BAILIFF AND CLERK, GROUP-C RECRUITMENT IN THE OFFICE OF
SHERIFF OF MUMBAI RULES, 2022
PREAMBLE
In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in
supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of
Maharashtra, is hereby pleased to make the following rules regulating recruitment to the posts of Bailiff
and Clerk, Group-C in the Office of the Sheriff of Mumbai, namely:--
Rule - 1.
These rules may be called "the Bailiff and Clerk, Group-C Recruitment in the Office of Sheriff of Mumbai
Rules, 2022".
Rule - 2.
In these rules, unless the context requires otherwise,--
(a) "Commission" means the Maharashtra Public Service Commission.
(b) "Degree" means a degree of any discipline of a statutory university or any other qualification
declared by the Government to be equivalent thereto;
(c) "Government" means the Government of Maharashtra;
(d) "Government Commercial Certificate" means a certificate in typewriting or computer typewriting
awarded by the Maharashtra State Council of Examinations or Bureau of Government Examination,
Department of Education, Government of Maharashtra and it includes a Certificate issued by any other
institution as may be specifically approved by the Government for this purpose;
(e) "post in Group-D" means post falling in Group-D in the Office of the Sheriff of Mumbai;
(f) "Secondary School Certificate Examination" means the Secondary School Certificate Examination
conducted by a Divisional Boards constituted under the Maharashtra Secondary and Higher Secondary
Education Boards Act, 1965 (Mah. XLI of 1965) and includes any other examination declared by the
Government to be equivalent thereto.
Rule - 3.
Appointment to the post of Bailiff and Clerk, Group-C in the Office of Sheriff of Mumbai, shall be made
either,
(a) by promotion of a suitable person, on the basis of seniority, subject to fitness from amongst the
persons holding the post in "Group-D", having not less than three years of regular service on the post
in "Group-D" and possess qualifications mentioned in sub-clauses (ii) and (iii) of clause (6);
Or
(b) by nomination, on the basis of result of Competitive Examination held by the Commission, from

amongst the persons who,--
(i) are not less than nineteen years of age and not more than thirty-eight years of age in case of
persons belonging to open Category and not more than forty-three years of age in case of persons
belonging to Backward Category;
(ii) possess a degree; and
(iii) possess the Government Commercial Certificate or Computer Typing Certificate with a speed of not
less than 30 words per minute in Marathi Typewriting or 40 words per minute in English Typewriting ;
Or
(c) by appointment of a suitable person on compassionate ground, in accordance with the orders issued
in this behalf by the Government, from time to time, who possess qualifications specified in sub-clauses
(ii) and (iii) of clause (6);
Or
(d) by appointment of a suitable person on deputation possessing qualifications mentioned in sub-
clauses (ii) and (iii) of clause (b) and holds equivalent post in Government Office:
Provided that, the person eligible to appear from the Class of Divyangjan (Persons with
disabilities/Differently abled persons/Specially enabled persons) or Class of ex servicemen, who does not
possess the qualification mentioned in sub-clause (iii) of clause (b), shall be allowed to appear for the
competitive examination for this post, subject to the condition that, such person shall acquire this
qualification within the period of two years from the date of his appointment. If such person does not
acquire this qualification within the said period he shall be liable to be terminated from the service:
Provided also that, if a person appointed on compassionate ground does not possess the qualification
mentioned in sub-clause (iii) of clause (b), within the period specified by the Government, from time to
time, then the action shall be taken as per orders issued by the Government, from time to time, in
this regard :
Provided also that, the educational qualification of Secondary School Certificate shall be applicable to
the candidates for appointment on compassionate ground, who are included in waiting list for
appointment on compassionate ground, before the date of publication of these recruitment rules in the
Official Gazette; and from the date of publication of these recruitment rules in the Official Gazette, the
educational qualification prescribed in sub-clause (ii) of clause (b) shall be required for including the
name in the waiting list for appointment on compassionate ground :
Provided also that, the upper age limit mentioned in sub-clause (i) of clause (b) shall not apply to the
persons appointed on compassionate ground and persons belonging to classes reserved for horizontal
reservation such as Ex servicemen, Divyangjan (Persons with disabilities/Differently abled
persons/Specially enabled), Project affected persons, Earthquake affected persons and Sports persons.
Upper age limit for the candidates belonging to such classes shall be as per the prevalent policy
declared by the Government in this regard, from time to time.

Rule - 4.
Appointment to the post mentioned in rule 3, shall be made by promotion and nomination including the
appointment on compassionate ground, in the ratio of 25:75 respectively:
Provided that, if suitable candidates possessing prescribed qualifications mentioned for promotion are
not available, the Appointing Authority may relax the ratio for appointment by promotion and may
appoint the candidates by nomination.
Rule - 5. Hindi and Marathi Languages Examinations.
(a) It shall be mandatory for the Government Servant who has been appointed by promotion to the
post mentioned in rule 3, either have been passed Hindi and Marathi language examinations as
regulated by the Government (Marathi Language Department) from time to time regarding passing of
these examinations or to get exemption from passing of these examinations before getting promoted to
the said post, otherwise, such Government Servants shall not be eligible for promotion to the post
mentioned at rule 3.
(b) If any Government Servant who has been appointed by nomination to the post mentioned in rule 3,
hasn't passed the Hindi and Marathi language examinations before appointment, as regulated by the
Government (Marathi Language Department) from time to time regarding passing of these examinations
or he/she hasn't been exempted from passing of these examinations, then he/she is required to pass
these examinations, within the prescribed time limit. If such Government Servant shall fail to pass Hindi
and Marathi language examinations within the prescribed time limit, then he/she shall not be entitled
for annual increment till passing of these examinations. Further he/she shall not be entitled for
promotion till passing of these examinations.
Rule - 6. Certificate in Computer Operation.
(a) It shall be mandatory for the Government Servant who is to be appointed by promotion to the post
mentioned in rule 3, either to possess the Computer Operation Certificate as regulated by the
Government (General Administration Department/Information Technology) from time to time or to obtain
exemption from passing of the examination of Computer Operation on the grounds of age criteria
prescribed by Orders issued by the General Administration Department/Information Technology, from
time to time, before being promoted to the said post.
(b) If any Government Servant who is to be appointed by nomination to the post mentioned in rule 3,
shall fail to possess the Computer Operation Certificate, as regulated by the Government from time to
time, before appointment, then he/she is required to possess the said certificate within the prescribed
time limit. If such Government Servant shall fail to possess Computer Operation Certificate within the
prescribed time limit, then he/she shall not be entitled for annual increment till possessing the said
certificate. Further he/she shall not be entitled for promotion till possessing Computer Operation
Certificate.
Rule - 7. Declaration of Small Family.
It shall be mandatory for the person who is appointed by nomination to the post mentioned in rule 3,
to submit a Declaration of Small Family as provided by the Maharashtra Civil Services (Declaration of
Small Family) Rules, 2005 and the Rules made thereunder from time to time, at the time of

appointment to the concerned post. A person having more than 2 children on the date of submission of
Declaration of Small Family, shall be disqualified for the appointment in Government Service. Moreover,
the person shall be governed by Government Orders issued from time to time, in this behalf.
Rule - 8.
A person appointed to the post mentioned in rule 3, shall be liable for transfer in the office of the
Sheriff of Mumbai or its other office in Mumbai.
