Tender cost and tender security is waived off for those recognized by Department of
Industrial Policy and Promotion (DIPP) as ‘Startups’ shall be exempted from payment of
earnest money deposit detailed above. Labour Cooperative Societies shall deposit only 50% of
above earnest money deposit. The tenderer must submit documentary evidence for the same.
This tender shall be governed as per the Indian Railways General Condition of Contract for
Works- 2022 as amended/corrected upto latest Correction Slips and as well as other terms
and conditions of contract as mentioned in this tender.
This Tender shall be governed as per General condition of contract for Works-2022 as
amended/corrected upto latest correction slips and all conditions mentioned in General
condition of contract for works-2022 upto latest correction slips are applicable (Enclosed
with NIT). The clauses mentioned in standard Tender Document are to be read in conjunction
with GCC for Works-2022 and in case of any ambiguity other terms and conditions shall
prevail.
Tenderers are advised to carefully read all the clauses including its notes/special notes as
mentioned in tender document.

1. I/We __________ have read the various conditions to the tender attached hereto and agree to abide by
the said conditions. I/We also agree to keep this tender open for acceptance for a period of 60 days
from the date fixed for opening the same and in default thereof, I/We will be liable for forfeiture of
my/our “Earnest Money”. I/We offer to do the work for Ambala Division, Northern Railway, at the rates
quoted in the attached schedule and hereby bind myself/ourselves to complete the work in all respects
within 90 days from the date of issue of letter of acceptance of the tender.
2. I/We also hereby agree to abide by the Indian Railways Standard General Conditions of Contract for
Works 2022, with all correction slips up-to-date and to carry out the work according to the Special
Conditions of Contract and Specifications of materials and works as laid down by Railway in the
annexed Special Conditions/Specifications, Schedule of Rates with all correction slips up-to-date for
the present contract.
3. A sum of Rs 93,800/- is herewith forwarded as Earnest Money. Full value of the earnest Money shall
stand forfeited without prejudice to any other right or remedies in case my/our Tender is accepted and
if:
(a) I/We do not submit the Performance Guarantee within the time specified in the Tender
document;
(b) I/We do not execute the contract documents within seven days after receipt of notice issued by
the Railway that such documents are ready; and
(c) I/We do not commence the work within fifteen days after receipt of orders to that effect.

exempted from submission of Earnest Money.

1. Instructions to tenderer and Conditions of tender: The following documents form part of Tender/
Contract:

1.4. Standard General Conditions of Contract for Works 2022 and Standard Specifications for Materials and
Works of Indian Railway as amended/corrected upto latest Correction Slips, copies of which can be seen
in the office of [Link]/C&W/UMB or obtained from the office of the [Link]/C&W/UMB on payment of
prescribed charges.
1.5. Tenderers shall submit their offers made as per the Indian Railways GCC for Works- 2022 as
amended/corrected upto latest Correction Slips and as well as special terms and conditions of contract
as mentioned in this tender.
1.6. Schedule of Rates as amended/ corrected upto latest Correction Slips, copies of which can be seen in the
office of [Link]/C&W/UMB or obtained from the office of the [Link]/C&W/UMB on payment of
prescribed charges, as provided by Railway Board/NDLS HQ Baroda House.
1.7. All general and detailed drawings pertaining to this work which will be issued by the Manager or her
representatives (from time to time) with all changes and modifications.
2. Drawings for the Work: The drawings for the work can be seen in the office of the [Link]/C&W/UMB,
Northern Railway at any time during the office hours. The drawings are only for the guidance of
Bidder(s). Detailed working drawings (if required) based generally on the drawing mentioned above,
will be given by the Manager or her representative from time to time.
3. The Tenderer(s) shall quote her/ their rates as a percentage above or below the Schedule of Rates of
work except where she/they are required to quote item rates and must tender for all the items shown in
the Schedule of approximate quantities attached. The quantities shown in the attached Schedule are
given as a guide and are approximate only and are subject to variation according to the needs of the
Railway. The Railway does not guarantee work under each item of the Schedule. The tenderer(s) shall
quote rates / rebates only at specified place in Tender Form supplied by Railway. Any revision of rates /
rebates submitted (quoted) through a separate letter whether enclosed with the bid (Tender Form) or
submitted separately or mentioned elsewhere in the document other than specified place shall be
summarily ignored and will not be considered.
4. Tenders containing erasures and / or alterations of tender documents are liable to be rejected. Any
correction made by tender(s) in her/their entries must be attested by her/ them.
5. The works are required to be completed within a period of 90 days from the date of issue of acceptance
letter.
6. Earnest Money:
(a) The tender must be accompanied by a sum of ₹ 93,800/- as Earnest Money deposited in cash through e-
payment gateway or as mentioned in tender documents, failing which the tender shall l not be
considered. Any firm recognized by Department of Industrial Policy and Promotion (DIPP) as ‘Startups’
shall be exempted from payment of Earnest Money on submission of Registration Certificate issued by
appropriate authority.
(b) The Tenderer(s) shall keep the offer open for a minimum period of 60 days from the date of opening of
the Tender. It is understood that the tender documents have been issued to the Tenderer(s) and the
Tenderer(s), is / are permitted to tender in consideration of the stipulation on his / their part that after
submitting his / their tender subject to the period being extended further, if required by mutual
agreement from time to time, he will not resile from his offer or modify the terms and conditions thereof
in a manner not acceptable to the [Link]/C&W/UMB of Northern Railway, Should the tenderer fail to
observe or comply with the foregoing stipulation, the amount deposited as Earnest Money for the due
performance of the above stipulation, shall be forfeited to the Railway.
(c) If his tender is accepted the earnest money mentioned in sub clause (a) above will be retained as part
security for the due and faithful fulfillment of the contract in terms of Clause 16 of the Standard General
Conditions of Contract. The Earnest Money of other Tenderers shall, save as herein before provided, be
returned to them, but the Railway shall not be responsible for any loss or depreciation to the Earnest
Money that may happen thereto while in their possession, nor be liable to pay interest thereon.
(d) In case Contractor submits the Term Deposit Receipt/Bank Guarantee Bond towards full Security
Deposit, the Railway shall return the Earnest Money so retained to the Contractor.

