Ooredoo :Ooredoo
- Customer (You): The person or party that concludes an agreement with Ooredoo in order to benefit from a service and pays a sum in return of the aforesaid service. .‫ ﻟﻠﺤﺼﻮﻝ ﻋﻠﻰ ﺍﻟﺨﺪﻣﺔ ﻭﺍﻟﺪﻓﻊ ﻣﻘﺎﺑﻠﻬﺎ‬Ooredoo ‫ ﺍﻟﺸﺨﺺ ﺃﻭ ﺍﻟﺠﻬﺔ ﺍﻟﺬﻱ ﻳﺪﺧﻞ ﻓﻲ ﺍﺗﻔﺎﻗﻴﺔ ﻣﻊ‬:(‫ﺍﻟﻌﻤﻴﻞ )ﺃﻧﺖ‬-
-SIM Card: It is the main communication component part provided by Ooredoo or one of its authorized distributors allowing the Customer to benefit from the service of .Ooredoo ‫ ﻭﺍﻟﺘﻲ ﻣﻦ ﺧﻼﻟﻬﺎ ﻳﺘﻤﺘﻊ ﺍﻟﻌﻤﻴﻞ ﺑﺎﻟﺨﺪﻣﺔ ﺍﻟﻤﻘﺪﻣﺔ ﻣﻦ‬،‫ ﺃﻭ ﻣﻦ ﺃﺣﺪ ﻣﻮﺯﻋﻴﻬﺎ ﺍﻟﻤﺨﻮﻟﻴﻦ‬Ooredoo ‫ ﻫﻲ ﺍﻟﻤﻜﻮﻥ ﺍﻟﺮﺋﻴﺴﻲ ﻟﻼﺗﺼﺎﻝ ﻭﺗﺼﺪﺭ ﻣﻦ‬:SIM ‫ﺍﻟﺸﺮﻳﺤﺔ‬-

-Contract: It is the paper or electronic form signed by the Customer in order to ask for or activate or use the service of Ooredoo. The Contract includes all documents signed ‫ ﻭﻳﺸﻤﻞ ﺍﻟﻌﻘﺪ ﺟﻤﻴﻊ ﺍﻟﻤﺴﺘﻨﺪﺍﺕ ﺍﻟﻤﻮﻗﻌﺔ ﻣﻦ ﺍﻟﻌﻤﻴﻞ ﺃﻭ ﺍﻟﻄﻠﺒﺎﺕ ﺍﻟﺨﻄﻴﺔ ﺃﻭ‬،‫ ﻫﻮ ﺍﻟﻨﻤﻮﺫﺝ ﺍﻟﻮﺭﻗﻲ ﺃﻭ ﺍﻹﻟﻜﺘﺮﻭﻧﻲ ﺍﻟﺬﻱ ﻳﻘﻮﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺎﻟﺘﻮﻗﻴﻊ ﻋﻠﻴﻪ ﻟﻄﻠﺐ ﺃﻭ ﺗﻔﻌﻴﻞ ﺃﻭ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻟﺨﺪﻣﺔ‬:‫ﺍﻟﻌﻘﺪ‬-
by the Customer or written applications or approvals made through the electronic devices (phone call or SMS or website) or other registered communication mean. .‫ﺍﻟﻤﻮﺍﻓﻘﺎﺕ ﻣﻦ ﺧﻼﻝ ﺍﻷﺟﻬﺰﺓ ﺍﻹﻟﻜﺘﺮﻭﻧﻴﺔ )ﺍﻻﺗﺼﺎﻝ ﺃﻭ ﺧﺪﻣﺔ ﺍﻟﺮﺳﺎﺋﻞ ﺍﻟﻘﺼﻴﺮﺓ ﺃﻭ ﺍﻟﻤﻮﻗﻊ ﺍﻹﻟﻜﺘﺮﻭﻧﻲ( ﺃﻭ ﻏﻴﺮﻫﺎ ﻣﻦ ﻭﺳﺎﺋﻞ ﺍﻻﺗﺼﺎﻝ ﺍﻟﻤﺴﺠﻠﺔ‬
-Service: It is any service (services) – including but not limited to – (phone calls, local and international messages, voice messages and data) provided by Ooredoo directly to Ooredoo ‫ ﻟﻠﻌﻤﻼﺀ ﻣﺒﺎﺷﺮﺓ ﻣﻦ ﺧﻼﻝ ﻓﺮﻭﻉ‬Ooredoo ‫ ﻭﺍﻟﺼﻮﺗﻴﺔ ﻭﺍﻟﺒﻴﺎﻧﺎﺕ( ﺗﻘﺪﻣﻬﺎ‬،‫ ﺃﻱ ﺧﺪﻣﺔ )ﺧﺪﻣﺎﺕ( – ﻋﻠﻰ ﺳﺒﻴﻞ ﺍﻟﻤﺜﺎﻝ ﻻ ﺍﻟﺤﺼﺮ – )ﺍﻟﻤﻜﺎﻟﻤﺎﺕ ﻭﺍﻟﺮﺳﺎﺋﻞ ﺍﻟﻤﺤﻠﻴﺔ ﻭﺍﻟﺪﻭﻟﻴﺔ‬:‫ﺍﻟﺨﺪﻣﺔ‬-
its Customers through Ooredoo branches or one of its authorized distributors. .‫ﺃﻭ ﺃﺣﺪ ﻣﻮﺯﻋﻴﻬﺎ ﺍﻟﻤﺨﻮﻟﻴﻦ‬
-Fees: It is the prices list set by Ooredoo including the special conditions and provisions of the service. .‫ ﻭﺍﻟﻤﺘﻀﻤﻨﺔ ﻟﻠﺸﺮﻭﻁ ﻭﺍﻷﺣﻜﺎﻡ ﺍﻟﺨﺎﺻﺔ ﺑﺎﻟﺨﺪﻣﺔ ﺍﻟﻤﺮﻓﻘﺔ‬Ooredoo ‫ ﻭﻫﻲ ﻗﺎﺋﻤﺔ ﺍﻷﺳﻌﺎﺭ ﺍﻟﺘﻲ ﺗﺤﺪﺩﻫﺎ‬:‫ﺍﻟﺮﺳﻮﻡ‬-
The aforementioned definitions shall constitute an integral part of the present contract. The following articles shall form the provisions of the contract concluded with the ‫ ﺑﺎﻹﺿﺎﻓﺔ ﺇﻟﻰ ﺃﻱ ﺑﺮﻧﺎﻣﺞ‬Ooredoo ‫ ﻭﺗﻤﺜﻞ ﺍﻟﻤﻮﺍﺩ ﺍﻵﺗﻴﺔ ﺃﺣﻜﺎﻡ ﺍﻟﻌﻘﺪ ﺍﻟﻤﺒﺮﻡ ﻣﻊ ﺍﻟﻌﻤﻴﻞ ﻓﻴﻤﺎ ﻳﺘﻌﻠﻖ ﺑﺎﻟﺨﺪﻣﺔ ﺍﻟﺘﻲ ﺗﻘﺪﻣﻬﺎ‬،‫ﺗﻌﺘﺒﺮ ﺍﻟﺘﻌﺮﻳﻔﺎﺕ ﺍﻟﺴﺎﺑﻘﺔ ﺟﺰﺀﺍ ﻻ ﻳﺘﺠﺰﺃ ﻣﻦ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﻣﻜﻤﻠﺔ ﻟﻪ‬

Ooredoo is a mobile telecommunications provider in the State of Kuwait. Any person, company, ministry and institution may benefit from this service in addition to any other ‫ ﺃﻭ ﻣﺆﺳﺴﺔ ﺃﻭ ﺃﻱ ﻛﻴﺎﻥ ﺁﺧﺮ ﻣﺴﺠﻞ ﺑﺸﻜﻞ ﻗﺎﻧﻮﻧﻲ ﻓﻲ‬،‫ ﺃﻭ ﻭﺯﺍﺭﺓ‬،‫ ﺃﻭ ﺷﺮﻛﺔ‬،‫ ﻭﺇﻥ ﺍﺳﺘﺨﺪﺍﻡ ﻫﺬﻩ ﺍﻟﺨﺪﻣﺔ ﻣﺘﺎﺡ ﺃﻣﺎﻡ ﺃﻱ ﺷﺨﺺ‬.‫ ﺧﺪﻣﺎﺕ ﺍﻻﺗﺼﺎﻻﺕ ﺍﻟﻤﺘﻨﻘﻠﺔ ﻓﻲ ﺩﻭﻟﺔ ﺍﻟﻜﻮﻳﺖ‬Ooredoo ‫ﺗﻘﺪﻡ‬
entity legally registered in the territory in return of settling the payments agreed upon in the contract. ‫ ﻣﺴﺆﻭﻟﺔ ﻋﻦ ﺃﻳﺔ ﻣﺸﻜﻠﺔ ﺃﻭ ﺗﺄﺧﻴﺮ ﺃﻭ ﺗﻮﻗﻒ ﺃﻭ‬Ooredoo ‫ ﻛﻤﺎ ﻻ ﺗﻌﺘﺒﺮ‬.‫ ﻻ ﺗﻀﻤﻦ ﺗﻘﺪﻳﻢ ﺍﻟﺨﺪﻣﺔ ﻓﻲ ﻛﺎﻓﺔ ﺃﻧﺤﺎﺀ ﺩﻭﻟﺔ ﺍﻟﻜﻮﻳﺖ‬Ooredoo ‫ ﻭ‬.‫ﺍﻹﻗﻠﻴﻢ ﻣﻘﺎﺑﻞ ﺗﺴﺪﻳﺪ ﺍﻟﺪﻓﻌﺎﺕ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻬﺎ ﺗﻌﺎﻗﺪﻳﺎ‬
However, Ooredoo does not provide its services everywhere in the State of Kuwait. As well as, Ooredoo shall not be held liable for any problem, delay, failure or interruption
Ooredoo ‫ ﻛﻤﺎ ﻻ ﺗﻜﻮﻥ‬،‫ ﺑﺄﻳﺔ ﺗﻌﻮﻳﻀﺎﺕ ﻋﻦ ﺃﻳﺔ ﺧﺴﺎﺭﺓ ﻗﺪ ﻳﺘﺤﻤﻠﻬﺎ ﺍﻟﻌﻤﻴﻞ ﻧﺘﻴﺠﺔ ﻟﺬﻟﻚ‬Ooredoo ‫ﺍﻧﻘﻄﺎﻉ ﻗﺪ ﻳﺤﺼﻞ ﻟﻠﺸﺒﻜﺔ ﻓﻲ ﺃﻱ ﻭﻗﺖ ﻭﺃﻳﺎ ﻛﺎﻥ ﻧﻮﻉ ﺍﻟﺨﺪﻣﺔ ﺍﻟﺘﻲ ﺍﺳﺘﺨﺪﻣﺖ ﻭﻻ ﺗﻠﺘﺰﻡ‬
