The undersigned SPS RAMON AND LIZA DE VEGA , hereby applies (or apply) to
have the land hereinafter described brought under the operation or the Property
Registration Decree, and to have the title thereto registered and confirmed:

1. That the applicants are the owners of the land (by virtue of possession in
accordance with Section 14 of said Decree, the said land, consisting of one
12,870 square meters parcel is situated, bounded and described as shown

PETITION

COMES NOW, the Petitioner, ERAP P. RAMOS, by and through the undersigned
counsel and unto this Honorable Court respectfully alleges that:

1. The Petitioner is of legal age, Filpino, married, and a resident of 187 Reinoso
St., Poblacion, Alaminos City, Pangasinan where he may be served with court
processes;

2. Petitioner is the registered owner of a parcel of land covered by Transfer


Certificate of Title No. 36028, issued by the Registry of Deeds of
Pangasinan;

3. The said property is more particularly described as follows:

4. Petitioner was in possession of the Owner’s Duplicate Certificate of Title


corresponding to the above-mentioned TCT;

5. However, on or about June 23, 2021 said Owner’s Duplicate Copy was lost
due to typhoon, despite diligent efforts to locate the same;

6. Petitioner executed an Affidavit of Loss, a copy of which is attached as


Annex “B”;

7. The original copy of the title remains intact and on file with the Registry of
Deeds of Pangasinan;

8. The loss of the Owner’s Duplicate Certificate of Title was not due to any
fraudulent act, nor has the same been pledged, sold, or otherwise
encumbered;

9. There are no existing claims, liens, or encumbrances affecting the


property, except those annotated on the title, if any;
10. Pursuant to law, it is necessary to secure a court order for the issuance of a
new Owner’s Duplicate Certificate of Title in lieu of the lost one.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed of the


Honorable Court that after due notice and hearing, a decision be rendered by this
Honorable Court directing the Registry of Deeds of Pangasinan to cause the
issuance of a new Owner’s Duplicate Copy of TCT No. 36028 with like faith and
integrity as the lost certificate of title for all legal intents and purposes.

Other reliefs and remedies as may be deemed just and equitable under the
premises are likewise prayed for.

5. Plaintiff demanded that Defendant vacate the encroached portion, but Defendant
refused and continues to unlawfully possess the same.
6. Defendant’s continued occupation constitutes a violation of Plaintiff’s right of
ownership, entitling Plaintiff to recovery of both ownership and possession.

PRAYER

WHEREFORE, premises considered, Plaintiff respectfully prays that judgment be


rendered:

1. Declaring Plaintiff as the lawful owner of the encroached portion;

2. Ordering Defendant to vacate and surrender possession of the property;

REAL ESTATE MORTGAGE AGREEMENT

KNOWN ALL MEN BY THESE PRESENTS:

EDDIE D. CRUZ married to JOSIE T. CRUZ, of legal age and residents of 8 Rizal
St., Poblacion, Bani, Pangasinan, Philippines (hereinafter as the MORTGAGORS);

instruments evidencing the obligations hereby secured or shall, during the time this
mortgage is in force, institute insolvency, suspension of payment of similar
proceedings, or be involuntary declared insolvent or writ of garnishment and/or
attachment be issued against any of the assets or income of the MORTGAGORS or
if this mortgage cannot be recorded in the Registry of Deeds, then all the obligations
of the MORTGAGORS secured by this mortgage shall immediately become due and
payable and defaulted and the MORTGAGEE may immediately foreclose this
mortgage judicially, or extra-judicially pursuant to Act No. 3135, as amended. The
MORTGAGEE is hereby appointed attorney-in-fact- of the MORTGAGORS, with full
power and authority to take actual possession of the mortgage property at once, and
to forthwith foreclose this mortgage judicially, or to sell the above-described property
extra-judicially in accordance with Act 3135. As amended, and to take such other
action(s) as he may be deem necessary to recover the amount due; and in the event
such of judicial or extra-judicial foreclosure or other legal action, the MORTGAGEE
shall be entitled to compensation for expenses incurred, attorney’s fees and costs of
collection, which is stipulated to be twelve percent (12%) of the indebtedness then
unpaid but not less than Php500,000.00.

The condition of this mortgage is such that if the MORTGAGORS shall well and truly
pay or cause to be paid to the MORTGAGEE the obligation in the principal sum with
accrued interest, according to the terms and tenor hereof, then this mortgage shall
thereby fully discharged and without further effect; OTHERWISE, it shall remain in
full force and effect and shall be enforceable in the manner provided by law.

