specifications, these
specifications shall govern.
All work, workmanship and materials are subject to inspection and approval by personnel of the
City of Durango’s CIP Division. The City of Durango reserves the right to accept or reject any
materials and workmanship that does not conform to the Contract Documents.
Various terms may be used throughout the contract documents to refer to the City’s Project
Manager, including but not limited to: Engineer, City Staff, Owner’s Representative and City’s
Representative. The City’s Project Manager may include or designate other parties for specific
concerns, and can assist Contractor with initial contacts with other City entities.
Working Hours will be Monday through Friday, from 7:30 AM to 5:00 PM unless otherwise
approved. Project Manager is typically available Monday through Friday, from 8:00 AM to 4:30
PM.
Vendors are encouraged to provide bids on products with recycled content or which meet criteria
for environmentally preferable products wherever such products meet the performance criteria
specified in bid documents. The City may accept a bid which is not the lowest bid if (1) the
lowest bid includes a nonrecycled product and (2) a recycled content product meets the
performance criteria specified, or (3) a bid other than the lowest bid meets the criteria for
environmentally preferable products or services, or (4) a cost analysis conducted over the life
and disposal of the product reveals lower total costs than are reflected in short-term analysis.
Contractor shall:
Administration, Communications, Traffic Control, Safety, Stormwater & Testing
1. Obtain all licenses and permits required for construction, including City of Durango
excavation permit, and all associated costs.
2. Be responsible for implementing and maintaining all required traffic control for this project.
This includes preparing and getting approval from the City Traffic Engineer for any and all
MHT’s and/or revisions.
3. Follow all Local, State, and Federal regulations regarding the safety of the project and its
work force.

4. Be solely and completely responsible for conditions at and adjacent to the job site including
safety of all persons and property during performance of the work. This requirement shall
apply continuously and not be limited to normal working hours.
5. Have in their possession at all times a copy of the Contract Documents which have been
approved by the City of Durango’s Capital Improvments Division.
6. Provide an ‘as constructed’ red lined set of plans prior to final acceptance.
7. Provide and implement a storm-water protection and erosion control plan, including
installation of all storm-water protection and erosion control measures prior to any
excavation or stockpiling of materials within the affected vicinity. This includes installation,
maintenance and final removal of stormwater and erosion control measures for the duration
of the project.
8. Notify the proper authorities prior to construction and attend a pre-construction meeting with
the City of Durango’s CIP Division.
9. Coordinate with and notify the public and affected tenants/customers as required. City of
Durango will make an initial construction notification; subsequent coordination and
information regarding access, parking, service interruptions, and all other impacts is the
responsibility of the Contractor.
10. Provide construction quality control testing for all required backfill compaction and concrete
placements using a qualified testing laboratory under the supervision of a Colorado registered
professional engineer. Contractor to provide all required QC testing to include backfill,
waterlines, ABC, concrete, asphalt, and other items as specified in the contract/bid
documents. Concrete testing to include strength testing cylinders. All test results to be
provided to the COD Project Manager. All Quality Control testing is incidental to the
material placed and will not be paid separately.
11. Notify the Project Manager 24-hours in advance of compaction tests, concrete placement,
and asphalt placement. Contractor coordination with the quality tester(s), City Project
Manager, and City Inspectors will not be paid for separately, but will be incidental to the
work.
Excavation, Protection/Restoration of Existing Utilities and Other Improvements
12. Comply with all current Colorado 811 requirements and time frames for utility locates. The
Contractor shall contact the appropriate agencies for the location of underground utilities
within the project areas at least two (2) full business days prior to commencement of
construction, or longer as required by utility locating agencies.
13. Be responsible for the location of all utility lines, including service lines, both horizontally
and vertically. Buried utility information indicated on the plans meets SB18-167 Utility
Locate Law requirements to Level B. The Contractor is required to provide test holes (pot-
hole with non-destructive hydro or pneumatic excavation technique) to verify buried utility
locations at all crossing locations. Contractor shall coordinate all utility pole/post protection
with utility pole owner. The cost of protecting existing utilities, and minor adjustments to the
proposed improvements to accommodate existing utilities, shall be considered incidental.

