2.0 REQUIREMENTS FOR TECHNICAL PROPOSAL


BIDDER shall submit the complete TECHNICAL PROPOSAL in the Attachment
Section of SMART by GEP. Concurrently, BIDDER shall also extract and upload
the relevant portion of the technical proposal into the Questionnaire Section in
SMART by GEP.
BIDDER shall submit a Technical PROPOSAL which clearly describes all matters
that form part of BIDDER’s proposal, excluding prices. The Technical PROPOSAL
shall be in full compliance with the ITB and shall be prepared with the following

2.1 T1 – INTRODUCTION AND PURPOSE


BIDDER shall submit a cover letter introducing the BIDDER and stating its
purpose in this PROPOSAL based on the INVITATION TO BID (ITB). BIDDER shall
also submit their corporate/organisation profile in this section.

2.2 T2 – CLARIFICATION CORRESPONDENCES


BIDDER shall submit a complete copy of clarification correspondences and log
listing all correspondences between COMPANY and BIDDER during the bidding
period.

2.3 T3 – BIDDER’S DECLARATION


T3.1 – FORM OF TENDER
BIDDER is required to sign and submit the Form of Tender as per ATTACHMENT
1-2-1 (FORM OF TENDER).

T3.2 – BIDDER’S PARTICULARS


BIDDER shall provide the completed BIDDER’s Particulars as per ATTACHMENT
1-2-2 (BIDDER’S PARTICULARS) and to ensure all supporting documents are
attached. BIDDER is required to include any further details or information if
deemed required that will enable COMPANY to better understand the BIDDER’s
PROPOSAL.

T3.3 – STATEMENT OF COMPLIANCE


BIDDER shall indicate full compliance of its BASE PROPOSAL with the
requirements of the ITB by completing the Form of Compliance included as
ATTACHMENT 1-2-3 (STATEMENT OF COMPLIANCE).

T3.4 – STATEMENT OF QUALIFICATIONS/DEVIATIONS


BIDDER shall state qualification/deviation (if any) to the requirements of the ITB
by completing the Form of Qualifications/Deviations included as ATTACHMENT
1-2-4 (FORM OF QUALIFICATION/DEVIATIONS).
This includes any deviation/exception on the following subjects:

BIDDER may offer deviations; however, these must be consistent with the
essential requirements of the SPECIFICATIONS with the objective to provide for
lowest cost options and/or shorter schedule. The benefit to COMPANY shall be
elaborated in BIDDER’S proposal.
Any BIDDER’s ALTERNATIVE PROPOSAL containing such deviations that are not
in the 'Statement of Deviations' may be disqualified and rejected by
COMPANY.

T3.5 – SECRECY DECLARATION


BIDDER is required to sign the Secrecy Declaration as per ATTACHMENT 1-2-5
(SECRECY DECLARATION).

T3.6 – INSPECTION OF SITE


BIDDER shall confirm in ATTACHMENT 1-2-6 (INSPECTION OF SITE) that the
BIDDER shall be deemed to have inspected and examined the SITE and to have
full and complete knowledge of the conditions existing along the SITE and its
surroundings and to have satisfied itself as to the nature of the ground and to
have taken into account any information in connection therewith including but
not limited to the following:
1. SITE conditions, layout and accessibility;
2. Presence and proximity of structures and adjacent facilities that may affect
or interfere with construction, e.g. buildings, piping, pipelines, drainage,
road, ditches, canals, power transmission lines, etc.;
3. availability of utilities such as water, power, telecommunication;
4. availability of transportation facilities and access;
5. Tie-ins requirements and locations;
6. local environmental conditions and seasonal weather pattern;
7. availability of local workers and suppliers of goods and services;
8. local trade practices, customs and laws;
9. requirements of all local, government and regulatory authorities;
10. Health, safety and environmental requirements and construction
techniques; and
11. Laydown and storage area

T3.7 – LITIGATION HISTORY

BIDDER shall declare if BIDDER is currently and/or in the last five (5) years been
involved in litigation. The declaration shall be stated in the ATTACHMENT 1-2-
2 (BIDDER’S PARTICULAR) of this Article. If BIDDER is currently involved in
litigation, the details shall be provided to COMPANY accordingly.

BIDDER shall provide details of any potential or actual or threatened litigation,


arbitration or other disputes (including industrial tribunal actions) affecting your
company or any person for whose acts of defaults your company may be
vicariously liable which, to your company’s knowledge (whether in Malaysia or
elsewhere) is currently involving your company or such other person, or is
contemplated, or foreseeable.

