INSURANCE FRAUD

1. INTRODUCTION

There are several types of fraud that affect the day to day operation of an organization.
Understanding the total impact of fraud enables organizations to make more informed decisions.
Insurance fraud is one of the types of fraud that affect the day to day operations of insurance
companies. Insurance fraud refers to the commission of any act with the intent to obtain an
outcome that is favorable but fraudulent during an insurance claim. It can take various forms,
such as filing a false insurance claim or exaggerating damages, injuries, or other losses to receive
benefits (Legal Dictionary, 2015). In essence, it involves attempting to exploit an insurance
contract for financial gain. This essay will tackle issues concerning insurance fraud, the forms of
fraud or financial crime, the current legal and regulatory provisions about the form of fraud or
financial crime, how they are assessed to determine the manner and amounts involved and
remedial options available and how prevalent is the form of fraud or financial crime in the
country and or internationally.

2. FORMS OF FRAUD

To begin with, the forms of fraud that fall under insurance fraud. According to (Rosanes, 2022)
insurance fraud include the following;

2.1 Claims Fraud

This occurs when a policyholder makes a false claim or stages an event that never happened. For
example, slip-and-fall claims, staged auto accidents, or property damage for a higher payout.

2.2 Death Fraud

In rare cases, a policyholder may fake their own death to receive a life insurance payout.
Conversely, beneficiaries might attempt murder to claim the entire benefit.

2.3 Application Fraud

Some applicants provide incorrect information on their life insurance application (material
misrepresentation). Dishonesty about health, smoking habits, or other factors can affect policy
costs.
2.4 Premium Leakage

Insurers may omit or misstate underwriting information, leading to inaccurate rates in auto
insurance

According to (Cressey, 2023) these forms of fraud may occur as a result of the following
reasons;

Financial Stress, Individuals facing financial difficulties may resort to fraud to alleviate their
situation.

Greed, some people are motivated by the desire for financial gain, leading them to commit fraud.

Addiction, substance abuse or gambling addiction can drive individuals to fraudulent acts.

Sense of Entitlement, a belief that they deserve more than what they have can lead to fraudulent
behavior.

Opportunity, fraud often occurs when there’s a perceived low risk but high financial gain, such
as inflating claims or omitting information on applications

3. NATIONAL AND/OR INTERNATIONAL LEGAL REGULATORY


PROVISIONS ABOUT THE FORM OF INSURANCE FRAUD OR FINANCIAL
CRIME

Legal and regulatory provisions play a crucial role in preventing and addressing fraudulent
activities. The following are some of the national and/or international legal regulatory provisions
about the forms of insurance fraud or financial crimes in reference to (Fraud and Financial
Crime: 2023 Regulatory Challenges, 2023).

Firstly, reporting Requirements. Regulators require insurers to report suspicious activities


promptly. This ensures that potential fraud cases are investigated thoroughly.

Secondly, anti-Fraud Units. Many insurance companies have dedicated anti-fraud units. These
teams collaborate with law enforcement agencies and share information to detect and prevent
fraud.

Thirdly, Laws and Penalties. Legal frameworks define insurance fraud as a criminal offense.
Penalties for fraud can include fines, imprisonment, or both. These laws act as deterrents.
Furthermore, Consumer Protection. Regulations protect policyholders by ensuring fair practices,
transparency, and timely claims processing. This helps prevent fraudulent denials or delays.

In addition, data sharing. Regulators encourage data sharing among insurers to identify patterns
of fraud. This collective effort enhances fraud detection capabilities.

Finally, training and Awareness. Insurers and agents receive training on fraud prevention. This
includes recognizing red flags, verifying claims, and understanding legal obligations.

4. ASSESSMENT TECHNIQUES AND REMEDIAL OPTIONS AVAILABLE

Assessing insurance fraud involves a systematic approach to uncover fraudulent activities and
quantify their impact. The points below are the techniques of assessing insurance fraud according
to (Investigating Insurance Fraud: Best Practices and Techniques, 2023).

The fist technique is initial assessment. It involves gathering preliminary information about the
claim, assessing its potential for fraud and then determining the scope of the investigation.

The second technique is legal compliance. It involves familiarizing yourself with relevant laws
and procedures, obtaining proper authorization for accessing records or conducting surveillance
and respecting individuals’ rights and maintain confidentiality.

Another technique is detailed investigation plan. It requires on to develop a comprehensive plan


which requires to define objectives, tasks, timelines, and resource allocation and consider fraud
nature, available evidence, and challenges.

Data Analytics is also another technique in assessing insurance fraud. It uses data analytics tools
to detect anomalies in claims data and identify patterns suggestive of fraud.

Lastly, key performance indicators (KPIs). This monitors KPIs related to fraud detection by
assessing claim rejection rates, investigation closure time and false positive/negative rates.

There are several remedial options available that help to deal with insurance fraud, which include
proving fraud, termination of policy if fraud is confirmed, reporting suspicious activities by
reaching out to the state’s fraud bureau and adopting fraud prevention measures such as adopting
artificial intelligence in fraud investigations, implement a zero-tolerance policy for fraud,
automate claims processes, use data analytics and involve outside experts when needed (Prusak,
2021).

5. PREVALANCE OF INSURANCE FRAUD INTERNATIONALLY AND


LOCALLY

Insurance fraud is a persistent issue both in Malawi and globally. In Malawi, fraudulent activities
impact the insurance industry significantly. According to (Chiyembekeza, 2014) approximately
30% of all claims processed are false, particularly in the motor insurance section. The prevalence
of insurance fraud in Malawi takes three principal dimensions which are insurance premium
diversion, staged claims and exaggerated claims.

Globally, it’s estimated that 10% of all insurance claims made by consumers are fraudulent, with
only a fifth of these detected by insurers this is according to (KAVANAGH, 2018).

The challenge of Insurance Fraud can be addressed by ensuring collaboration between insurers,
since sharing information about fraud issues and maintaining resources like the insurance claims
register can help, improved fraud detection mechanisms, public awareness and putting stricter
penalties for fraudsters.

6. CONCLUSION

Insurance fraud is a major setback in the insurance industry since it affects the trust, operations
and finances of both the company and policyholders. This essay has explained insurance fraud
mainly focusing on the forms, the current legal and regulatory provisions about the form of fraud
or financial crime, how they are assessed to determine the manner and amounts involved and
remedial options available and how prevalent is the form of fraud or financial crime in the
country and or internationally.