occurring in the network at any time whatsoever regardless of the type of the service. Ooredoo shall not be obliged to pay any indemnification for any loss supported by the
Customer as a result thereof. As well as, Ooredoo shall not be held liable for any error or failure of any part of the Customer's device .‫ﻣﺴﺆﻭﻟﺔ ﻋﻦ ﺃﻱ ﺧﻄﺄ ﺃﻭ ﻋﻄﻞ ﻓﻲ ﻣﻜﻮﻧﺎﺕ ﺃﺟﻬﺰﺓ ﺍﻟﻌﻤﻴﻞ‬

Ooredoo shall be entitled to impose the following fees: :‫ ﺃﻥ ﺗﻔﺮﺽ ﺍﻟﺮﺳﻮﻡ ﺍﻵﺗﻴﺔ‬Ooredoo ‫ﻳﺤﻖ ﻟــ‬
•Operation fees are the fees imposed to obtain the SIM Card as well as PIN and PUK codes. .PUK & PIN ‫ ﻭﻫﻲ ﺍﻟﺮﺳﻮﻡ ﺍﻟﻤﻔﺮﻭﺿﺔ ﻟﻠﺤﺼﻮﻝ ﻋﻠﻰ ﺍﻟﺸﺮﻳﺤﺔ ﻭﻋﻠﻰ ﺭﻣﺰ‬:‫• ﺭﺳﻮﻡ ﺍﻟﺘﺸﻐﻴﻞ‬
•Subscription fees are the fees paid on a regular basis in advance as defined by Ooredoo. .Ooredoo ‫ ﺗﺪﻓﻊ ﺩﻭﺭﻳﺎ ﻭﻣﻘﺪﻣﺎ ﻛﻤﺎ ﻫﻮ ﻣﻌﺮﻑ ﻣﻦ ﻗﺒﻞ‬:‫• ﺭﺳﻮﻡ ﺍﻻﺷﺘﺮﺍﻙ‬
•The fees of the service used by the Customer – including but not limited to (local, international, voice and data services) – in return of a cost unit specified in accordance with .Ooredoo‫ ﺍﻟﺼﻮﺗﻴﺔ ﻭﺍﻟﺒﻴﺎﻧﺎﺕ( ﻣﻘﺎﺑﻞ ﻭﺣﺪﺓ ﺗﻜﻠﻔﺔ ﻣﺤﺪﺩﺓ ﻃﺒﻘﺎ ﻟﻨﻈﺎﻡ ﺍﻟﺘﻌﺮﻓﺔ ﺍﻟﺨﺎﺹ ﺑـ‬،‫•ﺭﺳﻮﻡ ﺍﻟﺨﺪﻣﺔ ﺍﻟﺘﻲ ﺍﺳﺘﺨﺪﻣﻬﺎ ﺃﻭ ﺗﻠﻘﺎﻫﺎ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﺳﺒﻴﻞ ﺍﻟﻤﺜﺎﻝ )ﺍﻟﻤﺤﻠﻴﺔ ﻭﺍﻟﺪﻭﻟﻴﺔ‬
the tariff system of Ooredoo. .‫ ﺗﺸﻤﻞ ﺍﻟﺨﺪﻣﺔ ﺍﻟﺘﻲ ﺍﺳﺘﺨﺪﻣﻬﺎ ﺃﻭ ﺗﻠﻘﺎﻫﺎ ﺍﻟﻌﻤﻴﻞ ﺧﺎﺭﺝ ﺩﻭﻟﺔ ﺍﻟﻜﻮﻳﺖ ﻭﺍﻟﺘﻲ ﺗﺘﺤﺪﺩ ﺃﺳﻌﺎﺭﻫﺎ ﻭﺑﻴﺎﻧﺎﺗﻬﺎ ﻣﻦ ﻗﺒﻞ ﺍﻟﺸﺒﻜﺎﺕ ﺍﻷﺟﻨﺒﻴﺔ‬:‫• ﺭﺳﻮﻡ ﺍﻟﺘﺠﻮﺍﻝ‬
•Roaming fees refer to the service used by the Customer outside the State of Kuwait. However, the fees of the roaming service are determined by foreign networks.
.‫ ﺃﻭ ﺇﻟﻐﺎﺀ ﺍﻟﺨﺪﻣﺔ ﺃﻭ ﺇﺟﺮﺍﺀ ﺍﻟﺘﻌﺪﻳﻼﺕ ﻋﻠﻰ ﺑﻴﺎﻧﺎﺕ ﺍﻟﻌﻘﺪ‬،‫ ﻫﻲ ﺍﻟﺮﺳﻮﻡ ﺍﻟﻤﻔﺮﻭﺿﺔ ﻧﺘﻴﺠﺔ ﺗﺄﺧﺮ ﺍﻟﺴﺪﺍﺩ‬:‫•ﺍﻟﺮﺳﻮﻡ ﺍﻹﺩﺍﺭﻳﺔ‬
•Administrative fees are the fees imposed in case of a settlement delay, service cancellation or amendments made to the data of the contract.
‫ ﻭﻻ ﻳﻜﻮﻥ‬.‫ ﺇﻥ ﺃﻱ ﺗﻌﺪﻳﻞ ﺃﻭ ﺗﻐﻴﻴﺮﻓﻲ ﺍﻟﺮﺳﻮﻡ ﻳﻌﺘﺒﺮ ﻣﻠﺰﻣﺎ ﻭﻧﺎﻓﺬﺍ ﺑﻤﻮﺍﺟﻬﺔ ﺍﻟﻌﻤﻴﻞ ﺑﻤﺠﺮﺩ ﺍﻟﻨﺸﺮ ﺃﻭ ﺍﻹﺧﻄﺎﺭ ﺑﻪ ﻋﺒﺮ ﻭﺳﺎﺋﻞ ﺍﻹﻋﻼﻡ ﺍﻟﻤﺨﺘﻠﻔﺔ ﺃﻭ ﻓﻲ ﻣﻮﺍﻗﻊ ﺍﻟﺸﺮﻛﺔ ﻋﻠﻰ ﺷﺒﻜﺔ ﺍﻹﻧﺘﺮﻧﺖ‬:‫ﻣﻼﺣﻈﺔ‬

.‫ ﻛﻤﺎ ﻻ ﻳﺸﻜﻞ ﺃﻱ ﺗﻌﺪﻳﻞ ﻓﻲ ﺍﻟﺮﺳﻮﻡ ﺑﺄﻳﺔ ﻃﺮﻳﻘﺔ ﺳﺒﺒﺎ ﻣﺒﺮﺭﺍ ﻟﻺﻧﻬﺎﺀ ﺍﻟﻤﺒﻜﺮ ﻟﻠﻌﻘﺪ‬.‫ﻟﻠﻌﻤﻴﻞ ﺍﻟﺤﻖ ﺑﺎﻻﻋﺘﺮﺍﺽ ﺑﺴﺒﺐ ﻧﻘﺺ ﺍﻻﻃﻼﻉ ﻋﻠﻰ ﻫﺬﻩ ﺍﻟﺮﺳﻮﻡ ﺍﻭ ﺗﻌﺪﻳﻠﻬﺎ‬
Customer shall not be entitled to file any objection in this regard under the pretense of not being notified of the fees' adjustment. As well as, it shall be noted that the
amendment of the fees shall not be considered as a reason to terminate the contract before the end of its term.

Ooredoo issues a monthly bill in the name of each Customer including the total due fees. The bill shall include the different fees of the services to which the Customer ‫ ﻭﺗﺸﻤﻞ ﺍﻟﻔﺎﺗﻮﺭﺓ ﺍﻟﺮﺳﻮﻡ ﺍﻟﻤﺨﺘﻠﻔﺔ ﻟﻠﺨﺪﻣﺎﺕ ﺍﻟﺘﻲ ﺍﺷﺘﺮﻙ ﻓﻴﻬﺎ ﺍﻟﻌﻤﻴﻞ ﺃﻭ ﺍﻟﺘﻲ ﺍﺳﺘﺨﺪﻣﻬﺎ ﻓﻲ ﺍﻟﺸﻬﻮﺭ‬،‫ ﻓﺎﺗﻮﺭﺓ ﺷﻬﺮﻳﺔ ﻟﻜﻞ ﻋﻤﻴﻞ ﺗﺘﻀﻤﻦ ﻛﺎﻓﺔ ﺍﻟﺮﺳﻮﻡ ﺍﻹﺟﻤﺎﻟﻴﺔ ﺍﻟﻤﺴﺘﺤﻘﺔ‬Ooredoo ‫ﺗﺼﺪﺭ‬
subscribed or used during the last months except for the roaming fees and services and other kinds of services to be listed in the bills of (90) days. However, the Customer ‫ ﻭﻣﻊ ﺫﻟﻚ ﻳﺘﻮﺟﺐ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺩﻓﻊ ﻫﺬﻩ ﺍﻟﻔﻮﺍﺗﻴﺮ ﺑﺎﻟﻜﺎﻣﻞ ﺑﻤﺠﺮﺩ ﺇﺧﻄﺎﺭﻩ‬،‫ ﻳﻮﻣﺎ‬90 ‫ ﻫﺬﺍ ﺑﺎﺳﺘﺜﻨﺎﺀ ﺧﺪﻣﺎﺕ ﻭﺭﺳﻮﻡ ﺍﻟﺘﺠﻮﺍﻝ ﻭﻏﻴﺮﻫﺎ ﻣﻦ ﺍﻟﺨﺪﻣﺎﺕ ﺍﻟﺘﻲ ﻳﺴﺘﺪﻋﻲ ﺇﺩﺭﺍﺝ ﻓﻮﺍﺗﻴﺮﻫﺎ ﻓﺘﺮﺓ‬.‫ﺍﻟﻤﺎﺿﻴﺔ‬
shall pay all the bills immediately after receiving a notice in this regard without any objection whatsoever in accordance with the bill. The bills of Ooredoo are final and
‫ ﻧﻬﺎﺋﻴﺔ ﻭﺗﻤﺜﻞ ﺍﻟﺤﺴﺎﺏ ﺍﻟﺤﻘﻴﻘﻲ ﻭﺍﻟﺪﻟﻴﻞ ﺍﻟﻘﺎﻃﻊ ﺑﺎﻟﻨﺴﺒﺔ ﻟﻠﻤﺒﺎﻟﻎ ﺍﻟﻤﺴﺘﺤﻘﺔ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﻓﻲ ﺣﺎﻝ ﻟﻢ ﻳﻘﻢ‬Ooredoo ‫ ﻭﺗﻌﺘﺒﺮ ﻓﻮﺍﺗﻴﺮ‬.‫ﺑﻬﺎ ﺩﻭﻥ ﺍﻟﻤﻨﺎﺯﻋﺔ ﻓﻲ ﺍﺳﺘﺤﻘﺎﻗﻬﺎ ﻭﻓﻘﺎ ﻟﻠﻤﺒﻴﻦ ﻓﻲ ﺍﻟﻔﺎﺗﻮﺭﺓ‬