T3.8 – MALAYSIAN PARTICIPATION


BIDDER shall provide a specific breakdown of the Malaysian Participation of its
PROPOSAL in accordance with ATTACHMENT 1-2-7 (BREAKDOWN OF
MALAYSIAN PARTICIPATION).
BIDDER shall complete the forms in ATTACHMENT 1-2-7 (BREAKDOWN OF
MALAYSIAN PARTICIPATION) by providing PROPOSAL content by percentage
for each scope of WORKS or scope of supply as appropriate. BIDDER shall not
duplicate any figures shown on such forms so that summation of all percentages
shown shall add to 100%.

BIDDER, as much as possible, shall maximize Malaysian Participation pa in the


manpower involved throughout the CONTRACT PERIOD.

T3.8A – FOREIGN LABOUR AT SASARAN PENTING NEGARA

Further to the breakdown of Malaysian Participation captioned in T3.8 above,


BIDDER, where applicable, shall provide additional breakdown of Foreign
Content of its PROPOSAL in accordance with ATTACHMENT 1-2-7A
(BREAKDOWN OF FOREIGN CONTENT AT SASARAN PENTING NEGARA).

The proposed Foreign Content shall comply with the requirements stipulated by
the Malaysian Ministry of Home Affairs in accordance with Jawatankuasa Pusat
Sasaran Penting (JPSP) Directive 2012 as well as all laws and regulations related
to and/or in connection with JPSP Directive 2012.

BIDDER, as much as possible, shall maximize Malaysian Participation in the


manpower involved throughout the project execution.

T3.9 – KNOW YOUR CUSTOMER (KYC) QUESTIONNAIRE

BIDDER shall complete and submit the KYC Questionnaire as appended in


ATTACHMENT 1-2-21 (KYC QUESTIONNAIRE).

2.4 T4 – PERFORMANCE BOND AND PARENTAL GUARANTEE

T4.1 – LETTER OF UNDERTAKING FOR PERFORMANCE BOND


BIDDER shall submit a letter of undertaking to provide the Performance Bond
from the Bank in the format in ATTACHMENT 1-2-8 (LETTER OF
UNDERTAKING FOR PERFORMANCE SECURITY – PERFORMANCE BOND).
Alternatively, BIDDER may submit Letter of Undertaking for Performance Bond
from the BIDDER with supporting letter from the Bank.

The value of the Performance Bond shall be five percent (5%) from the
CONTRACT PRICE.

T4.2 – LETTER OF UNDERTAKING FOR PARENTAL GUARANTEE

If BIDDER relies on its parent for any part or performance of the WORKS or when
requested by COMPANY, BIDDER shall submit a letter of undertaking to provide
Parental Guarantee (if any) in the format specified in ATTACHMENT 1-2-9 :
LETTER OF UNDERTAKING FOR PARENTAL GUARANTEE.

2.5 T5 – BIDDER BACKGROUND AND EXPERIENCE

T5.1 – BIDDER EXPERIENCE

BIDDER shall complete and submit the summary of Bidder experience as


appended in ATTACHMENT 1-2-10 (SUMMARY OF COMPANY EXPERIENCE).

BIDDER shall provide a copy of a Letter of Award, Purchase Order or Agreement


indicating the required the above experience.

T5.2 – PROOF OF PARTNERSHIP COMMITMENT

In the event that BIDDER will be participating as a Joint Venture or Consortium,


BIDDER shall submit a signed JV/Consortium agreement between all members
of the Joint Venture or Consortium. The agreement shall clearly indicate each
party commitment in undertaking the works should BIDDER be awarded and
clearly demonstrate the demarcation of works between the parties.

T5.3 – DELEGATION OF AUTHORITY (If Applicable)

In the event that BIDDER will be participating as a Joint Venture or Consortium,


BIDDER shall provide a Letter of Delegation of Authority stating the personnel
authorized on behalf of the Joint Venture or Consortium.

