Order passed below application Exh.1 for grant of anticipatory bail
under Section 482 of B.N.S.S. 2023.

1. Vide the present application under Section 482 of
B.N.S.S. 2023 of claiming pre-arrest bail as the applicants are
apprehending their arrest in Crime No.17/2025 registered with
Police Station Loni-Kalbhor, Pune, for the offences punishable
under Sections 85, 115(2), 352, 351(2) r/w. 3(5) of Bharatiya
Nyaya Sanhita, 2023.
2. Read the application, say vide Exh.5 of investigating
officer, documents and investigation papers.
3. Heard, Learned Adv. Mr. A. H. Pathan for applicants
and Learned A.P. P. Mr. S. S. More for the State.
4. Brief facts of the prosecution case is as under,
Alleged incident took place during the period from
29.03.2012 to 11.01.2025 at matrimonial house of informant.
Informant is the wife of accused No1-Amar Vhankalas and they got
married on 29.2.2012. Applicant No.2 is the father in-law and
applicant No.3 is the brother-in-law of informant. Accused Avida
died in the year 2018 prior to the registration of crime. Applicants
and deceased co-accused-Avida, have beaten her by raising the
petty quarrels and thereby they have harassed her physically,
mentally & economically.
5. Ld. Advocate for applicants has argued that informant

has lodged a false report against the applicants and falsely
involved them. Informant & applicant No.1 begotten two children.
Informant did not lodge any complaint since 2012 to till the
lodging of N.C. in the year 2024. Custodial interrogation of
applicants is not necessary. He has prayed for allowed the
anticipatory bail application.
6. Ld. A. P. P. has argued that the applicants are involved
in alleged offences by beating & harassing the informant.
Custodial interrogation is necessary. He has prayed for rejection of
the anticipatory bail application.
7. Considering the submissions of both sides and on
perusal of documents on record and investigation papers, it
transpire that informant is the wife of accused No1-Amar
Vhankalas, they got married on 29.2.2012 and they blessed with
two children. Applicant No.2 is the father-in-law and applicant
No.3 is the brother-in-law of informant. Accused Avida died in the
year 2018 prior to the registration of crime. Applicants and
deceased co-accused-Avida, have allegedly beaten her by raising
the petty quarrels and thereby they have allegedly harassed her
physically, mentally & economically. Prima-facie, it transpires that
there is a matrimonial dispute in between the informant and
applicants and alleged offences arose out of the said matrimonial
dispute. As per the say of investigating officer, he has issued the
notice under Section 35(3) of B.N.S.S. 2023 to the applicants and
he has filed the charge-sheet against them on 29.7.2025. Thus, the

custodial of interrogation of applicants transpires to be not
necessary.
8. Looking to the matrimonial nature of offences, role of
applicants and facts & circumstances, applicants have made out a
prima-facie case for grant of anticipatory bail and they are entitled
to get the same. In the result, instant application is liable to be
allowed subject to conditions accordingly and I proceed to pass the
following order.
ORDER
1. Application vide Exh.1 for grant of anticipatory bail is hereby
allowed.
2. In the event of arrest, applicants No.1-Amar Utreshwar
Vhankalas, No.2-Utreshwar Vhankalas & No.3-Yogesh
Utreshwar Vhankalas, All R/o. Barshi, Tal.-Barshi, Dist.-
Solapur, in Crime No.17/2025 registered with Police Station
Loni-Kalbhor, Pune, for the offences punishable under
Sections 85, 115(2), 352, 351(2) r/w. 3(5) of Bharatiya
Nyaya Sanhita, 2023, they be released on execution of
Personal Bonds of Rs.25,000/- each and Surety Bonds of like
amount each, subject to conditions.
i) Applicants shall not threaten or pressurise the
informant in any manner.
ii) Applicants shall remain appear before the investigating
officer attached to the Police Station Loni-Kalbhor in
between 1.00 a.m. to 2.00 p.m. on 12.01.2026 and

thereafter as and when called and co-operate the
investigating officer.
3. Inform to the Police Station Loni-Kalbhor, Pune.