represent the real account and conclusive evidence regarding the due sums to be settled by the Customer unless the latter files a complaint pursuant to article (19)
.19 ‫ﺑﺘﻘﺪﻳﻢ ﺷﻜﻮﻯ ﻭﻓﻖ ﺍﻟﺒﻨﺪ‬
4. Payment ‫ ﺍﻟﺪﻓﻌﺎﺕ‬.4
- Postpaid: The Customer shall settle the entire monthly bill on its maturity date whereas the Customer is held solely liable in this regard. In the event the Customer abstained ‫ ﺑﺤﻘﻬﺎ‬Ooredoo ‫ ﻭﻓﻲ ﺣﺎﻟﺔ ﻋﺪﻡ ﺍﻟﺪﻓﻊ ﺃﻭ ﺍﻟﺘﺄﺧﺮ ﻓﻴﻪ ﺗﺤﺘﻔﻆ‬.‫ ﻳﺘﻌﻬﺪ ﺍﻟﻌﻤﻴﻞ ﺑﺘﺴﺪﻳﺪ ﻛﺎﻣﻞ ﺍﻟﻔﺎﺗﻮﺭﺓ ﺍﻟﺸﻬﺮﻳﺔ ﺑﺘﺎﺭﻳﺦ ﺍﻻﺳﺘﺤﻘﺎﻕ ﺍﻟﻤﺤﺪﺩ ﻭﻳﻜﻮﻥ ﻭﺣﺪﻩ ﺍﻟﻤﺴﺆﻭﻝ ﻋﻦ ﺳﺪﺍﺩﻫﺎ‬:‫ ﺍﻟﺪﻓﻊ ﺍﻵﺟﻞ‬.1
or failed to settle the bill on its maturity date, Ooredoo reserves the right to suspend the services of the Customer until the complete settlement of the due bills. As well as, the ‫ ﺗﺤﺘﻔﻆ‬،‫( ﻳﻮﻣﺎ ﻣﻦ ﺗﺎﺭﻳﺦ ﺍﺳﺘﺤﻘﺎﻕ ﺍﻟﻔﺎﺗﻮﺭﺓ‬90) ‫ ﻛﻤﺎ ﻳﺤﻖ ﻟﻬﺎ ﻓﺮﺽ ﺍﻟﺮﺳﻮﻡ ﺍﻹﺩﺍﺭﻳﺔ ﺍﻟﻤﻨﺎﺳﺒﺔ ﻭﻓﻲ ﺣﺎﻝ ﻟﻢ ﻳﺘﻢ ﺗﻠﻘﻲ ﺃﻳﺔ ﺩﻓﻌﺔ ﺧﻼﻝ ﻓﺘﺮﺓ ﺗﺴﻌﻴﻦ‬،‫ﻓﻲ ﺗﻌﻠﻴﻖ ﺧﺪﻣﺎﺕ ﺍﻟﻌﻤﻴﻞ ﺣﺘﻰ ﺗﻤﺎﻡ ﺍﻟﺴﺪﺍﺩ‬
Company shall be entitled to impose suitable administrative fees in such a case. In the event no payments were transferred within (90) days counting from the date of maturity
‫ ﺑﺎﻟﺤﻖ ﻓﻲ ﺗﺤﺼﻴﻞ ﺟﻤﻴﻊ ﺍﻟﻤﺒﺎﻟﻎ ﺍﻟﻤﺴﺘﺤﻘﺔ ﻋﻠﻰ ﺳﺒﻴﻞ ﺍﻟﻤﺜﺎﻝ‬Ooredoo ‫ ﻛﻤﺎ ﺗﺤﺘﻔﻆ‬.‫ ﺑﺎﻟﺤﻖ ﻓﻲ ﺇﻧﻬﺎﺀ ﺍﻟﻌﻘﺪ ﻭﺇﻋﺎﺩﺓ ﺗﺨﺼﻴﺺ ﺭﻗﻢ ﺍﻟﻬﺎﺗﻒ ﻟﻌﻤﻴﻞ ﺁﺧﺮ ﺩﻭﻥ ﺍﻟﺤﺎﺟﺔ ﻟﻺﻧﺬﺍﺭ‬Ooredoo
date of the bill, Ooredoo reserves the right to terminate the contract and reallocate the phone number to another Customer without the need for a notice in this regard.
Ooredoo also shall be entitled to collect all the due sums including but not limited to the administrative and judicial fees in addition to the actual attorney fees. (.‫)ﺍﻟﺮﺳﻮﻡ ﺍﻹﺩﺍﺭﻳﺔ ﻭﺍﻟﺘﻜﺎﻟﻴﻒ ﺍﻟﻘﻀﺎﺋﻴﺔ ﻭﺃﺗﻌﺎﺏ ﺍﻟﻤﺤﺎﻣﺎﺓ‬
- Prepaid: The service shall remain valid as long as it is recharged. Each recharge operation shall be related to its validity term whereas the last day of the validity term shall ‫ ﺣﻴﺚ ﻳﻜﻮﻥ ﺍﻟﻴﻮﻡ ﺍﻷﺧﻴﺮ ﻣﻦ ﻓﺘﺮﺓ ﺍﻟﺼﻼﺣﻴﺔ ﻫﻮ ﺗﺎﺭﻳﺦ‬،‫ ﻭﺗﺮﺗﺒﻂ ﻛﻞ ﻋﻤﻠﻴﺔ ﻹﻋﺎﺩﺓ ﺍﻟﺸﺤﻦ ﺑﻔﺘﺮﺓ ﺍﻟﺼﻼﺣﻴﺔ ﺍﻟﻤﺨﺼﺼﺔ ﻟﻬﺎ‬.‫ ﺗﺒﻘﻰ ﻫﺬﻩ ﺍﻟﺨﺪﻣﺔ ﺳﺎﺭﻳﺔ ﻃﺎﻟﻤﺎ ﺗﻢ ﺇﻋﺎﺩﺓ ﺷﺤﻨﻬﺎ‬:‫ ﺍﻟﺪﻓﻊ ﺍﻟﻤﺴﺒﻖ‬.2

The expiry date shall be followed by a grace period estimated by the Company provided that it shall not be less than (90) days during which the Customer .‫( ﻳﻮﻣﺎ ﻳﺘﻮﺟﺐ ﺧﻼﻟﻬﺎ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺇﻋﺎﺩﺓ ﺗﻌﺒﺌﺔ ﺍﻟﺮﺻﻴﺪ ﺃﻭ ﻳﻜﻮﻥ ﻋﺮﺿﺔ ﻟﺨﺴﺎﺭﺓ ﺍﻟﺨﻂ ﺩﻭﻥ ﺍﻟﺤﺎﺟﺔ ﻟﻺﻧﺬﺍﺭ‬90) ‫ ﻭﻳﻠﻲ ﺗﺎﺭﻳﺦ ﺍﻻﻧﺘﻬﺎﺀ ﻣﻬﻠﺔ ﺇﺧﻄﺎﺭ ﺗﻘﺪﺭﻫﺎ ﺍﻟﺸﺮﻛﺔ ﻭﻻ ﺗﻘﻞ ﻋﻦ ﺗﺴﻌﻴﻦ‬.‫ﺍﻻﻧﺘﻬﺎﺀ‬
shall recharge the account or else the Customer may lose the line without the need for a notice. Ooredoo reserves the right to reallocate the line in accordance with its internal ‫ ﺑﺎﻟﺤﻖ ﻓﻲ ﺇﻋﺎﺩﺓ ﺗﺨﺼﻴﺺ ﺍﻟﺨﻂ ﻭﻓﻘﺎ ﻟﺴﻴﺎﺳﺘﻬﺎ ﺍﻟﺪﺍﺧﻠﻴﺔ ﻭﻻ ﻳﻜﻮﻥ ﻟﻠﻌﻤﻴﻞ ﺍﻟﺤﻖ ﻓﻲ ﺍﻟﻤﻄﺎﻟﺒﺔ ﺑﺄﻱ ﺭﺻﻴﺪ ﻣﺘﺒﻘﻲ ﻓﻲ ﺣﺴﺎﺑﻪ ﺣﻴﺚ ﺃﻥ ﻫﺬﺍ ﺍﻟﺮﺻﻴﺪ ﺗﻌﻮﺩ ﻣﻠﻜﻴﺘﻪ ﺇﻟﻰ‬Ooredoo ‫ﻭﺗﺤﺘﻔﻆ‬
policy. The Customer shall not be entitled to claim any remaining account whereas the account is owned by Ooredoo. .Ooredoo
5. Using Ooredoo Services and Devices: ‫ ﻭﺃﺟﻬﺰﺗﻬﺎ‬Ooredoo ‫ ﺍﺳﺘﺨﺪﺍﻡ ﺧﺪﻣﺎﺕ‬.5
The Customer agrees to use the service of Ooredoo on its own liability. The Customer shall not be entitled to use or try to use or delegate others to use the service or devices ‫ ﻋﻠﻰ ﻣﺴﺆﻭﻟﻴﺘﻪ ﺍﻟﺨﺎﺻﺔ ﻭﻻ ﻳﺠﻮﺯ ﻟﻠﻌﻤﻴﻞ ﺍﺳﺘﺨﺪﺍﻡ ﺃﻭ ﻣﺤﺎﻭﻟﺔ ﺍﺳﺘﺨﺪﺍﻡ ﺃﻭ ﺗﻔﻮﻳﺾ ﺍﻵﺧﺮﻳﻦ ﺑﺎﺳﺘﺨﺪﺍﻡ ﺍﻟﺨﺪﻣﺔ ﺃﻭ ﺍﻷﺟﻬﺰﺓ ﺍﻟﻤﻘﺪﻣﺔ‬Ooredoo ‫ﻳﻮﺍﻓﻖ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻟﺨﺪﻣﺔ ﺍﻟﻤﻘﺪﻣﺔ ﻣﻦ‬
provided by Ooredoo in any way which may lead to the following: :‫ ﺑﺄﻳﺔ ﻃﺮﻳﻘﺔ ﺗﺆﺩﻱ ﺇﻟﻰ ﺍﻵﺗﻲ‬Ooredoo ‫ﻣﻦ‬
