1. PROSECUTION CASE
The prosecution case, in brief, is that on ____________, the accused
allegedly committed the offence punishable under Section __________ PPC.
Consequently, FIR No. ____________ was registered at Police Station
____________. After completion of investigation, the challan was
submitted before this Court for trial.
2. CHARGE

4. STATEMENT OF THE ACCUSED

The accused denied the allegations and pleaded innocence.
(Choose one)
(a) The accused did not produce any defence evidence.
OR
(b) The accused produced defence evidence in support of his plea.
5. POINT FOR DETERMINATION
Whether the prosecution has proved beyond reasonable doubt that the
accused committed the offence punishable under Section __________ PPC?
6. DISCUSSION AND REASONS
I have carefully examined the entire evidence available on the record
and heard the learned Prosecutor as well as the accused.
The prosecution has relied upon the oral as well as documentary
evidence. The testimony of the prosecution witnesses has been
examined in the light of the available record.
The defence has denied the allegations and has taken the plea that
the accused has been falsely implicated.
It is a settled principle of criminal law that the burden lies upon
the prosecution to prove its case beyond reasonable doubt. If any
reasonable doubt exists, its benefit must go to the accused.
(Now write your discussion according to the facts given in the
question paper.)
---------------------------------------------------------------
If Conviction:
The evidence produced by the prosecution is reliable, trustworthy
and confidence-inspiring. There are no material contradictions.
Therefore, I hold that the prosecution has successfully proved its
case beyond reasonable doubt.
---------------------------------------------------------------
If Acquittal:
The prosecution evidence suffers from material contradictions and
fails to establish the guilt of the accused beyond reasonable doubt.
Accordingly, the accused is entitled to the benefit of doubt.
7. ORDER
(If Convicted)
Consequently, for the reasons discussed above, I hold that the
prosecution has successfully proved its case beyond reasonable
doubt.
Accordingly, the accused __________________ is convicted under
Section __________ PPC and is sentenced to ________________.
The accused is informed of his right to file an appeal before the
competent Court in accordance with law.
(If Acquitted)
Consequently, the prosecution has failed to prove its case beyond
reasonable doubt.
Accordingly, the accused __________________ is acquitted of the
charge by extending the benefit of doubt.
He shall be released forthwith if not required in any other case.
Announced in open Court
this ____ day of __________, 20____.