2.6 T6 – PROJECT EXECUTION PLAN

BIDDER shall have submitted the Project Execution Plan (PEP) of the WORK.
BIDDER shall update as necessary the PEP. The content of the PEP shall be
reviewed and approved by COMPANY. The PEP shall address the following as
minimum:
• General project execution;
• PROJECT scope;
• Organisation chart and resource plan
The PEP shall also explain the key principals of the following PROJECT Activities:
• Project Management Plan
• PEP Objectives
• Summary of PEP
• Project objectives
• Engineering Execution Plan
• Procurement & Subcontracting Execution Plan
• Construction Execution Plan
• Pre-Commissioning & Commissioning Execution Plan
• Organization Chart
• Risk Management Plan
• Interface Management Plan
• Permitting Plan
• Project Close-Out & Handover Plan
• HSSE Management Plan
• Quality Management Plan
• Regulatory Approval Plan
• Project Control and Reporting Plan

Further instructions relating to each of the above topics are in accordance


with EXHIBIT 2 - SUMMARY SCOPE OF WORKS

The CONTRACTOR shall indicate and specify its strategies to successfully,


execute the WORK. CONTRACTOR shall comply with these requirements
during the execution of the WORK.

T6.1 – PROJECT ORGANISATION

BIDDER shall submit a chart indicating the overall organisation that are proposed
for the execution of the WORKS.

BIDDER shall provide organisation charts for all the positions and personnel that
BIDDER will provide for each phase of the PROJECT from EFFECTIVE DATE of
CONTRACT until completion of PROJECT. The organisation charts detailing the
positions to support each function shall be accompanied by a manpower
projection plan defining the planned duration for each position. The organisation
chart shall consist but not limited to the following:

2. Engineering Manager
3. Construction Manager
4. QAQC Manager
5. Commissioning Manager
6. Safety Health Officer (SHO)
7. Environment Officer (EO)
8. Pipeline Designer
9. Project Engineer

The chart shall show detailed organization indicating availability of Engineering,


Procurement, Construction and Commissioning and shall include the Quality
Assurance, and Health, Safety and Environment (HSE) functions.

BIDDER shall provide a full explanation of the lines of reporting, authority and
communication within:

1. Parent/ corporate organisation for each Joint Venture/Consortium


members as required in Section 1 Part 1: Instruction to Bidders.

2. BIDDER's proposed Consortium/Joint Venture PROJECT organization

3. BIDDER's proposed PROJECT organisation for each of the following:-


a. Engineering phase
b. Procurement phase

c. Construction phase

d. Commissioning phase

BIDDER shall include the following:

1. A description of the PROJECT Management Organisation for all locations


where the WORK is to be carried out during all phases of the PROJECT
including all involvement of the Consortium members, sub-consultant etc.
BIDDER shall provide an Organization Chart to identify key management and
support personnel for the proposed organisation for each location where the
WORK is performed. BIDDER shall clearly identify which key personnel are
full time and those, which are part-time in the proposed organisation.

2. Understanding of the key issues and identification of the critical success


factors for PROJECT organisation during Engineering, Procurement,
Construction and Commissioning to meet the requirements of the
PROJECT.

3. Role and responsibilities of the key personnel and highlight the changes in
the roles and responsibilities through the various stages of the PROJECT to
ensure successful execution or WORKS.

4. Approach to communication and co-ordination with the different work


locations and its proposal to ensure that quality and consistency are
maintained throughout the work centres and through all phases of the
PROJECT.

5. Details of any proposal to SUBCONTRACT any part engineering, or assign


work to subsidiary or affiliate companies.

6. Proposed method and procedure describing the transfer of roles and


responsibilities between all phases (engineering, construction,
commissioning and handing over to COMPANY) will be executed.

7. Details regarding the mobilisation and demobilisation of its PROJECT


Organisation.

8. BIDDER shall indicate firmly the Joint Venture/Consortium Leader (if any) and
shall describe roles and responsibilities of the Leader in all phases of project
executions.

BIDDER shall provide resumes of the for the required KEY PERSONNEL in the
table showed below. The resume shall show the name with photo, age (in years),
nationality, proposed position for the Project, current position and duration in
position and description, responsibilities, authority, qualification and experience

T6.3 – BASIC ENGINEERING DESIGN (BED) AND SITE VERIFICATION

COMPANY has made a diligent effort to ensure the accuracy of the drawings,
data sheets, specifications, codes and standards. However, their accuracy is not
guaranteed and BIDDER is responsible to check, verify and advice COMPANY
should there be any changes, to complete the WORKS.

Information such as parameters, numbers, figures and size in documents of


SECTION 2-1: (SCOPE OF WORKS) are minimum requirements. BIDDER shall
do sufficient engineering at the bid stage to ensure that the design is appropriate.