Note: The tenderer shall submit the bank Account details for refund/payment through NEFT/RTGS as
per Appendix-III.
7. Rights of the Railway to Deal with Tender: The authority for the acceptance of the tender will rest
with the Railway. It shall not be obligatory on the said authority to accept the lowest tender or any other
tender and no bidder(s) shall demand any explanation for the cause of rejection of her /their tender or
the Railway to assign reasons for declining to consider or reject any particular tender or tenders.
8. If the bidder(s) deliberately gives / give wrong information in her / their tender or creates / create
circumstances for the acceptance of her / their tender, the Railway reserves the right to reject such
tender at any stage.
9. If the bidder(s) expire(s) after the submission of her / their tender or after the acceptance of her / their
tender, the Railway shall deem such tender cancelled. If a partner of a firm expires after the submission
of their tender or after the acceptance of their tender, the Railway shall deem such tender as cancelled,
unless the firm retains its character.
10. Bidder's Credentials: Bidder shall submit the documents as demanded under Bid Evaluation criteria
along with the bid.
11. For e-bidding: Relevant guidelines should be followed:
11.1. All Tenderers are hereby cautioned that tenders containing any material deviation or reservations as
described in tender condition and/or minor deviation without quoting the cost of withdrawal shall be
considered as non-responsive and is liable to be rejected.
11.2. The intending tenderers must be registered on e-tendering portal https:// [Link]. Those who
are not registered on the e-tendering portal shall be required to get registered beforehand. After
registration, the tenderer will get user id and password. On login, tenderer can participate in tendering
process and can witness various activities of the process.
11.3. The authorized signatory of intending tenderer, as per Power of Attorney (POA), must have valid
class-II or class-III digital signature. The tender document can only be downloaded from e-
tendering portal using class-II or class-III digital signature. However, the tenderer shall upload
their tender on https:// [Link] using class-II or class-III digital signature of the
authorized signatory only.
11.4. Tender submissions shall be done online on https:// [Link] payment of Earnest Money
Deposit (EMD) and Tender document cost, in respect of e-tendering, should be accepted through Net
Banking or Payment Gateway only, if applicable.
11.5. Submission of Tenders shall be closed on e-tendering website of RAILWAY ADMINISTRATION at the
date & time of submission prescribed in NIT after which no tender shall be accepted. It shall be the
responsibility of the bidder / tenderer to ensure that his tender is uploaded online on e-tendering
website https:// [Link] before the deadline of submission. Railway administration will not be
responsible for non-receipt of tender documents due to any delay and/or loss etc.
11.6. RAILWAY ADMINISTRATION ([Link]/C&W/UMB) reserves the right to accept or reject any or all
proposals without assigning any reasons. No tenderer shall have any cause of action or claim against the
RAILWAY ADMINISTRATION for rejection of his proposal.
11.7. Tenderers are advised to keep in touch with e-tendering portal https:// [Link] for updates.
The bidders are required to submit soft copies of their bids electronically on the IREPS Portal, using
valid Digital Signature Certificates. The instructions given below are meant to assist the bidders in
registering on the IREPS Portal, prepare their bids in accordance with the requirements and submitting
their bids online on the IREPS Portal.

