MEDIATION SIMULATION PROBLEM
Ankit and Meera have been married for six years and have a four-year-old daughter, Diya.
Ankit works in a private company and lives with his parents in Bengaluru. Meera, who
worked as a lecturer before marriage, stopped working after the birth of the child.
From the beginning of the marriage, tensions existed between Meera and Ankit’s parents.
Meera felt that she was constantly criticised for her lifestyle, parenting choices, and inability
to manage household work according to the family’s expectations. She repeatedly requested
Ankit to move into a separate house nearby, but Ankit refused, stating that he could not leave
his ageing parents alone.
Arguments between the couple became frequent and dramatic. On several occasions, both
families interfered, leading to heated exchanges and emotional confrontations. Meera alleges
that Ankit always sided with his parents and ignored her emotional well-being. Ankit alleges
that Meera disrespected his parents and threatened to leave the house whenever disputes
arose.
Eight months ago, after a major argument during a family function, Meera left the
matrimonial home with Diya and started residing with her parents. Since then, the parties
have been living separately. Ankit wants Meera to return to the matrimonial home, while
Meera is only willing to continue the marriage if they live separately from his parents.
A further dispute has arisen regarding custody of Diya. Meera wants permanent custody of
the child, claiming that Diya is emotionally attached to her and is uncomfortable in the joint
family environment. Ankit seeks shared custody and regular visitation rights, alleging that
Meera is preventing him and his parents from meeting the child.
The matter has now been referred for mediation to explore the possibility of settlement
between the parties.