The BED document and drawings as included in the ITB are indicative only of the
magnitude of the WORKS and the arrangement of the equipment, as anticipated
by COMPANY. They are of a preliminary nature and in no way are to be
considered “Approved for Construction.”

BIDDER shall state and elaborate their understanding of the BED documents and
drawings during PROPOSAL preparation.

In the Report Summary, BIDDER to demonstrate that they have performed a


preliminary engineering as part of their PROPOSAL to demonstrate BIDDER’s
engineering competency, confirm acceptance of COMPANY design basis, data
and supplied material, and to establish technical basis for BIDDER’s Commercial
Proposal. BIDDER, hereunder, confirm that they have:

1. Checked and verified all data and designs during this verification report and
confirm acceptance of same;

2. Confirm BED data completeness and suitability for further development


Detailed Engineering Design Package;

3. Deemed to have made all due allowances, within their CONTRACT PRICE,
schedules and Scope of Work for the WORKS.

BIDDER shall state compliance to this requirement and elaborate in BIDDER’s


execution plan.

T6.4 – COMPLIANCE TO SPECIFICATIONS, CODES AND STANDARDS

BIDDER shall ensure that BIDDER has read, understood and fully comply
with the Specifications, Codes and Standards as specified in SECTION 2-1:
(SCOPE OF WORKS) and SECTION 2-2: (TECHNICAL REQUIREMENTS). Any
deviation shall be highlighted in ATTACHMENT 1-2-4 (FORM OF
QUALIFICATION & DEVIATIONS).

T6.5 – DETAILED ENGINEERING DESIGN

BIDDER shall provide a detailed overall engineering plan for each discipline i.e
Process, Mechanical, Piping, Civil & Structural, Instrument & Control, and
Electrical. The plan shall describe all activities and explain the execution of
detailed engineering and as a minimum include but not limited to the followings:

1. Execution Plan covering Overall Project Engineering and all other


engineering and design resources for the proposed organization for each
phase of the PROJECT.
2. Interface between disciplines within Engineering Team.
3. Understanding of the key engineering issues and identifies the critical
engineering success factors.
4. Document Control System which includes the methods by which design
documentation and Vendor documentation will be handled.
5. Planning and implementation of stringing activities for dimensional control
e.g. Surveys etc. in completing the Engineering activities.
6. Description of engineering / design consistency checking process and the
different phases of engineering in terms of procedure, work practices and
systems.
7. Proposed list of detailed design deliverables e.g. list of Approved for
Construction (AFC) drawings and documents.

T6.6 – PROCUREMENT PLAN

BIDDER shall provide a detailed Procurement Plan in accordance with EXHIBIT


6 (PROCUREMENT) of SECTION 2-1: (SCOPE OF WORKS) and summary which
describes the main features of the procurement execution plan including:
1. BIDDER’s Procurement Organization Chart shows line of authority and
communication within Project Organization Chart with clear scope of work
and function. Bidder’s procurement organization shall demonstrate
adequacy of its manpower resource and ability to execute procurement
function of major equipment and long lead items as well for sub-
contracting services.
2. Details of all pre-award procurement strategy including sourcing from
Malaysian and non-Malaysian vendors. BIDDER shall also observe the
requirements on Category Items.

3. Description to indicate that BIDDER’s selection of vendors for procurement


and subcontracting equipment, materials, items/services in compliance with
ITB requirements including subcontractor list and major equipment
suppliers.
4. A description of post-award procurement strategy including expediting,
inspection, delivery, custom clearance, storage, spare parts and handling of
EQUIPMENT, material and supplies.
5. A list of proposed vendor or suppliers together with the specific brand and
manufacturing origin of all EQUIPMENT shall be provided. Based on the list
submitted BIDDER to identify major and long lead EQUIPMENT for this
PROJECT. BIDDER shall provide the list of all major items/vendor(s)/sub-
contractor(s) to be used in the PROJECT.
6. Material control and surplus and scrap management.

T6.7 – PROCUREMENT AND SUBCONTRACTING

BIDDER shall not subcontract the Project Management scope.

BIDDER shall provide full details of any proposal to SUBCONTRACT any part or
WORK to subsidiary, affiliate companies or other parties in accordance to
provisions set forth in the SECTION 2-A (GENERAL TERMS AND CONDITIONS)
and EXHIBIT 6 (PROCUREMENT) of SECTION 2-1 (SCOPE OF WORKS).