13. Execution of Contract Documents: The successful bidder(s) shall be required to execute an agreement
with the President of India acting through the Northern Railway for carrying out the work according to
Standard General Conditions of Contract, Special Conditions / Specifications annexed to the tender and
Specification for work and materials of Railway as amended/corrected up to latest Correction Slips,
mentioned in tender form (First Sheet).
14. In terms of clause 14 & 15 in ANNEXURE-I of General Conditions of Contract for Works,2022 the bidder
shall submit the constitution of its Firm i.e. Partnership Firm / Company / Joint Venture (JV) /Registered
Society / Registered Trust / HUF etc. along with Documents with tender, failing which tender is liable
to be rejected.
15. Employment/Partnership etc. of Retired Railway Employees: Refer clause 16 of ANNEXURE-I in General
Conditions of Contract for Works, 2022. Undertaking to be submitted by the bidder is enclosed as
Appendix-II. Non submission of a copy of certificate by the bidder shall result in summarily
rejection of his/their bid
16. A copy of certificate stating that they are not liable to be disqualified and all their
statements/documents submitted along with bid are true and factual. Standard format of the certificate
to be submitted by the bidder is enclosed as Appendix- I and 1A. Non submission of a copy of
certificate by the bidder shall result in summarily rejection of his/their bid. It shall be mandatorily
incumbent upon the tenderer to identify, state and submit the supporting documents duly self-attested
by which they/he are/is qualifying the Qualifying Criteria mentioned in the Tender Document.

5. Income Tax/TDS and other statutory deductions as applicable will be deducted from every monthly bill by
Railways.
6. Bidders are requested to read the tender document carefully and are strongly advised to inspect the site
before quoting the tender.
7. The rates quoted in the schedule are inclusive of all types of duties, Taxes and levies applicable to this
contract INCLDUING GST, however GST will be paid as per applicability/ percentage decided by GST
governing council for Service Tender prevailing during the currency of contract as under
a. GST TDS @ 2% (CGST 1% and SGCT/UTGST 1%) towards total/gross value of monthly bill will be deducted
by Railways. (Ref: Railway Board letter no. 2018/AC-II/1/46 Dated 29.09.2018) for releasing the GST on
goods/service levied.
b. Any increase/decrease in GST percentage from present rate will be compensated/recovered by Railways.

PART-III
SCOPE OF WORK

1. Scope of work shall consist of providing all labour, equipment and appliances necessary required
for the work. All tools and plants required to execute the work shall be arranged by the contractor.
2. Any welding/cutting required to execute the work shall be done by the contractor only after the
approval of SSE/C&W.
3. The Tank shall be designed for a life of 20 years with regular maintenance and all the structural
members of the machine. Tenderer would submit suitable undertaking.
4. The warranty period would be for 1 year from the date of successful commissioning.
5. Contractor has to ensure that there is no leakage after fitment. Hydraulic test must be carried out
during testing. Rigidity of the storage tank shall be demonstrated to the satisfaction of appointed
inspector or inspecting agency.
6. One copy of the printed illustrative catalogue showing features/ Lay out drawings/wiring/piping of
the Storage tank must be provided. General Arrangement Drawings will be sent by the ‘Supplier’ to
the consignee. The ‘Supplier’ should ensure that drawings sent to consignee are complete in all
respects as specified in technical specification. In case Consignee finds some deficiencies in the
Drawings and returns the same for rectification to the ‘Supplier’, the Supplier must return the
rectified drawings within 5 days from the date of issue of letter by Consignee. This period will not be
counted towards LD calculation.
7. In case of delay on part of consignee in providing the clear site for installation of tank, the supplier
will report the matter to [Link]/C&W/UMB and consignee. In case of delay in readiness of site on
part of consignee, [Link]/C&W/UMB shall take up the matter with concerned department and
advise supplier accordingly.
8. Responsibilities of Railways
i. Provision of a clear site / foundation to ensure installation of storage tank and its accessories at site.
ii. Electricity and water for installation and commissioning of machine shall be provided free of cost.
iii. Wherever a road mobile crane has to be arranged by the supplier for material handling, a clear
approach for it up to the site will be provided.
iv. Clear covered space for storage of material/equipment required for the work.
9. Responsibilities of contractor
i. Advise consignee in time regarding schedule for requirement of clear site for installation of Storage
Tank.
ii. Provision of all tools and equipment, technical and unskilled manpower, material handling
accessories/ equipment and material for installation and commissioning.
iii. The bidder should ensure the proper Earthing of peripherals/accessories.
iv. The site for installation of Tank must be seen and studied in detail before submission of offer.
v. The drawing for the Tank with accessories shall be provided by the supplier to the consignee for
approval.
vi. It shall be the sole responsibility of the supplier to observe all safety precautions to ensure that no
untoward incident occurs and that safety rules and procedures are followed without fail.
vii. Consignee will provide only 415 V+10%-20%, 3 phase 50 Hz+3% AC supply at a single point (mains).
All types of cables, connections, circuit breakers etc. required for connecting power supply point to
different parts of the machine/control cabinets, shall be the responsibility of the bidder.
viii. Electrical work like laying of power/electrical cables & earthing wires from Pumps to machine
control panel (upto 20 meters) as well as within the machine, with supply of all materials shall also
be carried out by the supplier.

