A central act is assented to the President on 26 th Jan at 10:30 AM.
Discuss the
commencement of the said Act.
General Clauses Act (s.6)- The Act would legally commence at 00:00 hours (midnight) on
January 26th. The 10:30 AM time is relevant for when the process concludes, but the legal
start is effectively the beginning of that day, making it operational for the full day of January
26th.
Industrial Disputes Act provides that a party cannot be represented by a legal
practitioner before labour court, tribunal or national tribunal whereas the Advocates
Act confers the right to practice on every advocate before any authority. How to resolve
this clash? Decide with the help of suitable rule of interpretation
Generalia Specialibus Non Derogant (general provisions do not derogate from special
provisions)- When a specific law (ID Act) and a general law (Advocates Act) conflict over
the same subject matter (legal representation in industrial disputes), the specific law takes
precedence, unless the general law explicitly states an intention to override the special law
(which the Advocates Act does not).
Rajesh was held liable to be punished for contravening s.7 of the Prevention of Food
and Adulteration Act 1954 even though he had no guilty mind as he did not know that
food article was adulterated. He challenges his conviction. Decide with the help of
appropriate rule of interpretation.
Strict Rule of Interpretation- a statute should be interpreted according to its plain, literal, and
grammatical meaning. In the case of regulatory offenses, particularly those involving public
welfare like food safety, the courts often apply a strict interpretation to the language of the
law, focusing on whether the prohibited act occurred rather than the defendant's mental state
The Street Offences Act 1959 made it an offence for prostitutes to solicit customers in a
public place. Few prostitutes were charged under the law for soliciting public from
private premises in windows or balconies. Decide with reference to applicable rule of
interpretation of statues
Mischief Rule (Smith v. Hughes)- focus on the purpose of the Act which was to clean up
streets and prevent public harassment.
Workmen in an industry resorted to strike without giving notice of strike. In an
industrial dispute raised by trade union for wages during strike period, it was decided
by the labour court that the strike was ‘illegal’ and hence no wages are payable. Later,
employer filed a suit in a civil court claiming damages against the trade union for the
loss of business during strike period. Trade union argues civil court’s jurisdiction to
award compensation is ousted. Decide with reasons.
Presumption of Jurisdiction of Court- The Trade Union's argument is likely to fail. The Civil
Court has jurisdiction because the claim for damages for business loss from an illegal strike is
a separate, common law remedy not fully addressed by the Industrial Disputes Act, which
focuses on employment terms, not tortious losses.