BIDDER shall list all proposed PROCUREMENT AND SUBCONTRACTING or


each scope of WORKS and the contracting strategy in Sub-contracting Plan.
SUBCONTRACTORS & VENDOR for main packages to submit detail of its
company information using the same attachment for Bidders Particular
ATTACHMENT 1-2-2 (BIDDER PARTICULARS) and to ensure all supporting
documents are attached accordingly.

The final selections of PROCUREMENT AND SUBCONTRACTING are subject to


COMPANY approval. BIDDER shall describe the subcontractor’s & VENDOR’s
capability and experience that would qualify them to carry out such the
subcontracted WORKS.

Any vendors / subcontractor list shall be highlighted in ATTACHMENT 1-2-


14 (VENDOR / SUBCONTRACTOR LIST).

T6.8 – MOBILISATION, SET-UP AND DEMOLISATION PLAN

BIDDER shall describe the location planned for its engineering, procurement,
fabrication, and testing including the fabrication yard/ warehouse/ office
location. BIDDER to submit information on its office, warehouse and fabrication
yard ownership, location, equipment and facilities.

BIDDER shall also in detailed describe the site mobilisation and demobilisation
including planning in establishing the site facilities.

T6.9 – CONSTRUCTION PLAN

BIDDER shall demonstrate his capability to undertake the WORKS by providing


the construction sequence and any special construction techniques that will be
used to undertake the WORKS.
The Construction Plan shall be practical and with sufficient detail to demonstrate
the sequence of construction activities including at minimum:

a. Site mobilisation plan including manpower and equipment deployment


to SITE, graphical and written description of site layout, main site access,
proposed temporary laydown area, material storage area, and
construction material;

b. Piping fabrication, civil and piping works, tie-in, installation of USM, GC


and valves, construction of new GMS and tie-in and modification works
at existing KOC and BOC SCADA system.

c. BIDDER shall provide detailed construction plan to demonstrate the


practical sequence, proven method and proper coordination for the
WORKS.

BIDDER shall assess the SITE conditions, provide its assessment on the
constructability and identify construction requirements and methods for the
work execution.

BIDDER to identify suitable construction method specific to each location


including consideration on the following;

a) Pre-requisite prior to construction commencement:

i. Site preparation;
ii. Traffic management, access to ROW (referring to road
reserve and utility corridor also) and laydown, temporary
access/road diversion for public;

of the COMPANY’s supplied item.

T6.10 - PROJECT CONTROL PLANNING PACKAGE

T6.10.1 – PROJECT PLANNING PLAN

BIDDER shall provide the detailed documentation developed for the PROJECT
with all the information necessary to establish, monitor and control all the
various functions and activities required to complete the PROJECT to meet the
SCHEDULE. This shall include a description by BIDDER of how the WORKS has
been scheduled to complete the PROJECT in line with PROJECT
SPECIFICATION.

BIDDER shall provide a description of BIDDER’s proposed PROJECT reporting


methods and progress measurement procedures to be applied during the
execution of the PROJECT in-line with EXHIBIT 4: PROJECT CONTROL AND
REPORTING

Submission shall include:


1) Description of overall project control planning and reporting for the
project.
2) Work Breakdown Structure (WBS) demonstrating understanding of the
scope. The WBS shall include all Phases, Scope, Discipline and Elements.

The Project SCHEDULE shall have sufficient details (activities and key

4) Critical Path Network (CPN) in diagrammatic network. Minimum critical
path schedule with resource loading.
5) Resource Management e.g. histogram showing direct and indirect
manpower (with trade) and equipment.
6) Progress Measurement and progress measuring method with sample work
progress measurement for each phase of the PROJECT i.e. PM, E, P, C, C.
7) S-Curve for each phase i.e. PM, E, P, C, C and Overall with weightage
distribution.
8) Schedule Basis Memorandum - to document all planning assumptions,
decisions, scope of WORKS, agreed milestones used in the preparation of
the schedule which is like a document forms the framework on which the
Project SCHEDULE is built, documenting the premises, assumptions,
exceptions, and exclusions represented in the Project SCHEDULE
9) Productivity Norms used in the proposed project schedule as per
Attachment (ATTACHMENT 1-2-15 a) WORK BREAKDOWN STRUCTURE

10) Weekly Reporting and Monthly Progress Report Template as similar to

T6.10.2 – PROJECT SCHEDULE

BIDDER shall submit the Project Schedule (Level 3) and meet PROJECT duration
within 44 months (shall refer to EXHIBIT 3 SCHEDULE OF WORK) with
optimized sequences of activities to demonstrate the ability to complete works
and overall schedule for planning purposes in developing of the proposed
schedule, BIDDER can assume CONTRACT shall be effective on QUARTER 1
(Q1) 2024.