PART-IV
SPECIAL CONDITIONS OF CONTRACT AND INSTRUCTION TO TENDERERS

1. The contract shall be governed by Indian Railway Standard General Conditions of Contract (GCC
for works), April, 2022 corrected up to date in conjunction with special conditions of contract
and scope of work mentioned hereunder. GCC, April-2022 can be downloaded from internet for
reference; however copy of the same can also be received from office of tender inviting authority
on payment of requisite fee.
2. The estimated cost work is all inclusive rates i.e. all taxes, GST and levies pertaining to the work.
3. No advance payment will be made. Payment on completion of work shall be released to the
contractor on Satisfactory completion of work .
4. Security deposit @ 5% of accepted contract value will be deducted from bill of the successful
tenderer, and security deposit will refunded after expiry of the warranty period and no claim
certificate from SSE/C&W/CDG is issued
5. The Period of contract shall of 03 months from the date of issue of Letter of Acceptance (LOA)
or from the date of handing over the site to contractor, whichever is later.
6. Tenderer can visit site at Chandigarh to seek any clarification from CDO/CDG/GAZ on any working
day during office hours. The bidder shall associate with the C&W Depot Chandigarh in
preparation of the site drawing. The former shall also prepare, based on inputs given by the
consignee, the complete schematic and wiring diagram/piping layout of the Storage Tank. For
this purpose, C&W depot Chandigarh may be visited in consultation with Sr. DME/C&W/UMB,
before submission of final bid. Before quoting for the work, it will be imperative for the
tenderer(s) to fully acquaint himself/themselves with all the local conditions, nature of work
and all other matters pertaining thereto and factors which would have any effect on the
performance of the contract and the cost of item of works. Tenderer(s) is / are advised to visit
the site personally to ascertain the quantum of work. The “Railway” shall not entertain request
for clarification from the tenderer(s) regarding such local conditions. No request for change of
price or time schedule of completion of work shall be entertained after the “Railways” accepts
the offer
7. In addition, any latest instructions regarding the work suggested by Railway Board/RDSO during
execution of work after the tender is awarded shall also have to be implemented by the
contractor without any extra cost on this account.
8. Inspection of material and workmanship will be done by Engineer or Engineer’s representative
and his decision to this effect shall be final binding on the contractor.
9. The contractor shall ensure that the garbage, litter and filth collected after the maintenance are
dumped only at pre-designated place as decided by Railway.
10. No Price Variation shall be applicable in this contract work. The rates shall remain firm during
entire currency of the contract.
11. Contractor will be responsible for salary and all other statutory benefits e.g. EPF and ESIC to his
staff engaged for the work as per extant rule.
12. The contractor should take utmost care to ensure that no damage to the Railway property is
done during execution of work and should indemnify Railway for such damages to Railway
property while in their custody.
13. Any Type of damages to Railway property during the work will be borne by contractor.
14. The work shall be carried out without affecting the Railway working and in consultation with
Engineer ([Link] or CDO/CDG/GAZ) or his authorized representative.
15. The contractor should issue identity badges with photographs to all his deployed staff engaged
to carry out the work. These identity badges should be so carried that they can be identified by
Railway Security, Carriage & Wagon staff and supervisors. The identity badge should be worn by
contractor labour on left on the chest at the place of work or during their presence in Railway
premises.