1. Violating the law and/or conditions and provisions of the present contract concluded with Ooredoo.
.Ooredoo ‫ ﺃﻭ ﺍﻟﺸﺮﻭﻁ ﻭﺍﻷﺣﻜﺎﻡ ﺍﻟﻤﻄﺒﻘﺔ ﻓﻲ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻣﻊ‬/‫ ﻣﺨﺎﻟﻔﺔ ﺍﻟﻘﺎﻧﻮﻥ ﻭ‬.1
2. Annoying authorities or destabilizing security.
3. Sending, receiving, uploading or using any material which violates the public order and rules of conduct or harms the reputation and honor or any information which may .‫ ﺇﺯﻋﺎﺝ ﺃﻭ ﺯﻋﺰﻋﺔ ﺍﻷﻣﻦ‬.2
form a wrong belief leading to deception and fraud. ‫ ﺍﻹﺭﺳﺎﻝ ﺃﻭ ﺍﻻﺳﺘﻼﻡ ﻋﻦ ﻣﻌﺮﻓﺔ ﺃﻭ ﺗﺤﻤﻴﻞ ﺃﻭ ﺍﺳﺘﺨﺪﺍﻡ ﺃﻱ ﻣﺎﺩﺓ ﻣﺨﻠﺔ ﺑﺎﻟﻨﻈﺎﻡ ﺍﻟﻌﺎﻡ ﻭﺍﻵﺩﺍﺏ ﺃﻭ ﻣﺴﻴﺌﺔ ﻟﻠﺴﻤﻌﺔ ﻭﺍﻟﺸﺮﻑ ﺃﻭ ﺃﻱ ﻣﻌﻠﻮﻣﺎﺕ ﻳﻜﻮﻥ ﺍﻟﻬﺪﻑ ﻣﻨﻬﺎ ﺗﻜﻮﻳﻦ ﺍﻋﺘﻘﺎﺩ ﺧﺎﻃﺊ ﻳﺆﺩﻱ ﺃﻭ‬.3
4. Affecting the provision of the service to the Customers of Ooredoo in a negative way. .‫ﻳﻜﻮﻥ ﻣﻦ ﺷﺄﻧﻪ ﺃﻥ ﻳﺆﺩﻱ ﺇﻟﻰ ﺍﻟﻨﺼﺐ ﻭﺍﻻﺣﺘﻴﺎﻝ‬
5. Violating the copyrights or other intellectual rights. .‫ ﺑﺼﻮﺭﺓ ﺳﻠﺒﻴﺔ‬Ooredoo ‫ ﺍﻟﺘﺄﺛﻴﺮ ﻋﻠﻰ ﺗﻘﺪﻳﻢ ﺍﻟﺨﺪﻣﺔ ﻟﻌﻤﻼﺀ‬.4
6. Accessing or trying to access computer systems, networks or any other information resource illegally or without the approval of the owner of the information or resources. .‫ ﺍﻧﺘﻬﺎﻙ ﺣﻘﻮﻕ ﺍﻟﻨﺸﺮ ﻭﺍﻟﺘﺄﻟﻴﻒ ﺃﻭ ﺣﻘﻮﻕ ﺍﻟﻤﻠﻜﻴﺔ ﺍﻟﻔﻜﺮﻳﺔ ﺍﻷﺧﺮﻯ‬.5
.‫ ﺍﻟﺪﺧﻮﻝ ﺃﻭ ﻣﺤﺎﻭﻟﺔ ﺍﻟﺪﺧﻮﻝ ﺇﻟﻰ ﺃﻧﻈﻤﺔ ﺍﻟﻜﻤﺒﻴﻮﺗﺮ ﺃﻭ ﺍﻟﺸﺒﻜﺎﺕ ﺃﻭ ﺃﻳﺔ ﻣﻮﺍﺭﺩ ﻣﻌﻠﻮﻣﺎﺕ ﺃﺧﺮﻯ ﺑﺸﻜﻞ ﻏﻴﺮ ﻗﺎﻧﻮﻧﻲ ﺃﻭ ﺩﻭﻥ ﻣﻮﺍﻓﻘﺔ ﺻﺎﺣﺐ ﺗﻠﻚ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺃﻭ ﺍﻟﻤﻮﺍﺭﺩ‬.6
6. Fair Usage Policy: ‫ ﺳﻴﺎﺳﺔ ﺍﻻﺳﺘﺨﺪﺍﻡ ﺍﻟﻌﺎﺩﻝ‬.6
All the Customers of Ooredoo shall be subject to the Fair Usage Policy in order to guarantee providing the service to the Customer on a continuous basis. Therefore, Ooredoo ‫ ﺑﻤﺮﺍﻗﺒﺔ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻟﻌﻤﻴﻞ ﻟﻠﺨﺪﻣﺔ ﻓﺈﺫﺍ‬Ooredoo ‫ ﻭﺑﻨﺎﺀ ﻋﻠﻴﻪ ﺳﻮﻑ ﺗﻘﻮﻡ‬.‫ ﻟﺴﻴﺎﺳﺔ ﺍﻻﺳﺘﺨﺪﺍﻡ ﺍﻟﻌﺎﺩﻝ ﻭﺫﻟﻚ ﻟﻀﻤﺎﻥ ﺗﻤﺘﻊ ﺍﻟﻌﻤﻴﻞ ﺑﺎﺳﺘﻤﺮﺍﺭ ﺍﻟﺨﺪﻣﺔ‬Ooredoo ‫ﻳﺘﻢ ﺇﺧﻀﺎﻉ ﺟﻤﻴﻊ ﺍﻟﻌﻤﻼﺀ ﻓﻲ‬
shall control the usage of the service by the Customer. In the event the Customer failed to comply with the Fair Usage Policy – in accordance with the estimation of Ooredoo – Ooredoo ‫ ﻳﻜﻮﻥ ﻣﻦ ﺣﻖ‬،‫ ﺃﻭ ﻣﺴﺘﻮﻯ ﺍﻟﺨﺪﻣﺔ ﺍﻟﻤﻘﺪﻣﺔ ﻟﺒﺎﻗﻲ ﺍﻟﻌﻤﻼﺀ‬Ooredoo ‫ ﺑﺘﺠﺎﻭﺯ ﺳﻴﺎﺳﺔ ﺍﻻﺳﺘﺨﺪﺍﻡ ﺍﻟﻌﺎﺩﻝ ﺑﺸﻜﻞ ﻳﺆﺛﺮ ﺳﻠﺒﺎ ﻋﻠﻰ ﺷﺒﻜﺔ‬Ooredoo – ‫ﻗﺎﻡ ﺍﻟﻌﻤﻴﻞ – ﻭﻓﻘﺎ ﻟﺘﻘﺪﻳﺮ‬
which affected negatively on Ooredoo network or the level of the service provided to the other Customers, Ooredoo shall be entitled to take all necessary procedures including ‫ ﻣﻦ ﺃﻳﺔ‬Ooredoo ‫ ﻭﻳﻌﻔﻰ ﺍﻟﻌﻤﻴﻞ‬،‫ﺍﺗﺨﺎﺫ ﻣﺎ ﺗﺮﺍﻩ ﻣﻨﺎﺳﺒﺎ ﻣﻦ ﺍﻹﺟﺮﺍﺀﺍﺕ ﻛﺘﻌﺪﻳﻞ ﻧﻮﻉ ﺍﻟﺨﺪﻣﺔ ﺃﻭ ﻗﻄﻌﻬﺎ ﺃﻭ ﺇﻟﻐﺎﺋﻬﺎ ﺩﻭﻥ ﺍﻟﺤﺎﺟﺔ ﻟﻺﻧﺬﺍﺭ ﻣﻊ ﺇﻟﺰﺍﻡ ﺍﻟﻌﻤﻴﻞ ﺑﻜﺎﻓﺔ ﺍﻟﺮﺳﻮﻡ ﺍﻟﻤﻘﺮﺭﺓ ﻟﻬﺬﻩ ﺍﻹﺟﺮﺍﺀﺍﺕ‬
but not limited to adjusting the type of the service or cancelling the service without the need for a notice while binding the Customer to settle all the fees resulting from such
.‫ﻣﺴﺆﻭﻟﻴﺎﺕ ﺃﻭ ﺗﺒﻌﺎﺕ ﻗﺎﻧﻮﻧﻴﺔ ﺃﻭ ﻣﺎﻟﻴﺔ ﺗﺘﺮﺗﺐ ﻋﻠﻰ ﻫﺬﻩ ﺍﻹﺟﺮﺍﺀﺍﺕ‬
procedures. However, the Customer exempt Ooredoo from bearing any legal or financial liability maybe resulting herein.
7. Termination: ‫ ﺍﻹﻧﻬﺎﺀ‬.7
Once the Customer activates the SIM Card or subscribes at the service, he/she shall be entitled to ask for the termination of the Contract. As a result thereof, Ooredoo ‫ ﻓﺮﺽ ﺭﺳﻮﻡ ﻣﻨﺎﺳﺒﺔ ﺗﻌﺎﺩﻝ ﻗﻴﻤﺔ ﺍﻟﻤﺒﻠﻎ ﺍﻟﻤﺴﺘﺤﻖ ﻭﺭﺳﻮﻡ‬Ooredoo ‫ ﻭﺑﺎﻟﺘﺎﻟﻲ ﻳﺤﻖ ﻟـ‬.‫ﺑﻤﺠﺮﺩ ﺗﻔﻌﻴﻞ ﺷﺮﻳﺤﺔ ﺍﻻﺗﺼﺎﻝ ﻟﻠﻌﻤﻴﻞ ﺃﻭ ﺑﺪﺀ ﺍﻻﺷﺘﺮﺍﻙ ﻓﻲ ﺍﻟﺨﺪﻣﺔ ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ ﻃﻠﺐ ﺇﻧﻬﺎﺀ ﺍﻟﻌﻘﺪ‬
reserves the right to impose convenient fees equal to the due sum and cancellation fees of the Contract in addition to any due fees related to other offers included in a .‫ﺍﻹﻟﻐﺎﺀ ﺍﻟﺨﺎﺻﺔ ﺑﺎﻟﻌﻘﺪ ﺑﺎﻹﺿﺎﻓﺔ ﺇﻟﻰ ﺃﻳﺔ ﺭﺳﻮﻡ ﺗﺴﺘﺤﻖ ﻋﻦ ﻋﺮﻭﺽ ﺃﺧﺮﻯ ﺗﻢ ﺍﻟﺘﻌﺎﻗﺪ ﻋﻠﻴﻬﺎ‬
Contract.