BIDDER shall prepare and submit the following schedules in Primavera P6


format:

i. Overall Project Schedule which includes the overall planning of the


project from the day of award to the completion of the PROJECT. The
schedule shall consist of major activities (but not limited to) such as
Engineering, Procurement, Construction, MECHANICAL COMPLETION,
COMMISSIONING, INITIAL ACCEPTANCE and FINAL ACCEPTANCE. The
activities in the schedule shall be properly sequenced, resource loaded
and complete analysis of critical path activities.

ii. Project Schedule which includes the detail of all construction activities,
BIDDER shall demonstrate its understanding on the execution of WORKS
and the plans to achieve the completion of WORKS. The activities in the
schedule shall be properly sequenced, resource loaded and complete
analysis of critical path activities. The schedule shall be of a minimum
LEVEL 3 Work Breakdown Structure (WBS).

BIDDER shall use ATTACHMENT 1-2-11 (WORK BREAKDOWN STRUCTURE


(WBS)) to detail out all the proposed WBS. The WBS shall include all Phases,
Plants, Scopes, Disciplines and Elements. This is required to demonstrate that
has a full appreciation of the scope of the WORK.

BIDDER schedule shall take in consideration the plant Shutdown Schedule.

BIDDER shall consider the followings constraints / windows and indicate in the
PROJECT SCHEDULE:-

a) Monsoon season
b) Other construction activities during Turnaround of the plants (if Applicable)
c) Festive seasons
d) Regulatory requirements
e) Existing plant & facilities requirements and compliances

BIDDER shall submit a complete table of Manpower Planning from day one of
the project until the Final Documentation submission. The table shall consist of
labour requirements showing category-wise break-up of the labour force and
productivity, for each month of execution period.

BIDDER shall submit the direct/indirect manpower loading by discipline/trade in


the specified format in ATTACHMENT 1-2-15 b) (MANPOWER LOADING AND
EQUIPMENT LOADING).

T6.11 - COMMISSIONING AND PERFORMANCE TESTING PLAN

The COMMISSIONING plan shall demonstrate the sequence of commissioning


activities including, but not limited to;

1. COMMISSIONING Organisation Chart that indicate the number and


classification of personnel (including VENDOR’s personnel) to be involved,
their organisation and responsibilities. CONTRACTOR shall demonstrate to
COMPANY that its proposed key personnel are skilled and experienced in
the COMMISSIONING of utility facilities;

2. Procedures for the co-ordination of the COMMISSIONING of the


FACILITIES.

3. VENDOR support plan and Mobilisation/Demobilisation schedule.

4. COMMISSIONING schedule, including activity descriptions, highlighting


the sequence of COMMISSIONING, any construction predecessors and
durations;

5. EQUIPMENT required;

6. Tests to be carried out that will verify the design function and performance
of EQUIPMENT, COMPANY systems, control systems and safety systems.
This shall include site performance tests of the FACILITIES;

BIDDER shall provide the COMMISSIONING Execution Plan which shall include
COMMISSIONING programme, COMMISSIONING planning and schedule,
COMMISSIONING team organisation, COMMISSIONING risk assessment,
performance test programme, training programme and Operation and
Maintenance Manual.

COMMISSIONING and PERFORMANCE TEST which shall include manpower


histogram showing planned manpower levels for each month of
COMMISSIONING by process or plant unit, skill group category, inclusive of
categories for supervision, vendor interfacing and field office staff.

BIDDER shall describe how the performance of each FACILITIES will be carried
out during COMMISSIONING and PERFORMANCE TEST phase. The
COMMISSIONING and PERFORMANCE TEST plan shall be practical and have
sufficient detail to demonstrate the sequence of COMMISSIONING and
PERFORMANCE TEST activities.

BIDDER shall provide preliminary and sufficient information of EQUIPMENT and


tools to be used during COMMISSIONING and PERFORMANCE TEST. BIDDER
shall provide preliminary criteria of acceptance for COMMISSIONING and
PERFORMANCE TEST activity and testing methods for assessing the acceptance

PERFORMANCE TEST shall be the responsibility of BIDDER.