14. Keep existing water and sewer lines in service during construction. Contractor shall obtain
an interruption of water service permit from the City of Durango 72 hours prior to shutting
off the main for any water service outages required for tie-ins. Tie-ins shall be coordinated
with the Utility Department, and all in service water valves will be operated by the Utility
Department.
15. Expect any excavation to include rocks of varying size. Removal of rocks with conventional
excavation equipment appropriate for the project scope (inc. rock hammer) will not receive
additional payment. If boulders too large for conventional excavation equipment are
encountered, advise the Project Manager; alternate methods and compensation will be
addressed at that time.
16. Notify Project Manager immediately if unforeseen conditions prevent construction per
Contract Documents. Any work done not in full compliance with the Contract Documents or
not specifically approved by the Project Manager will be at the Contractor’s risk. Contractor
may be required to remove such work without compensation.
17. Be responsible for the proper and legal disposal of all demolished and excess materials.
18. Shall salvage and restore, repair or replace in kind all improvements including landscape
features, plantings and utilities damaged or removed during construction, including but not
limited to: fencing, irrigation ditches, sprinkler systems, shrubs, trees, pavement, curbs,
gutters, sidewalks, water and sewer mains or service lines, storm drains, power, gas, cable,
fiber optic lines, hand-holes, pull boxes, bollards, utility poles, light poles and anchors, etc.
The Contractor must guarantee landscape repairs or replacement for two (2) years after the
final acceptance of the construction.
19. Restore any vegetated areas damaged by wheel ruts, excavations, or similar, using native soil
graded to match surrounding undisturbed area, tilled four inches (4”) deep, minimum, seeded
with two pounds (2 lbs.) live seed per 1,000 square feet to match surrounding vegetation, or
foothills native grass seed mix in natural or native areas. All seeding is to be topped with
weed free certified straw mulch placed at a rate of one (1) two-wire bale per 500 square feet,
crimped to the ground.
20. Contact the Project Manager if roots greater than 2” in diameter are encountered. Roots
encountered smaller than 2” in diameter shall be cut clean to remove notable damage from
excavation or portions in the way of installation work.
II PAYMENTS
Payments will be made once each month as work progresses and will be based upon pay requests
from the Contractor to the Project Manager. The Contractor shall submit a complete and signed
progress payment estimate delivered to the Project Manager on the 20th of each month. The
estimate shall cover the value of the work performed and the materials placed in accordance with
the Contract Documents and for materials delivered during the preceding month and shall be
supported by such data as the Project Manager may reasonably require. Materials and equipment
delivered and suitably stored at or near the site, but not incorporated in the Work, may be
included in an estimate; provided, however, the Contractor shall include supportive data
establishing title in the name of the Contracting Agency. The Project Manager shall confirm the
pay requests based on independent estimates. The Project Manager shall approve or disapprove

the estimate within ten (10) days. Written disapproval of the payment shall be delivered to the
Contractor and shall include reasons for the disapproval. The Contracting Agency will deduct
retainage from the partial payments in the amounts specified to protect the Contracting Agency
and will retain this money until after completion of the entire Contract. Upon publication of
Notice of Final Settlement, the Contractor shall prepare and submit to the Project Manager a
written request for the release of the retainage withheld.
The contractor is hereby advised of Colorado Statue (HB 91-1150) Section (2) which requires
that, under certain conditions, "the Contractor shall make payments to each of his subcontractors
of any amounts actually received which were included in the Contractor's request for payment to
the public entity for such contracts. The Contractor shall make payment from the public entity
...."
III. SUBMITTALS
A. Permanent Material Data: Construction material submittals for all permanent materials
imported to the construction site such as gravel gradation, concrete and asphalt mix designs, pipe
and fitting cut sheets shall be provided to City of Durango, CIP Division upon Notice of Award
to enable acceptance prior to Notice to Proceed and purchase of materials.
B. Pre-fabricated Booster Pump Station: Shop drawings and specifications for the pre-
fabricated booster pump station shall be provided by the Contractor to the City of Durango for
review and approval.
C. Cummins Generator and ATS: Shop drawings and specifications for the Cummins
generator and ATS shall be provided by the Contractor to the City of Durango for review and
approval.
B. Project Schedule: The Construction schedule is to be submitted prior to the preconstruction
meeting, and updated as the project evolves. Scheduling coordination with City of Durango
Utilities Department is critical to minimize interruptions in service.
C. Pump Station, Waterline Installation, Testing, and Connection Method Statement: The
Contractor shall prepare and submit for review and approval a method of work statement
describing the materials and planned sequencing of new pump station installation, disinfection,
testing, and connection to the existing water system.
D. Stormwater Management and Pollution Control Plan: An erosion control plan per
CDPHE requirements, indicating types and locations of devices to be used, and contact
information for who is responsible for installation and maintenance of devices, shall be
submitted to the City of Durango CIP Division for review and approval prior to the start of
construction. The area of disturbance for this project is under 1 acre. Therefore, neither a City of
Durango Stormwater Quality Permit nor a CDPHE Stormwater Permit are required for this
project.

IV. PAY ITEMS & PROJECT SPECIAL PROVISION SPECIFICATIONS
A. REPLACEMENT OF THE EXISTING BOOSTER PUMP STATION
This work includes items bid 11 and 15, and consists of installing the new pump station, cutting
over from the existing pump station to the new pump station, and salvaging the existing pump
station. Construction sequencing must be planned such that water outages do not exceed 5 hours
in duration. The Contractor must coordinate all water outages with the City of Durango Utilities
Department. The Contractor is responsible for providing generator power to the pump station(s)
during the electrical services upgrade. Generator power is incidental to the work and will not be
paid for separately.
The existing pump station is to be salvaged by the Contractor and stored on site under the
direction of the City of Durango Project Manager. The existing pump station must be protected
and removed in working condition for future City of Durango use. Any work or materials
required to preserve the condition of the existing pump station are considered incidental to the
work and will not be paid for separately.