8. Robbery or Loss of the SIM Card: ‫ ﺳﺮﻗﺔ ﺃﻭ ﺿﻴﺎﻉ ﺍﻟﺸﺮﻳﺤﺔ‬.8
In the event the SIM Card was robbed or lost, the Customer undertakes to settle all the fees and bills related to the service until he/she sends an official notice in this regard to ‫ ﺭﺳﻤﻴﺎ ﺑﻬﺬﻩ ﺍﻟﺴﺮﻗﺔ ﺃﻭ ﺍﻟﻀﻴﺎﻉ ﻭﺣﺘﻰ ﺗﺘﻤﻜﻦ ﺍﻟﺸﺮﻛﺔ ﺗﻘﻨﻴﺎ ﻣﻦ‬Ooredoo ‫ﻓﻲ ﺣﺎﻟﺔ ﺳﺮﻗﺔ ﺃﻭ ﺿﻴﺎﻉ ﺍﻟﺸﺮﻳﺤﺔ ﻳﻠﺘﺰﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺴﺪﺍﺩ ﻛﺎﻓﺔ ﺍﻟﺮﺳﻮﻡ ﻭﺍﻟﻔﻮﺍﺗﻴﺮ ﺍﻟﺨﺎﺻﺔ ﺑﺎﻟﺨﺪﻣﺔ ﺣﺘﻰ ﺗﺎﺭﻳﺦ ﺇﺧﻄﺎﺭ‬
Ooredoo in order for the Company to stop the service in accordance with article (17) of the Contract. .‫ ﻣﻦ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬17 ‫ﻗﻄﻊ ﺍﻟﺨﺪﻣﺔ ﻭﺫﻟﻚ ﻭﻓﻘﺎ ﻟﻠﻤﺎﺩﺓ‬
9. Eligibility: ‫ ﺍﻷﻫﻠﻴﺔ‬.9
The Customer shall prove his/her age and identity by submitting an original civil card and/or other document or procedure required by Ooredoo in accordance with the :‫ ﻭﺫﻟﻚ ﻭﻓﻘﺎ ﻟﻶﺗﻲ‬Ooredoo ‫ﺃﻭ ﺃﻱ ﻣﺴﺘﻨﺪ ﺁﺧﺮ ﺃﻭ ﺇﺟﺮﺍﺀ ﻣﻄﻠﻮﺏ ﻣﻦ ﻗﺒﻞ‬/‫ﻳﻜﻮﻥ ﺍﻟﻌﻤﻴﻞ ﻣﻠﺰﻣﺎ ﺑﺈﺛﺒﺎﺕ ﺳﻨﻪ ﻭﻫﻮﻳﺘﻪ ﻣﻦ ﺧﻼﻝ ﺗﻘﺪﻳﻢ ﺑﻄﺎﻗﺘﻪ ﺍﻟﻤﺪﻧﻴﺔ ﺍﻷﺻﻠﻴﺔ ﻭ‬
following: .Ooredoo ‫( ﻭﻣﺎ ﻓﻮﻕ ﺃﻭ ﺃﻱ ﺣﺪ ﻋﻤﺮﻱ ﺁﺧﺮ ﺗﺤﺪﺩﻩ‬21) ‫ ﻳﺠﺐ ﺃﻥ ﻳﺒﻠﻎ ﺍﻟﻌﻤﻴﻞ ﺳﻦ ﺍﻟﻮﺍﺣﺪ ﻭﺍﻟﻌﺸﺮﻳﻦ ﻋﺎﻣﺎ‬:‫ ﺧﻄﻮﻁ ﺍﻟﺪﻓﻊ ﺍﻵﺟﻞ‬-
-Postpaid Lines: The Customer shall be (21) years old and above or as may be defined by Ooredoo.
.Ooredoo ‫( ﻭﻣﺎ ﻓﻮﻕ ﺃﻭ ﺃﻱ ﺣﺪ ﻋﻤﺮﻱ ﺁﺧﺮ ﺗﺤﺪﺩﻩ‬12) ‫ ﻳﺠﺐ ﺃﻥ ﻳﺒﻠﻎ ﺍﻟﻌﻤﻴﻞ ﺳﻦ ﺍﺛﻨﻲ ﻋﺸﺮ ﻋﺎﻣﺎ‬:‫ ﺧﻄﻮﻁ ﺍﻟﺪﻓﻊ ﺍﻟﻤﺴﺒﻖ‬-
-Prepaid Lines: The Customer shall be (12) years old and above or as may be defined by Ooredoo.
-Data Services Lines: The Customer shall be (18) years old and above or as may be defined by Ooredoo. Not all Customers enjoy the capacity to receive the service due to ‫ ﻣﻊ ﻋﺪﻡ ﺍﻹﺧﻼﻝ ﺑﻤﺎ ﻭﺭﺩ ﻓﻲ ﻫﺬﻩ ﺍﻟﻤﺎﺩﺓ ﻻ ﻳﻜﻮﻥ ﺍﻟﺒﻌﺾ‬.Ooredoo ‫( ﻭﻣﺎ ﻓﻮﻕ ﺃﻭ ﺃﻱ ﺣﺪ ﻋﻤﺮﻱ ﺁﺧﺮ ﺗﺤﺪﺩﻩ‬18) ‫ ﻳﺠﺐ ﺃﻥ ﻳﺒﻠﻎ ﺍﻟﻌﻤﻴﻞ ﺳﻦ ﺍﻟﺜﺎﻣﻨﺔ ﻋﺸﺮﺓ ﻋﺎﻣﺎ‬:‫ ﺧﻄﻮﻁ ﺧﺪﻣﺎﺕ ﺍﻟﺒﻴﺎﻧﺎﺕ‬-
the credit history or payments record at Ooredoo or any other reason whatsoever without prejudice to the content of the present article. .‫ ﺃﻭ ﺃﻳﺔ ﻋﻮﺍﻣﻞ ﺃﺧﺮﻯ‬Ooredoo ‫ ﻭﺫﻟﻚ ﺑﺴﺒﺐ ﺍﻟﺘﺎﺭﻳﺦ ﺍﻻﺋﺘﻤﺎﻧﻲ ﺃﻭ ﺳﺠﻞ ﺍﻟﺪﻓﻌﺎﺕ ﺍﻟﺨﺎﺹ ﺑﻪ ﻟﺪﻯ‬،‫ﻣﺆﻫﻼ ﻟﺘﻠﻘﻲ ﺍﻟﺨﺪﻣﺔ‬
10. Termination: ‫ ﺍﻹﻧﻬﺎﺀ‬.10
First: Termination Right of Ooredoo: ‫ ﺑﺎﻹﻧﻬﺎﺀ‬Ooredoo ‫ ﺣﻖ‬:‫ﺃﻭﻻ‬
Ooredoo shall be entitled to terminate the contract in one of the following cases: :‫ﻓﻲ ﺣﺎﻟﺔ ﺣﺪﻭﺙ ﺃﻳﺎ ﻣﻦ ﺍﻟﺤﺎﻻﺕ ﺍﻵﺗﻴﺔ‬
1. In case Ooredoo finds that the information included in the contract are incomplete or wrong or fraudulent.
.‫ ﺇﺫﺍ ﻭﺟﺪﺕ ﺃﻥ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﻓﻲ ﺍﻟﻌﻘﺪ ﻛﻠﻬﺎ ﺃﻭ ﺑﻌﻀﻬﺎ ﻧﺎﻗﺼﺔ ﺃﻭ ﺧﺎﻃﺌﺔ ﺃﻭ ﺍﺣﺘﻴﺎﻟﻴﺔ‬.1
2. In case the Customer used equipment interfering with Ooredoo network or not found to be in conformity with the Kuwaiti and international standards.
3. In case the Customer violates any of the conditions and provisions of the present contract in particular article (6) of the same (Using Ooredoo services and devices). .‫ ﺃﻭ ﻻ ﺗﺘﻘﻴﺪ ﺑﺎﻟﻤﻘﺎﻳﻴﺲ ﺍﻟﻜﻮﻳﺘﻴﺔ ﻭﺍﻟﺪﻭﻟﻴﺔ‬Ooredoo ‫ ﺇﺫﺍ ﺍﺳﺘﺨﺪﻡ ﺍﻟﻌﻤﻴﻞ ﺃﻱ ﻣﻌﺪﺍﺕ ﺗﺘﺪﺍﺧﻞ ﻣﻊ ﺷﺒﻜﺔ‬.2
4. In case of force majeure or national crisis or state of emergency or issuance of a resolution made by the competent authorities binding Ooredoo to suspend its services. .(‫ ﻭﺃﺟﻬﺰﺗﻬﺎ‬Ooredoo ‫ )ﺍﺳﺘﺨﺪﺍﻡ ﺧﺪﻣﺎﺕ‬6 ‫ ﻓﻲ ﺣﺎﻝ ﺍﻧﺘﻬﺎﻙ ﺍﻟﻌﻤﻴﻞ ﻷﻱ ﻣﻦ ﺷﺮﻭﻁ ﻭﺃﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﺧﺼﻮﺻﺎ ﺍﻟﻤﺎﺩﺓ‬.3
Ooredoo reserves the right to take any of the following procedures: .‫ ﻟﺘﻌﻠﻴﻖ ﺧﺪﻣﺎﺗﻬﺎ‬Ooredoo ‫ ﻓﻲ ﺣﺎﻟﺔ ﺍﻟﻘﻮﺓ ﺍﻟﻘﺎﻫﺮﺓ ﺃﻭ ﺣﺪﻭﺙ ﺃﺯﻣﺔ ﻭﻃﻨﻴﺔ ﺃﻭ ﺇﻋﻼﻥ ﺣﺎﻟﺔ ﺍﻟﻄﻮﺍﺭﺉ ﺃﻭ ﺇﺻﺪﺍﺭ ﺃﻱ ﻗﺮﺍﺭ ﻣﻦ ﺍﻟﺴﻠﻄﺎﺕ ﺍﻟﻤﺨﺘﺼﺔ ﻳﻨﺺ ﻋﻠﻰ ﺣﺎﺟﺔ‬.4
1. Immediate termination of the contract without the need for a warning. :‫ ﺑﺎﻟﺤﻖ ﻓﻲ ﺍﺗﺨﺎﺫ ﺃﻱ ﻣﻦ ﺍﻹﺟﺮﺍﺀﺍﺕ ﺍﻵﺗﻴﺔ‬Ooredoo ‫ﺗﺤﺘﻔﻆ‬
