Introduction of Parties
The present Written Submission arises from a mock conciliation hearing concerning an indus-
trial dispute between Millennium Ltd. an automobile manufacturing establishment, and Ms.
Renuka, an assembly line worker.
The Management was represented by its Top Management Representative, Human Resources
Manager, and Site Supervisor. The Workman was represented through the Trade Union, and a
co-worker appeared as an eyewitness. The proceedings were conducted before the Conciliation
Officer in accordance with the applicable labour law framework.
Nature of the Industrial Dispute
The industrial dispute pertains to the denial of accident-related benefits, including payment of
wages during a medically certified rest period and reimbursement of medical expenses, follow-
ing an injury sustained by the workman during working hours on the assembly line.
The injury, though temporary in nature, required three months’ medical rest, resulting in loss
of income. The Management initially declined paid medical leave and full reimbursement on
the basis of internal policy, leading to dissatisfaction among workers and disruption of indus-
trial harmony.
Purpose of Initiating Conciliation Proceedings
The conciliation proceedings were initiated to resolve the dispute amicably and without adju-
dication, while ensuring fairness to the injured workman and maintaining industrial peace.
The objectives of conciliation were to:
Address the workman’s grievance regarding wages and medical expenses
Facilitate dialogue between the Management and the Workmen
Prevent escalation of the dispute
Promote harmonious employer - employee relations

Background of Dispute
Whereas Ms. Renuka, an assembly line worker employed with Millennium Ltd. sustained an
injury during working hours while performing her assigned duties on the assembly line due to
a sudden malfunction and stoppage of machinery;
And whereas the said injury occurred on the factory premises and during the course of employ-
ment, and the workman was immediately provided medical assistance;
And whereas upon medical examination, the workman was advised three months’ rest, the in-
jury being certified as temporary in nature;
And whereas due to the medically certified rest period, the workman suffered loss of wages
and incurred medical expenses, and the Management initially declined to grant paid medical
leave and full medical reimbursement on the basis of internal policy considerations;
And whereas the denial of the aforesaid benefits gave rise to disputes and differences between
the Management and the Workman, which were taken up through the Trade Union;
And whereas the said dispute was taken up for conciliation before the undersigned Conciliation
Officer with a view to arrive at an amicable settlement;
And whereas meetings were conducted between the parties during the conciliation proceedings
to resolve the issues in dispute;
Proceedings
Both parties appeared before the Conciliation Officer and actively participated in the concilia-
tion proceedings.
The Conciliation Officer heard submissions from the Workman, the Trade Union Representa-
tive, the Management representatives, and considered the circumstances leading to the acci-
dent, the medical advice tendered, and the positions adopted by both sides.
The Conciliation Officer facilitated discussions, restrained interruptions, encouraged construc-
tive dialogue, and guided the parties towards negotiation and compromise with the objective
of preserving industrial peace and harmonious relations.
After discussions and negotiations conducted in good faith, the parties voluntarily arrived at a
full and final settlement of all the issues arising out of the said incident.

Terms of Settlement
The parties mutually and voluntarily agree to the following terms:
1. Payment of Dues:
The Management shall pay full wages to Ms. Renuka for the medically certified rest
period of three months, treating the said period as paid medical leave.
2. Mode and Time of Payment:
The wages and medical expenses shall be paid through the regular payroll or bank
transfer mechanism within fifteen (15) days from the date of signing of this settle-
ment.
3. Service Conditions and Continuity:
It is agreed that no adverse entry, disciplinary action, or allegation of misconduct shall
be made or recorded against the Workman in her service records in relation to the in-
cident.
The period of medically certified rest shall be treated as continuous service for all pur-
poses.
4. Withdrawal of Claims:
Upon implementation of the above terms, the Workman and the Trade Union agree to
withdraw all claims, demands, or disputes arising out of or connected with the said in-
cident.
5. Full and Final Settlement:
This settlement shall be treated as a full and final settlement of all disputes and differ-
ences between the parties in respect of the said accident and related benefits.
6. Binding Nature:
The settlement arrived at during conciliation shall be binding on the parties in accord-
ance with applicable labour laws.
7. No Precedent Clause:
This settlement is arrived at based on the facts and circumstances of the present case
and shall not be treated as a precedent in any other matter.
8. Good Faith Clause:
The parties affirm that this settlement has been arrived at voluntarily, without coercion
or undue influence, and in good faith with the objective of maintaining industrial har-
mony and mutual trust.

Conclusion
In view of the above settlement, the industrial dispute stands amicably resolved. The Concili-
ation Officer records the settlement and declares that the conciliation proceedings are con-
cluded.

This is to certify that Ms. Renuka, employed as an Assembly Line Worker at Millennium
Ltd., was examined by the undersigned on 10 January 2026 following an injury sustained
during the course of her employment.
On clinical examination, the patient was found to have suffered a soft tissue injury involving
the lower back, caused due to a workplace incident on 9th January 2026. No permanent disa-
bility has been detected at present.
The patient has been advised complete rest for a period of three (3) months, commencing
from 10 January 2026 and ending on 9 April 2026. During this period, the patient is medi-
cally unfit to resume manual, industrial, or assembly line work.
This certificate is issued for medical, employment, and conciliation proceedings purposes.
