COPC No. 328/2026 in CWP No.16456/2025 Asha Kumari TOT CWM) & Ors V/s State of H.P.
(Regarding on analogy of lnder Singh Thakur)

That the petitioners have filed the present Civil Writ Petition thereby seeking the relief to the extent that
a writ of mandamus or any other direction may kindly be issued to the respondents to grant to the benefit of higher stage
of pay of Rs. 41600/-from the date petitioner has completed two years of regular services in terms of the judgment
passed by the Hon'ble High Court in CWP NO. 4830/2023 titled as lnder Singh Thakur & Ors. V/s State of H.P. and
further respondents directed that the petitioner be re-fixed from the date petitioner have completed two years of their
respective regular services and to release all consequential benefit.

The said case was listed before the Hon'ble High Court on different dated 17.10.2025 when the Hon'ble
High Court has directed that the instant writ petition(s) are disposed of by directing the respondents/competent authority
to consider and decide the aforesaid representation(s) of the petitioner(s), on main case in accordance with law, within a
period of six weeks from today. The order so passed be also communicated to the petitioner(s). Pending miscellaneous
application(s), if any, shall also stand disposed of.

Thereafter, the petitioners have filed Ex. Pet./COPC in above said CWP vide which it was directed to
file reply/compliance within two weeks.

Whereas, Sh. Inder Singh was appointed as POT IP on contract basis in the year, 2014 and their service
were regularized in the year, 2017 and have completed two years of regular services in the year, 2019. The petitioner has
filed CWP 4830/2023 titled as lnder Singh Thakur & ors. in the Hon'ble High Court to extend the benefits of Finance
Department notification No. Fin-(PR)B(7)-I/202l-loose dated 06.09.2022 by re-fixing the pay of the petitioner on
completion of two years of regular services of the petitioner.

The judgment of CWP No. 4830/2023 titled as Inder Singh Thakur as that ``view of above discussion,
notification dated 03.01.2022 promulgating the H.P. Civil Services (Revised Pay) Rules, 2022 and notification dated
06.09.2022 amending the Revised Pay Rules, 2022, are held applicable to the petitioners. This writ petition is allowed.
Respondents are directed to extend the benefit of notifications dated 03.01.2022 and 06.09.2022 to the petitioners. Their
pay be accordingly re-fixed from due dates and consequential benefits be granted in favour of the petitioners in
accordance with law and aforesaid notifications. This exercise be carried out within four weeks from today. The writ
petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any"

And whereas, as per order of the Hon'ble High Court dated 16.12.2025 passed in CWP 4830/2023 titled
as lnder Singh Thakur V/s State of H.P. and others, and Govt. letter dated 17.12.2025 the benefit of higher pay scale has
been granted to the petitioner vide office order No. EDN-(SE)-H(5)(B)7-2/2025(Court Case) dated 18.12.2025, subject to
final outcome of LPA filed by the Department.

And whereas, the petitioner in above said CWP were appointed as TGT's on contract basis in the year,
2012,2014 and regularized in the year, 2017,2018, and have completed two years of regular service in the year,
 20i9.2020. These petitioner have claimed the benefit of higher pay scale as per Finance Department notification No.
Fill-(PR)B(7)-I/2021-loosedated06.09.2022byre-fixingthepayofthepetitioner.

And whereas Finance Department has notified Pay Revision Rules Notification dated 03.01.2022 vide
which these petitioner were given level 10 and first cell initial of TGT was Rs. 38100/-later on Rule 7(A) was inserted
by Finance Department Notification dated 06.09.2022 vide which TGT after two years of regular services were allowed
41600/-but this was admissible tl such TGT who have not completed two years services as on 03.01.2022. These
petitioners have claimed 41600/-after completion of two years services, however, benefit in unrevised scale also
allowed grade pay from 3600 to 5000/-in the different year.

In compliance to the Hon'ble High Court order and as per Govt. letter dated 30.12.2025, the petitioner (
who are initially appointed as TOT on contract basis) in above said COPC / CWP are allowed higher pay scale of
41600/-after the two years of regular services subject to final outcome of LPA filed in CWP No. 4830/2023 titled as
lnder Singh and any other Legal remedies. The DDO concerned is hereby directed to fix the pay of the petitioner and
release the arrear as per Finance Department instruction from time to time with the condition that in case the outcome
LPA in favour of the Department, the petitioner are bound to refund the amount of arrear so paid to them. However, an
undertaking to this effect may be obtained from the petitioner that the overpayment if any, found, in later stage shall be
recovered from them accordingly. If the said benefit has already been released in favour of any of the petitioners in above
said Ex. Petition/CWP, then it may be ensured that double benefit may not be released in favour of any of them. The
entry be also made in the service book of individual concerned. May inform the parties accordingly.