2. Temporary suspension of the service or the account of the Customer. .‫ ﺍﻹﻧﻬﺎﺀ ﺍﻟﻔﻮﺭﻱ ﻟﻠﻌﻘﺪ ﻭﺩﻭﻥ ﺍﻟﺤﺎﺟﺔ ﻟﻺﻧﺬﺍﺭ‬.1
3. Collection of all due sums and administrative fees from the Customer or third parties when necessary.
.‫ ﺗﻌﻠﻴﻖ ﺍﻟﺨﺪﻣﺔ ﺃﻭ ﺣﺴﺎﺏ ﺍﻟﻌﻤﻴﻞ ﻣﺆﻗﺘﺎ‬.2
4. Recovery of the costs afforded by Ooredoo due to the misuse of its network.
Second: Termination Right of the Customer: .‫ ﺗﺤﺼﻴﻞ ﺃﻳﺔ ﺃﻣﻮﺍﻝ ﻣﺴﺘﺤﻘﺔ ﻭﺃﻳﺔ ﺭﺳﻮﻡ ﺇﺩﺍﺭﻳﺔ ﻣﻦ ﺍﻟﻌﻤﻴﻞ ﺃﻭ ﻣﻦ ﺍﻟﻐﻴﺮ ﻋﻨﺪ ﺍﻟﻀﺮﻭﺭﺓ‬.3
In the event the Customer asks to terminate the contract or transfer the number to another operator, Ooredoo shall be entitled to impose convenient fees equal to the due sum .‫ ﺑﺴﺒﺐ ﺳﻮﺀ ﺍﺳﺘﺨﺪﺍﻡ ﺷﺒﻜﺘﻬﺎ‬Ooredoo ‫ ﺍﺳﺘﺮﺩﺍﺩ ﺍﻟﺘﻜﺎﻟﻴﻒ ﺍﻟﺘﻲ ﺗﻜﺒﺪﺗﻬﺎ‬.4
of the usage and cancellation fees of the Contract in addition to any due fees or numbers' value or devices related to other offers included in a Contract. ‫ ﺣﻖ ﺍﻟﻌﻤﻴﻞ ﺑﺎﻹﻧﻬﺎﺀ‬:‫ﺛﺎﻧﻴﺎ‬
‫ ﻓﺮﺽ ﺭﺳﻮﻡ ﻣﻨﺎﺳﺒﺔ ﺗﻌﺎﺩﻝ ﻗﻴﻤﺔ ﺍﻟﻤﺒﻠﻎ ﺍﻟﻤﺴﺘﺤﻖ ﻋﻦ ﺍﻹﺳﺘﺨﺪﺍﻡ ﻭﺭﺳﻮﻡ ﺍﻹﻟﻐﺎﺀ ﺍﻟﺨﺎﺻﺔ ﺑﺎﻟﻌﻘﺪ ﺑﺎﻹﺿﺎﻓﺔ‬Ooredoo ‫ﻓﻲ ﺣﺎﻝ ﻗﻴﺎﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺎﻹﻧﻬﺎﺀ ﺃﻭ ﻃﻠﺐ ﻧﻘﻞ ﺍﻟﺮﻗﻢ ﻟﻤﺸﻐﻞ ﺁﺧﺮ ﻓﺈﻧﻪ ﻳﺤﻖ ﻟـ‬
.‫ﺇﻟﻰ ﺃﻳﺔ ﺭﺳﻮﻡ ﺃﻭ ﻗﻴﻤﺔ ﺧﻄﻮﻁ ﺃﻭ ﺃﺟﻬﺰﺓ ﺗﺴﺘﺤﻖ ﻋﻦ ﻋﺮﻭﺽ ﺃﺧﺮﻯ ﺗﻢ ﺍﻟﺘﻌﺎﻗﺪ ﻋﻠﻴﻬﺎ‬
11. Numbers Portability/ Transfer: ‫ ﻧﻘﻞ ﺍﻷﺭﻗﺎﻡ‬.11
1. In the event the line will be transferred to another operator during the commitment period to any of the services or offers, the Customer shall settle the remaining monthly ‫ ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺩﻓﻊ ﻗﻴﻤﺔ ﺑﺎﻗﻲ ﺍﻹﺷﺘﺮﺍﻛﺎﺕ ﺍﻟﺸﻬﺮﻳﺔ ﻭﺩﻓﻊ ﻗﻴﻤﺔ ﺍﻟﺨﺼﻢ ﻋﻠﻰ ﺍﻟﺨﻂ‬،‫ ﻓﻲ ﺣﺎﻝ ﺍﻟﺮﻏﺒﺔ ﻓﻲ ﻧﻘﻞ ﺍﻟﺨﻂ ﺇﻟﻰ ﻣﺸﻐﻞ ﺁﺧﺮ ﺧﻼﻝ ﻣﺪﺓ ﺍﻹﻟﺘﺰﺍﻡ ﻓﻲ ﺃﻳﺎ ﻣﻦ ﺍﻟﺨﺪﻣﺎﺕ ﺃﻭ ﺍﻟﻌﺮﻭﺽ‬-1
subscriptions and the discount value of the line in addition to the remaining installments of the monthly line value. .‫ﻭﺑﺎﻗﻲ ﺃﻗﺴﺎﻁ ﻗﻴﻤﺔ ﺍﻟﺨﻂ ﺍﻟﺸﻬﺮﻳﺔ‬
2. In the event the line will be transferred to another operator during the commitment period to the cash offer, the Customer shall settle the remaining monthly subscriptions
.‫ ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺩﻓﻊ ﻗﻴﻤﺔ ﺑﺎﻗﻲ ﺍﻹﺷﺘﺮﺍﻛﺎﺕ ﺍﻟﺸﻬﺮﻳﺔ ﻭﺩﻓﻊ ﻗﻴﻤﺔ ﺍﻟﺨﺼﻢ ﻋﻠﻰ ﺍﻟﺨﻂ‬،‫ ﻓﻲ ﺣﺎﻝ ﺍﻟﺮﻏﺒﺔ ﻓﻲ ﻧﻘﻞ ﺍﻟﺨﻂ ﺇﻟﻰ ﻣﺸﻐﻞ ﺁﺧﺮ ﺧﻼﻝ ﻣﺪﺓ ﺍﻹﻟﺘﺰﺍﻡ ﻓﻲ ﺍﻟﻌﺮﺽ ﺍﻟﻨﻘﺪﻱ‬-2
value and the discount value of the line.
12. Phone Numbers and Transferability to Others: ‫ ﺃﺭﻗﺎﻡ ﺍﻟﻬﻮﺍﺗﻒ ﻭﻗﺎﺑﻠﻴﺔ ﺍﻟﺘﺤﻮﻳﻞ ﻟﻠﻐﻴﺮ‬.12
1. The Parties of the present contract mutually agreed that the Customer does not own the phone line listed in the present contract whereas he/she shall only be allowed to ‫ ﻭﺫﻟﻚ ﻭﻓﻘﺎ ﻟﻠﻘﻮﺍﻧﻴﻦ ﺍﻟﻤﻄﺒﻘﺔ ﻓﻲ‬Ooredoo ‫ﻣﻦ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻪ ﺑﻴﻦ ﺃﻃﺮﺍﻑ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺃﻥ ﺍﻟﻌﻤﻴﻞ ﻻ ﻳﻤﺘﻠﻚ ﺧﻂ ﺍﻟﻬﺎﺗﻒ ﺍﻟﻤﺒﻴﻦ ﻓﻲ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﺇﻧﻤﺎ ﻳﻜﻮﻥ ﻟﻪ ﺣﻖ ﺍﺳﺘﺨﺪﺍﻣﻪ ﻭﺍﻻﻧﺘﻔﺎﻉ ﺑﻪ ﻣﻦ ﻗﺒﻞ‬
use it by Ooredoo in accordance with the laws enforced in the State of Kuwait. .‫ ﻭﻭﻓﻘﺎ ﻟﻠﺮﺳﻮﻡ ﺍﻟﻤﻄﺒﻘﺔ‬Ooredoo ‫ ﻛﻤﺎ ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ ﺗﺤﻮﻳﻞ ﺧﻂ ﺍﻟﻬﺎﺗﻒ ﺍﻟﻤﺰﻭﺩ ﺑﻪ ﻟﺼﺎﻟﺢ ﺷﺨﺺ ﺁﺧﺮ ﺑﺸﺮﻁ ﺍﻟﺤﺼﻮﻝ ﻋﻠﻰ ﻣﻮﺍﻓﻘﺔ ﻣﺴﺒﻘﺔ ﻣﻦ‬،‫ﺩﻭﻝ ﺍﻟﻜﻮﻳﺖ‬
2. The Customer shall be entitled to transfer his/her phone line to another person following the prior approval of Ooredoo in this regard in accordance with the applied fees and
terms.
13. Personal Information and Data: ‫ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﻭﺍﻟﺒﻴﺎﻧﺎﺕ ﺍﻟﺸﺨﺼﻴﺔ‬.13
1. The personal information and data required for the Contract are deemed as necessary in order to provide the Customer with the service. Ooredoo will save and use the ‫ ﺑﺘﺨﺰﻳﻦ ﻭﺍﺳﺘﺨﺪﺍﻡ ﺗﻠﻚ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﻹﻋﺪﺍﺩ ﺍﻟﺨﺪﻣﺔ ﻭﺇﺭﺳﺎﻝ ﺍﻟﻔﻮﺍﺗﻴﺮ ﺍﻟﺨﺎﺻﺔ‬Ooredoo ‫ ﻭﺳﻮﻑ ﺗﻘﻮﻡ‬،‫ ﺗﻌﺘﺒﺮ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺍﻟﺸﺨﺼﻴﺔ ﺍﻟﻤﻄﻠﻮﺑﺔ ﻓﻲ ﺍﻟﻌﻘﺪ ﺿﺮﻭﺭﻳﺔ ﻟﺘﺰﻭﻳﺪ ﺍﻟﻌﻤﻴﻞ ﺑﺎﻟﺨﺪﻣﺔ‬.1
aforementioned information and data to prepare the service and send the bills related to the usage of the service by the Customer as well as to respond to the inquiries or ‫ ﻓﻲ‬Ooredoo ‫ﺑﺎﺳﺘﺨﺪﺍﻡ ﺍﻟﻌﻤﻴﻞ ﻟﻠﺨﺪﻣﺔ ﻭﺍﻹﺟﺎﺑﺔ ﻋﻦ ﺍﻻﺳﺘﻔﺴﺎﺭﺍﺕ ﺃﻭ ﺃﻳﺔ ﻋﺮﻭﺽ ﺧﺪﻣﺔ ﻣﺘﻮﻓﺮﺓ ﻭﺑﺘﻮﻗﻴﻊ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻓﺈﻧﻪ ﻳﻘﺮ ﺑﺼﺤﺔ ﻭﺩﻗﺔ ﻭﺍﻛﺘﻤﺎﻝ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺍﻟﺘﻲ ﺯﻭﺩﻫﺎ ﻟــ‬
available service offers. When the Customer signs the Contract, it means that he/she found the information included therein provided by the latter to the Company correct,
. Ooredoo ‫ ﺑﺄﻱ ﺗﻐﻴﻴﺮﺍﺕ ﻗﺪ ﺗﻄﺮﺃ ﻋﻠﻰ ﻫﺬﻩ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺩﻭﻥ ﺃﺩﻧﻰ ﻣﺴﺆﻭﻟﻴﺔ ﻋﻠﻰ‬Ooredoo ‫ ﻭﻳﻠﺘﺰﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺈﺑﻼﻍ‬،‫ﺍﻟﻌﻘﺪ‬
accurate and complete. The Customer undertakes to inform Ooredoo of any changes of the aforementioned information without any liability on behalf of the latter.
