1. Ministry in Charge
The Ministry of Commerce and Industry, specifically the Department for
Promotion of Industry and Internal Trade (DPIIT), oversees the
administration of Intellectual Property Rights in India.
It is responsible for policy formulation, modernization, and efficient
administration of IP laws in the country.
2. Controller General of Patents, Designs & Trade Marks (CGPDTM)
CGPDTM is the apex body under DPIIT responsible for managing the
administration of:
o Patents
o Trademarks
o Designs
o Geographical Indications (GIs)
o Copyrights (administratively coordinated with Ministry of Education)

🔹 Patent Offices

(PCTs).

The Trade Marks Registry has its Head Office in Mumbai.

Operates under the Ministry of Education.
Located in New Delhi and administered by the Registrar of Copyrights.
Works closely with the Copyright Board, which adjudicates disputes.
4. Other Relevant Offices and Authorities
Intellectual Property Appellate Board (IPAB) (now merged with High Courts)
Used to handle appeals against decisions of the registrar of trademarks, patents,
and copyright.
As of 2021, its functions are transferred to the High Courts under the Tribunals
Reforms Act, 2021.
Plant Varieties and Farmers' Rights Authority
Established under the Protection of Plant Varieties and Farmers’ Rights Act,
2001.
Responsible for registration and protection of new plant varieties.
Headquarters: New Delhi
🔹 National Biodiversity Authority (NBA)
Based in Chennai.
Regulates access to biological resources and associated traditional knowledge.
5. Digitization and Modernization Initiatives
Introduction of e-filing systems for patents, trademarks, designs, and GIs.
Launch of IP India Portal ([Link] for:

o Fee payment
o Public search tools
Use of AI and automation tools to speed up patent/trademark examination.
6. International Engagement
India is a member of major international IP bodies:
o WIPO (World Intellectual Property Organization)
o TRIPS (Trade-Related Aspects of Intellectual Property Rights) under
WTO.