BIDDER shall assist and provide the evidence for Pre-Activity Safety Review
(PASR) programme.

BIDDER shall provide a description of the training envisaged for Operation and
Maintenance Personnel as part of its handover plan including VENDOR and start-
up trainings.

BIDDER shall provide a description on handling/disposal procedures for waste


generated during COMMISSIONING and PERFORMANCE TEST activities.

T6.12– PROPOSED MANPOWER & EQUIPMENT LOADING

BIDDER shall submit overall project manpower and EQUIPMENT loading


showing planned manpower and man-hour level by skill category, type of
EQUIPMENT (own, rental and to be purchased) and numbers of EQUIPMENT
required, which is sufficient for execution at all phase of the WORKS.

BIDDER shall provide manpower loading histograms showing the total


manpower available for the Engineering, Procurement, Construction and
Commissioning, Defects Liability Period phases of the WORKS.

BIDDER shall state its current and anticipated workload compared to available
resources for the 56 MONTHS. BIDDER’s submission shall include the following
as a minimum:-

1) Project description;

2) Project value;

3) Man-hours utilization;

4) Project duration;

5) Expected to complete;

6) Project location; etc.

T6.13 – TRAINING PLAN

BIDDER shall provide a description of the training program envisaged for


COMPANY personnel. The description shall include a proposed SCHEDULE of
training activities and the locations of the proposed training activities.

BIDDER shall provide a description of the training envisaged for Malaysian


workers who will be utilized in the execution WORK.

BIDDER shall identify a qualified individual who will be dedicated to carry the
responsibility of coordinating and reporting to COMPANY on the planning, status
and progress of the Training Program. BIDDER shall propose the Training
Program and the frequency accordingly.

T6.14 – RISK MANAGEMENT PLAN

BIDDER shall provide the information on the best practices on how BIDDER
manages the anticipated risk face during execution of this PROJECT. Apart from
BIDDER’s best practices, BIDDER shall provide the plan on the BIDDER’s
personnel participation and assistance to COMPANY in COMPANY’s Value
Management Programs. The Value Management Programs will cover the
following but not limited to;

1) Project Risk Assessment

2) Project Independent Review and Peer Review Session

3) Constructability reviews

4) Smooth Start Up Program (SSP)

5) CONSTRUCTION Risk Assessment

T6.15 – REGULATORY APPROVAL PLAN AND LIAISON WITH OTHER


PARTIES

BIDDER to confirm compliance with relevant Malaysian Government


Regulations and Local Authorities e.g. Fire Department, DOSH, DOE, EC etc.

BIDDER shall provide an outline description of the plan to manage and control
the regulatory approvals processes. The outline plan should be sufficiently
detailed to enable COMPANY to be assured that the activity will be expeditiously
handled and cordial relationships will be maintained with the regulatory agencies
involved.

BIDDER’s submission shall include the list of approvals to be requested and


obtained by BIDDER from any government and/or local authorities required for
the PROJECT.

BIDDER comply and responsible for securing all necessary permits and ensuring
all regulatory requirements are met i.e. Site Registration, Blasting etc. BIDDER
shall develop the Regulatory Approval Plan as per ATTACHMENT 1-2-16
(TEMPLATE FOR REGULATORY PLAN).

BIDDER shall also describe its plan in liaising with various other parties such as
other contractor appointed by COMPANY related to the PROJECT.

T6.16 - QUALITY MANAGEMENT PLAN

BIDDER shall submit a copy of a valid ISO 9001 quality certification in which
covers the project scope. If BIDDER is a joint venture or consortium, each key
member of the JV / consortium shall have its own quality certification.

BIDDER shall submit a Project Quality Management Plan (PQMP) that contain
the overview of how the quality planning, quality assurance program, and quality
control activities are being organized and implemented to meet requirements.

The following items shall be included in the Project Quality Management Plan;

1) Project Quality Policy statement

2) PROJECT quality objectives

3) Quality organisation chart- which shows Quality Manning levels of the


BIDDERS covering Quality Manager, Quality Engineers and Inspectors.

6) PROJECT Procedures – a list of set of plans and procedure to demonstrate


compliance with the PROJECT SPECIFICATION and the requirements of

14) PROJECT Audit – a preliminary audit schedule , which includes audit


activities in accordance with the timing of activities set within the PROJECT
schedule. In addition, the PROJECT audit schedule shall identify separately
the key SUBCONTRACTOR, VENDOR that the BIDDER intends to audit

BIDDER shall also submit an uncontrolled copy of a previous Quality Plan in its
PROPOSAL.