2. Ooredoo undertakes to protect the personal information of the Customer. As well as, Ooredoo shall only collect, use or publish any personal information about the ‫ ﺑﺤﻤﺎﻳﺔ ﻣﻌﻠﻮﻣﺎﺕ ﺍﻟﻌﻤﻴﻞ ﺍﻟﺸﺨﺼﻴﺔ ﻭﻟﻦ ﺗﻘﻮﻡ ﺑﺠﻤﻊ ﺃﻭ ﺍﺳﺘﺨﺪﺍﻡ ﺃﻭ ﺍﻻﺣﺘﻔﺎﻅ ﺃﻭ ﺍﻹﻋﻼﻥ ﻋﻦ ﺃﻳﺔ ﻣﻌﻠﻮﻣﺎﺕ ﺩﻭﻥ ﺍﻟﺤﺼﻮﻝ ﻋﻠﻰ ﺍﻟﻤﻮﺍﻓﻘﺔ ﺍﻟﺨﻄﻴﺔ ﺍﻟﻤﺴﺒﻘﺔ ﻣﻦ ﺍﻟﻌﻤﻴﻞ ﻭﺑﻤﺎ‬Ooredoo ‫ ﺗﻠﺘﺰﻡ‬.2
Customer following the approval of the latter and in accordance with the laws enforced in the State of Kuwait. .‫ﻳﺘﻮﺍﻓﻖ ﻣﻊ ﺍﻟﻘﻮﺍﻧﻴﻦ ﺍﻟﻤﻄﺒﻘﺔ ﻓﻲ ﺩﻭﻟﺔ ﺍﻟﻜﻮﻳﺖ‬
14. Personal Identification Service: ‫ ﺧﺪﻣﺔ ﺍﻟﺘﻌﺮﻳﻒ ﺍﻟﺸﺨﺼﻲ‬.14
The Personal Identification Service is available through the mobile phone whereas the Customer selects a secret code composed of four numbers related to the personal .‫ ﻭﺫﻟﻚ ﺣﺴﺐ ﺍﻹﺟﺮﺍﺀﺍﺕ ﺍﻟﺨﺎﺻﺔ ﺑﺎﻟﺸﺮﻛﺔ‬،‫ﺗﺘﻮﻓﺮ ﺧﺪﻣﺔ ﺍﻟﺘﻌﺮﻳﻒ ﺍﻟﺸﺨﺼﻲ ﺑﻮﺍﺳﻄﺔ ﺍﻟﻬﺎﺗﻒ ﺍﻟﻨﻘﺎﻝ ﺣﻴﺚ ﻳﻘﻮﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺎﺧﺘﻴﺎﺭ ﺭﻗﻢ ﺳﺮﻱ ﺭﺑﺎﻋﻲ ﺧﺎﺹ ﺑﺸﻬﺎﺩﺓ ﺍﻟﺘﻌﺮﻳﻒ ﺍﻟﺸﺨﺼﻲ‬
identification certificate in accordance with the procedures of the Company.
15. Liability of Ooredoo: Ooredoo ‫ ﻣﺴﺆﻭﻟﻴﺔ‬.15
1. Ooredoo shall be liable for providing the service agreed upon to its Customers. .‫ ﻓﻲ ﺗﻮﻓﻴﺮ ﺍﻟﺨﺪﻣﺔ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻬﺎ ﻟﻌﻤﻼﺋﻬﺎ‬Ooredoo ‫ ﻳﻨﺤﺼﺮ ﺩﻭﺭ‬.1
2. Ooredoo shall provide the Customer with the secret code of the SIM Card which shall be saved in a confidential manner upon concluding the Contract. .‫ ﺑﻤﺪ ﺍﻟﻌﻤﻴﻞ ﻋﻨﺪ ﺍﻟﺘﻌﺎﻗﺪ ﺑﺎﻟﺮﻗﻢ ﺍﻟﺴﺮﻱ ﺍﻟﺨﺎﺹ ﺑﺎﻟﺸﺮﻳﺤﺔ ﻭﺍﻟﺬﻱ ﺗﻢ ﺣﻔﻈﻪ ﻋﻠﻰ ﻧﺤﻮ ﻳﻀﻤﻦ ﺳﺮﻳﺘﻪ‬Ooredoo ‫ ﺗﻠﺘﺰﻡ‬.2
16. Liability of the Customer: ‫ ﻣﺴﺆﻭﻟﻴﺔ ﺍﻟﻌﻤﻴﻞ‬.16
1. The Customer shall keep the SIM Card in a good condition and avoid losing or damaging it. He/she shall also keep the secret code confidential and avoid disclosing it ‫ ﻏﻴﺮ ﻣﺴﺆﻭﻟﺔ‬Ooredoo ‫ ﺣﻴﺚ ﺃﻥ‬،‫ ﻳﻠﺘﺰﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺎﻟﻤﺤﺎﻓﻈﺔ ﻋﻠﻰ ﺍﻟﺸﺮﻳﺤﺔ ﻭﺍﻟﺘﺄﻛﺪ ﻣﻦ ﻋﺪﻡ ﻓﻘﺪﺍﻧﻬﺎ ﺃﻭ ﺗﻠﻔﻬﺎ ﻭﺍﻟﻤﺤﺎﻓﻈﺔ ﻋﻠﻰ ﺍﻟﺮﻗﻢ ﺍﻟﺴﺮﻱ ﻭﻋﺪﻡ ﺇﻓﺸﺎﺋﻪ ﻟﻠﻐﻴﺮ ﻓﻲ ﺃﻱ ﺣﺎﻝ ﻣﻦ ﺍﻷﺣﻮﺍﻝ‬.1
before others in any case whatsoever whereas Ooredoo shall not be held liable for any operations or transactions made by others. .‫ﻗﺎﻧﻮﻧﻴﺎ ﺃﻭ ﻣﺎﻟﻴﺎ ﻋﻦ ﺃﻳﺔ ﻣﻌﺎﻣﻼﺕ ﺃﻭ ﺍﺳﺘﺨﺪﺍﻣﺎﺕ ﺗﺘﻢ ﺑﻮﺍﺳﻄﺔ ﺍﻟﻐﻴﺮ‬
2. The Customer shall be held liable for using the SIM Card and secret code in person or by others.
.‫ ﻳﺘﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﺍﻟﻤﺴﺆﻭﻟﻴﺔ ﻛﺎﻣﻠﺔ ﻋﻦ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻟﺸﺮﻳﺤﺔ ﻭﺍﻟﺮﻗﻢ ﺍﻟﺴﺮﻱ ﺑﻮﺍﺳﻄﺘﻪ ﺃﻭ ﺑﻮﺍﺳﻄﺔ ﺍﻟﻐﻴﺮ‬.2
3. In the event the Customer lost the SIM Card or the mobile phone, he/she shall notify Ooredoo immediately by calling the Customer Service Center of Ooredoo in order to
clear his/her liability after suspending the service from the SIM Card. ‫ ﻭﻳﻌﻔﻴﻪ ﻫﺬﺍ ﺍﻹﺧﻄﺎﺭ ﻣﻦ ﺍﻟﻤﺴﺆﻭﻟﻴﺔ ﻋﻨﺪ ﺇﺗﻤﺎﻡ‬،Ooredoo ‫ ﻓﻲ ﺣﺎﻟﺔ ﺿﻴﺎﻉ ﺍﻟﺸﺮﻳﺤﺔ ﺃﻭ ﺿﻴﺎﻉ ﺟﻬﺎﺯﻩ ﺍﻟﻨﻘﺎﻝ ﻋﻦ ﻃﺮﻳﻖ ﺍﻻﺗﺼﺎﻝ ﺑﺨﺪﻣﺔ ﺍﻟﻌﻤﻼﺀ ﺍﻟﺨﺎﺻﺔ ﺑـ‬Ooredoo ‫ ﻳﻠﺘﺰﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺈﺧﻄﺎﺭ‬.3
.‫ﻓﺼﻞ ﺍﻟﺨﺪﻣﺔ ﻋﻦ ﺍﻟﺸﺮﻳﺤﺔ ﻓﻌﻠﻴﺎ‬
17. Amendments: ‫ ﺍﻟﺘﻌﺪﻳﻼﺕ‬.17
Ooredoo reserves the right to change or amend the provisions of the present Contract from time to time when necessary. Any change or amendment shall be binding to the ‫ ﻭﺇﻥ ﺃﻱ ﺗﻐﻴﻴﺮ ﺃﻭ ﺗﻌﺪﻳﻞ ﻻﺣﻖ ﺳﻴﻜﻮﻥ ﻣﻠﺰﻣﺎ ﻭﻧﺎﻓﺬﺍ ﺑﻤﻮﺍﺟﻬﺔ ﺍﻟﻌﻤﻴﻞ ﺑﻤﺠﺮﺩ ﺍﻟﻨﺸﺮ‬،‫ ﺑﺎﻟﺤﻖ ﻓﻲ ﺗﻐﻴﻴﺮ ﻭﺗﻌﺪﻳﻞ ﺃﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻣﻦ ﺣﻴﻦ ﺇﻟﻰ ﺁﺧﺮ ﻛﻠﻤﺎ ﺍﻗﺘﻀﺖ ﺍﻟﻀﺮﻭﺭﺓ‬Ooredoo ‫ﺗﺤﺘﻔﻆ‬
Client when published or announced by different media means or company's websites. .‫ﺃﻭ ﺍﻹﺧﻄﺎﺭ ﺑﻪ ﻋﺒﺮ ﻭﺳﺎﺋﻞ ﺍﻹﻋﻼﻡ ﺍﻟﻤﺨﺘﻠﻔﺔ ﺃﻭ ﻓﻲ ﻣﻮﺍﻗﻊ ﺍﻟﺸﺮﻛﺔ ﻋﻠﻰ ﺷﺒﻜﺔ ﺍﻹﻧﺘﺮﻧﺖ‬
18. Objections and Complaints: ‫ ﺍﻻﻋﺘﺮﺍﺿﺎﺕ ﻭﺍﻟﺸﻜﺎﻭﻯ‬.18
1. The Customer shall be entitled to object to the monthly due bills by submitting a written request to Ooredoo or calling the Customer Service Center on (121) within (28) days ‫( ﻳﻮﻣﺎ ﻣﻦ ﺗﺎﺭﻳﺦ‬28) ‫ ﺧﻼﻝ ﺛﻤﺎﻧﻴﺔ ﻭﻋﺸﺮﻳﻦ‬،121 ‫ ﺃﻭ ﺍﻻﺗﺼﺎﻝ ﺑﻤﺮﻛﺰ ﺧﺪﻣﺔ ﺍﻟﻌﻤﻼﺀ ﻋﻠﻰ‬Ooredoo ‫ ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ ﺍﻻﻋﺘﺮﺍﺽ ﻋﻠﻰ ﺍﻟﻔﻮﺍﺗﻴﺮ ﺍﻟﻤﺴﺘﺤﻘﺔ ﺷﻬﺮﻳﺎ ﻭﺫﻟﻚ ﻋﺒﺮ ﺗﻘﺪﻳﻢ ﻃﻠﺐ ﺧﻄﻲ ﻟـ‬.1
from the maturity date of the bill. In the event the Customer did not file any objection in this regard during the aforementioned period, it shall be considered as an ‫ ﻭﻳﻌﺘﺒﺮ ﻋﺪﻡ ﺍﻋﺘﺮﺍﺽ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﺍﻟﻔﺎﺗﻮﺭﺓ ﺍﻟﺸﻬﺮﻳﺔ ﺑﻌﺪ ﺇﻧﺘﻬﺎﺀ ﺍﻟﻤﺪﺓ ﺍﻟﻤﺸﺎﺭ ﺇﻟﻴﻬﺎ ﻫﻮ ﺇﻗﺮﺍﺭ ﻣﻨﻪ ﺑﺼﺤﺔ ﺗﻠﻚ ﺍﻟﻔﺎﺗﻮﺭﺓ ﻭﻻ ﻳﺤﻖ ﻟﻪ ﺍﻟﻤﻨﺎﺯﻋﺔ ﻓﻲ ﻗﻴﻤﺘﻬﺎ ﺑﻌﺪ‬،‫ﺇﺳﺘﺤﻘﺎﻕ ﺍﻟﻔﺎﺗﻮﺭﺓ ﺫﺍﺕ ﺍﻟﺼﻠﺔ‬
acknowledgment from his side stating that the bill is correct whereas no objections shall be accepted after the end of the aforementioned time limit.