16. All direct or indirect costs and obligations pertaining to employment of specialized manpower,
material and equipment shall be borne by contractor.
17. The contractor shall indemnify the Railway against any or all claims, which may arise under
Workman’s compensation Act or any other act or statute having bearing over the services and
for engagement of workmen, directly or indirectly for performance of work under the contract.
18. The contractor shall indemnify the Railway and its employees against any penalties as
PRINCIPAL EMPLOYER, for any failure of the contractor to honor various Central/State
Government laws/enactments.
19. Authority for acceptance or otherwise of the tender will rest with the Railway administration
which does not bind itself to accept any tender and to assign any reason for rejecting the same.
20. Railway reserves the right to increase or decrease the quantity of work during the currency of
the contract. Similarly the execution of the work can be terminated at any point of time at the
sole discretion of Railway Administration.
21. The contractor will have to manage all resources required to complete the work in all respects at
his own cost to the satisfaction of Railway Administration. No extra claim what so ever will be
entertained by the Railways for any such items which are implicitly or explicitly not included in
the scope of work.
22. The quantities shown in attached schedules are given as guidance and are approximate only and
are subject to variation according to the needs of the Railway. Railway at its discretion may
increase or decrease or delete any items mentioned in the schedule of rates & quantities and no
extra compensation will be paid to the contractor on this account.
23. Inspection of work shall be carried out by concerned SSE(C&W)CDG or CDO/CDG/GAZ. If any
deficiency is pointed out during inspection the same shall be rectified by the contractor at his
own cost.
24. Cost of travel, lodging & Boarding of the contractual men will be borne by the contractor and no
extra payment or arrangement in this regard is to be made by the Railway
25. The contractor shall note that no compensation due to any loss of life or loss of material or any
other account shall be given by the Railway Administration and contractor shall have to pay all
Compensation in case of any accident, injury to the labour.
26. Contractor’s staff shall follow all safety precautions while working in depot. The contractor shall
provide all accessories like safety/protective gear to his staff as at his own cost. In case of any
mishap with the contract labour while working in Railway premises, the contractor will be
responsible for the same and Railway shall stand indemnified in this regard.
27. Railways reserve the right to impose penalty/penalties for non-compliance of the work as
specified or for any undesirable activities, endangering the image of railways. In this regard
decision of Railway will be final.
28. If any compensation/penalty is to be paid by the Railway in compliance of the order/ judgment
passed by the court, consumer forum or any other law-enforcing agency on default of the
contractor or his person/servant/employee to the complainant, the said amount shall be liable
to be paid by the contractor.
29. The contractor alone shall be responsible for payment of wages and all statutory contribution
towards social security benefits to contractual staff engaged by him for this work.

PENALTYCLAUSE

1. The Railways reserve the right to deduct the penalties for non-compliance of terms &
conditions as stipulated in the tender on the part of the contractor as under:
2. Any delay in the modification work in coaches on the part of contractor will be penalized.
3. [Link]/C&W and DME/C&W/UMB are authorized to penalize the contractor upto Rs 1000 per case
based on the level of non-compliance observed in the contract's execution
4. Decision of [Link]/C&W/UMB as to the amount of penalty that will be levied will be the final and
binding on the contractor for any type of violation of contract condition.
5. Inspecting Officers can impose penalty for unsatisfactory work by the contractor as given below

PAYMENT TERMS

1. The standard payment terms subject to penalty or/and recoveries of any amount under the
penalty clause of contract will be as under:
2. On Account monthly payment shall be released after successful completion of work based on the
quantity actually executed in all respect to the satisfaction of Railway.
3. All the work will be carried out under supervision of SSE(C&W)/In-charges of concerned depot or his
representative. Any other work related to it, not covered in the drawing, shall also be attended as
decided by CDO/CDG/GAZ
4. Final inspection will be done by CDO/CDG/GAZ or SSE(C&W)/In-charges of concerned depots.
5. Nominated SSE/C&W will work as incharge supervisor at CDG depot.
6. The MB shall be filled through online mode as available on webportal: IRWCMS by SSE(C&W)/In-
charges of concerned depots.
7. The Income tax will be deducted at source as per applicable rules.
8. Payment as above shall be subject to any deductions of any amount for which the contractor is
liable under the contract against this tender including penalty as specified in work evaluation
and as per penalty clause.

paying authority.