BIDDER shall provide its shop inspection plan on the approach to facilitate
factory inspections detailing the inspection level relating to specific equipment
and the authorisation process which shall include interfacing with the COMPANY
and any third party engaged

BIDDER shall provide its Clean Built Program on maintaining a clean build in
respect to pipeline, piping and equipment. This shall include measures for
cleaning during fabrication of piping, transportation of piping spool and
EQUIPMENT, pipeline construction, preservation at site. The program shall
include methods proposed to clean the pipeline with acceptance criteria.

BIDDER shall provide proposed overall Inspection Test Plan (ITP) for this
PROJECT. The proposed ITP shall include inspection requirement as specified in
relevant specification, codes and standards in this ITB. BIDDER shall also provide
the plan on the BIDDER’s personnel participation in the inspection activities of
this PROJECT.

BIDDER shall submits its Quality Records of Pipeline, Piping welding rejection
rate (by joints and length) from previous projects for the past 3 years.

2.7 T7 – HEALTH, SAFETY AND ENVIRONMENT

T7.1 – HSE EXECUTION PLAN


BIDDER shall comply with COMPANY standard HSE contract clause in EXHIBIT
11 (HSE REQUIREMENTS) of SECTION 2-1 (SCOPE OF WORKS) and submit
BIDDER’s concurrence as per ATTACHMENT 1-2-17 (HSE COMPLIANCE
FORM).
The HSE Plan shall be comprehensive and in accordance with the ITB
requirements and demonstrates that the Bidder understands and will implement
a comprehensive HSE Plan.

Bidder shall provide the followings:

T7.2 - HSE PERFORMANCE RECORD


BIDDER shall submit its safety record including Loss Time Injury Frequency (LTIF)
and Regulatory non-compliances for their previous projects for the past 3 years
that BIDDER has implemented. The record must show good safety performance
from their previous projects.

BIDDER shall provide the following typical documents for COMPANY’s
assessment on BIDDER’s understanding on the scope of WORKS:

2.9 T9 – FINANCIAL CAPABILITY

T9.1 – PROJECT FINANCING PLAN

BIDDER shall submit a Project Financing Plan. BIDDER shall in detail describe the
methods used to finance the project.

T9.2 – FINANCIAL STATEMENT


BIDDER shall submit copies of its company’s latest audited financial statements
and copies of those for its parent or affiliated company and any other
background information which would be helpful in the analysis of its company
for the past three (3) years. BIDDER shall also submit proof of available existing
credit facilities and Statement of Accounts for the past six (6) months.
BIDDER shall submit the status of credit facilities as per ATTACHMENT 1-2-19
(SAMPLE OF CREDIT FACILITIES) which to be duly endorsed by the issuing
bank.

2.10 T10 – UNPRICED COMMERCIAL


BIDDER shall include in its Technical PROPOSAL an Un-priced copy of its
Commercial PROPOSAL including any cover letters, comments or conditions
included with the Commercial PROPOSAL.
The copy shall be an exact copy and complete set of the Commercial PROPOSAL
with the exception of the prices which shall not be shown. Instead, against each
line item, BIDDER shall insert “Priced” or “Un-priced” whichever is applicable to
correspond with the priced copy of the Commercial Proposal. Failure to comply
with the requirement may cause BIDDER’s PROPOSAL to be rejected.
No prices or cost are to be shown in the Technical and Un-priced PROPOSAL.

2.11 T11– ALTERNATIVE PROPOSAL


BIDDER shall detail all proposed alternatives, if any, and summarize on the
Summary of Alternatives form, ATTACHMENT 1-2-20 (SUMMARY OF
ALTERNATIVES). Any alternatives not included in ATTACHMENT 1-2-20
(SUMMARY OF ALTERNATIVES) will not be considered by COMPANY.
BIDDER shall submit proposal meeting the requirement of ITB as BASE
PROPOSAL. However, BIDDER is encouraged to submit ALTERNATIVES
PROPOSAL that could bring advantage or value creation in case it will result in,
for example lower cost, faster delivery, ease of fabrication etc. COMPANY
reserve its right to accept or not to accept the proposed ALTERNATIVE
PROPOSAL.
