E-Filing Procedure of a Patent (India)

E-filing of a patent refers to the online submission of patent applications and related documents
through the Indian Patent Office (IPO) e-filing portal, governed by the Patents Act, 1970 and
Patents Rules, 2003.

Step-by-Step E-Filing Procedure

Step 1: User Registration

 The applicant or patent agent must register on the Indian Patent Office e-filing portal.
 Registration includes:
o Applicant/Agent details
o Email ID and password creation
 A Class III Digital Signature Certificate (DSC) is mandatory.

Step 2: Preparation of Patent Application

The following documents are prepared before filing:

 Form 1 – Application for grant of patent


 Form 2 – Provisional or Complete Specification
 Form 3 – Statement and undertaking (foreign filings)
 Form 5 – Declaration of inventorship
 Form 26 – Power of Attorney (if filed by agent)
 Abstract
 Drawings (if any)

Step 3: Online Filing of Application

 Login to the e-filing portal.


 Select:
o Ordinary / Convention / PCT National Phase application
 Upload all required forms and documents in PDF format.
 Choose the appropriate Patent Office jurisdiction.

Step 4: Payment of Fees

 Fees are paid online via:


o Net banking

o Debit/Credit card
 Fee depends on:
o Type of applicant (Natural person, Startup, MSME, Others)
o Type of application
Step 5: Acknowledgement & Application Number

 After successful submission:


o Application number is generated instantly

o Filing date is recorded


 This marks the official filing of the patent application.

Step 6: Publication of Application

 Patent application is published:


o Automatically after 18 months from filing date
OR
o Early publication by filing Form 9

Step 7: Request for Examination (RFE)

 Filed using Form 18 or Form 18A (expedited examination)


 Must be filed within 48 months from priority date.

Step 8: Examination & FER

 Examiner issues First Examination Report (FER).


 Applicant must respond to objections within 6 months (extendable by 3 months).

Step 9: Grant of Patent

 If objections are resolved:


o Patent is granted

o Published in the Patent Journal

Step 10: Post-Grant Compliance