PETITION

PETITIONER, through undersigned counsel unto to his Honorable Court, respectfully


states that:

1. Petitioner, is of legal age, Filipino citizen, married to Andrea S. Mariano and a


resident of Poblacion, Agno, Pangasinan where he may be served with
summons and other processes from this Honorable Board;

2. Responded is the Register of Deeds of the province of Pangasinan who is in


charge of certificates of title and with office address Narciso Ramos Sports
and Civic Center, Lingayen;

3. Dexter B. Mariano is the registered owner of a certain agricultural land known


as Lot No. 453-C, PsD-xx-xxxx-xx covered in Transfer Certificate Title No. T-
57921, situated in Alacan, Malasiqui, Pangasinan with an area of TWENTY-
ONE THOUSAND NINE HUNDRED (21,900) SQUARE METERS. Machine
copy of TCT No. T-57921 is hereto attached and marks as Annex “A” hereof;

4. In the certificate title, the first name was erroneously written as Dixter instead
of Dexter. Machine copy of the certification as to marriage of Dexter B.
Mariano and Andrea S. Mariano is hereto attached as Annex “B”;

5. Such fact was also confirmed in a Joint Affidavit of Two Disinterested Persons
executed by James Lebron and Kathy Dion marked as Annex “C” hereof;

6. There is a need of change this entry to prevent future complications.


PRAYER

WHEREFORE, premises considered, it is most respectfully prayed of this Honorable


Adjudication Board that an Order be issued directing the Register of Deeds of the
Province of Pangasinan to change the first name from DIXTER to DEXTER.

I, DEXTER B. MARIANO, Filipino, of legal age, and a resident of Poblacion, Agno,


Pangasinan, under oath hereby depose and say that:

I am the petitioner in this instant case;

I have read the foregoing Petition and the allegations therein are true and correct as
of my own knowledge and/or based on the records on hand;

I attest to the authenticity of the annexes thereof;

I further certify that I have not commenced and/or am not aware of any other action
or proceeding involving the same land, or a portion thereof, or issue in any court,
tribunal or quasi-judicial agency; and to the best of my knowledge, no such action or
proceeding is pending in any court, tribunal, or quasi-judicial agency, and if I should
thereafter learn that the same or similar action or claim has been filed or pending, I
shall report the fact within five (5) days from such notice.

PETITION

COMES NOW, the above-named petitioner, thru and by his undersigned counsel,
and to this Honorable Court respectfully states:

1. That the said petitioner is of legal age, Filipino citizen, and a resident of
Poblacion, Agno, Pangasinan;

2. That he is the registered owner of fee simple of that certain parcel of land
embraced in and covered by Transfer/Original Certificate of Title No. T-57921,
the location, area and boundaries of which are as follows:

3. That the original copy of the said certificate of title which used to be kept in
the custody of the Register of Deeds of Pangasinan, as well as the owner’s
duplicate thereof formerly held by the herein petitioner, was lost or destroyed
by fire;

4. That no co-owners or other duplicates of said certificate of title had been


issued;

5. That there are no buildings or improvements existing on said land which do


not belong to the herein petitioner as the registered owner;

6. That the petitioner and his family are actually in possession of the property;

7. That the names and addresses of the owners of adjoining properties, as well
as of other persons who may or might have interest in the property covered by
the missing certificate of title, are as follows:

8. That the property is free from all liens and encumbrances of any kind or
whatsoever;
9. That there is no deeds or instruments affecting the property which have been
presented for and pending registration to this date in the office of the Register
of Deeds concerned; and

10. That certified copy of Transfer/Original Certificate of Title No. T-57921, as


previously issued by the Registrar of Land Titles and Deeds of PANGASINAN,
which may be availed of as a basis for the reconstitution herein applied for, is
submitted herewith and marked Annex “A”.

WHEREFORE, and invoking the provisions of Republic Act, after due


publication and hearing, to order and direct the Register of Deeds of PANGASINAN
to reconstitute the original copy of Transfer/Original Certificate of Title No. T-57921 in
the name of the herein petitioner and in exactly the same terms and conditions, on
the basis of the certified copy of the same certificate of title previously issued by the
Registry of Deeds of PANGASINAN which is attached hereto and marked Annex “A’,
and, once accomplished. The Registrar be further ordered and directed to issue a
new owner’s duplicate of the same certificate of title in lieu of the one was lost or
destroyed.

AFFIDAVIT OF ADVERSE CLAIM

I, JULIE G. ANGELITO, of legal age, Filipino citizen, and a resident of Barangay


Alos, Alaminos City, Pangasinan, after being sworn to in accordance with law,
depose and state:

1. That I am the buyer over a parcel of land covered by Transfer Certificate of


Title No. 10982, registered in the name of JOSELITO D. ANDAYA, situated in
Barangay San Jose, Bani, Pangasinan;

2. That on April 10, 2021, I entered into a Contract to Sell with the said
registered owner, whereby the latter agreed to sell the above-described
property to me for a total consideration amount of TWO MILLION THREE
HUNDRED NINETY-SIX THOUSAND PESOS (Php2,396,000.00);

3. That pursuant to said agreement, I have already paid the amount of ONE
MILLION ONE HUNDRED NINETY-EIGHT THOUSAND PESOS
(Php1,198,000.00), representing partial payment of the agreed purchase
price, as evidenced by receipts and/or written acknowledgement issued by the
seller;

4. That despite my compliance in paying a substantial portion of the purchase


price, the seller unjustifiably refused and failed to execute the corresponding
Deed of Absolute Sale in my favor, in violation of our agreement;

5. That by virtue of said partial payment and agreement, I have acquired a lawful
and enforceable interest over the subject property;

6. That I am executing this Affidavit of Adverse Claim to protect and preserve my


rights and interest over the said property, and to serve notice to third persons
of my claim, pursuant to Section 70 of Presidential Decree No. 1529
(property Registration Decree);

7. That this adverse claim is being annotated on the title of the property to
prevent any disposition, encumbrance, or transfer thereof that may prejudice
my rights and interest.