.‫ﺍﻧﺘﻬﺎﺀ ﺗﻠﻚ ﺍﻟﻤﺪﺓ‬
2. The Customer shall be entitled to present a complaint regarding the service by submitting a written request to Ooredoo or calling the Customer Service Center on (121).
.121 ‫ ﺃﻭ ﺍﻻﺗﺼﺎﻝ ﺑﻤﺮﻛﺰ ﺧﺪﻣﺔ ﺍﻟﻌﻤﻼﺀ ﻋﻠﻰ‬Ooredoo ‫ ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ ﺃﻥ ﻳﻘﺪﻡ ﺷﻜﻮﻯ ﻋﻠﻰ ﺍﻟﺨﺪﻣﺔ ﻭﺫﻟﻚ ﻋﺒﺮ ﺗﻘﺪﻳﻢ ﻃﻠﺐ ﺧﻄﻲ ﻟــ‬.2
19. Force Majeure and Out of Control Circumstances: Ooredoo ‫ ﺍﻟﻘﻮﺓ ﺍﻟﻘﺎﻫﺮﺓ ﻭﺍﻷﻣﻮﺭ ﺍﻟﺨﺎﺭﺟﺔ ﻋﻦ ﺳﻴﻄﺮﺓ‬.19
Ooredoo may not be able to comply with the provisions of the present contract or to offer the service due to Out of Control Circumstances including but not limited to the ‫ ﺣﻴﺚ ﺗﺘﻀﻤﻦ ﻫﺬﻩ ﺍﻟﻈﺮﻭﻑ – ﻋﻠﻰ ﺳﺒﻴﻞ ﺍﻟﻤﺜﺎﻝ ﻻ ﺍﻟﺤﺼﺮ ﺍﻟﻘﻀﺎﺀ‬،‫ ﻗﺎﺩﺭﺓ ﻋﻠﻰ ﺍﻻﻟﺘﺰﺍﻡ ﺑﺄﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺃﻭ ﺗﻘﺪﻳﻢ ﺍﻟﺨﺪﻣﺔ ﻧﻈﺮﺍ ﻟﻈﺮﻭﻑ ﺧﺎﺭﺟﺔ ﻋﻦ ﺳﻴﻄﺮﺗﻬﺎ‬Ooredoo ‫ﺃﺣﻴﺎﻧﺎ ﻗﺪ ﻻ ﺗﻜﻮﻥ‬
following – act of God, delay or incompliance by others or natural disasters (such as weather, earthquakes, floods, fire) or intended disasters (turbulence, war, civil ‫ ﺍﻻﺿﺮﺍﺑﺎﺕ‬،‫ ﺍﻟﺤﺮﺏ‬،‫ ﺍﻟﺤﺮﺍﺋﻖ( ﺃﻭ ﺍﻟﻤﻔﺘﻌﻠﺔ )ﻣﺜﻞ ﺃﻋﻤﺎﻝ ﺍﻟﺸﻐﺐ‬،‫ ﺍﻟﻔﻴﻀﺎﻧﺎﺕ‬،‫ ﺍﻟﺰﻻﺯﻝ‬،‫ﻭﺍﻟﻘﺪﺭ ﺃﻭ ﺍﻟﺘﺄﺧﻴﺮ ﺃﻭ ﻋﺪﻡ ﺍﻻﻟﺘﺰﺍﻡ ﻣﻦ ﻗﺒﻞ ﺍﻟﻐﻴﺮ ﺃﻭ ﺍﻟﻜﻮﺍﺭﺙ ﺍﻟﻄﺒﻴﻌﻴﺔ )ﻣﺜﻞ ﺍﺿﻄﺮﺍﺑﺎﺕ ﺍﻟﻄﻘﺲ‬
disturbances, revolutions, properties confiscation, embargo, strikes, electrical defect, governmental procedures or any other resolution made by the competent Court). In such ‫ ﺍﻻﺟﺮﺍﺀﺍﺕ ﺍﻟﺤﻜﻮﻣﻴﺔ ﺃﻭ ﺃﻱ ﻗﺮﺍﺭ ﺗﺼﺪﺭﻩ ﺍﻟﻤﺤﻜﻤﺔ ﺍﻟﻤﺨﺘﺼﺔ( ﻓﻲ ﻫﺬﻩ ﺍﻟﺤﺎﻻﺕ ﻭﻏﻴﺮﻫﺎ ﻟﻦ ﺗﻘﻊ ﻋﻠﻰ‬،‫ ﺧﻠﻞ ﻓﻲ ﺍﻟﻜﻬﺮﺑﺎﺀ‬،‫ ﺍﻹﺿﺮﺍﺏ‬،‫ ﺍﻟﺤﻈﺮ ﺍﻟﺘﺠﺎﺭﻱ‬،‫ ﻣﺼﺎﺩﺭﺓ ﺍﻟﻤﻤﺘﻠﻜﺎﺕ‬،‫ ﺍﻟﺜﻮﺭﺍﺕ‬،‫ﺍﻟﻤﺪﻧﻴﺔ‬
cases, Ooredoo shall not be held liable for not providing the Customer with the service agreed upon in the Contract. Ooredoo will do everything possible to provide the
.‫ ﺩﺍﺋﻤﺎ ﻭﺑﺸﻜﻞ ﻣﻌﻘﻮﻝ ﻭﻓﻘﺎ ﻟﻬﺬﻩ ﺍﻟﻈﺮﻭﻑ ﺃﻥ ﺗﺴﺘﻌﻴﺪ ﺍﻟﺨﺪﻣﺔ ﺑﺄﺳﺮﻉ ﻭﻗﺖ ﻣﻤﻜﻦ‬Ooredoo ‫ ﻛﻤﺎ ﺗﺤﺎﻭﻝ‬.‫ ﻣﺴﺆﻭﻟﻴﺔ ﺗﻘﺪﻳﻢ ﺍﻟﺨﺪﻣﺔ ﻟﻠﻌﻤﻴﻞ ﺃﻭ ﺍﻧﻘﻄﺎﻋﻬﺎ ﺑﻤﻮﺟﺐ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬Ooredoo ‫ﻋﺎﺗﻖ‬
Customers with the service as fast as possible.
20. Duration: ‫ ﺍﻟﻤﺪﺓ‬.20
The Contract shall remain valid until either party decides to terminate it or replace it with another Contract or amend it in accordance with the enforced law. .‫ﻳﺒﻘﻰ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺳﺎﺭﻳﺎ ﺣﺘﻰ ﻳﺘﻢ ﺇﻧﻬﺎﺅﻩ ﻣﻦ ﻗﺒﻞ ﺃﺣﺪ ﺍﻟﻄﺮﻓﻴﻦ ﺃﻭ ﻳﺘﻢ ﺍﺳﺘﺒﺪﺍﻝ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺑﻌﻘﺪ ﺁﺧﺮ ﺟﺪﻳﺪ ﺃﻭ ﻋﻨﺪ ﺗﻌﺪﻳﻞ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﻓﻘﺎ ﻷﺣﻜﺎﻡ ﺍﻟﻘﺎﻧﻮﻥ ﺍﻟﻤﻄﺒﻖ‬
21. Applicable Law: ‫ ﺍﻟﻘﺎﻧﻮﻥ ﻭﺍﺟﺐ ﺍﻟﺘﻄﺒﻴﻖ‬.21
The Contract shall be subject to the laws enforced in the State of Kuwait. Any conflict which may arise in relation hereto shall be referred to the competent Kuwaiti Courts. .‫ﻳﺨﻀﻊ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻟﻠﻘﻮﺍﻧﻴﻦ ﺍﻟﻤﻄﺒﻘﺔ ﻓﻲ ﺩﻭﻟﺔ ﺍﻟﻜﻮﻳﺖ ﻭﺗﺨﺘﺺ ﻣﺤﺎﻛﻢ ﺩﻭﻟﺔ ﺍﻟﻜﻮﻳﺖ ﺑﺄﻱ ﻧﺰﺍﻉ ﻳﻨﺸﺄ ﻋﻨﻪ‬

In the event a contradiction was detected between the Arabic copy and English copy of the present Contract, the Arabic copy shall be prioritized over the English copy. .‫ﻓﻲ ﺣﺎﻝ ﻭﺟﻮﺩ ﺃﻱ ﺗﻌﺎﺭﺽ ﺑﻴﻦ ﺍﻟﻨﺴﺨﺘﻴﻦ ﺍﻟﻌﺮﺑﻴﺔ ﻭﺍﻹﻧﺠﻠﻴﺰﻳﺔ ﻟﻬﺬﺍ ﺍﻟﻌﻘﺪ ﺗﻜﻮﻥ ﺍﻟﻨﺴﺨﺔ ﺍﻟﻌﺮﺑﻴﺔ ﻫﻲ ﺍﻟﻤﻔﻀﻠﺔ‬
