SUBJECT : DETAILS OF CLAIM DUE TO WORK DISRUPTION UNDER SUB-CLAUSE 8.5

References : 1) Contractor’s notice under Sub-Clause 20.1

Dear Sir,

We pertain to the notice submitted under Sub-Clause 20.1 [Contractor’s Claim] for this particular
claim. Subsequently, we hereby forward herewith our interim detailed particular. As a result of the
actions by relevant authorities, the Contractor had suffered unforeseeable shortages in the
availability of personnel and/or Goods and, thus, leading up to disruption and delay to the Works.

Sub-Clause 8.5 [Delays Caused by Authorities] provides that if:


“(a) the Contractor has diligently followed the procedures laid down by the relevant legally
constituted public authorities in the countries,
(b) these authorities delay or disrupt the Contractor’s work, and
(c) the delay or disruption was Unforeseeable,

Then this delay or disruption will be considered a cause of delay under … Sub-Clause 8.4 [Extension of
Time for Completion]” resulting to entitlement to an extension of Time for Completion.

Based on these circumstances, we would like to notify your good office of the necessary extension of
time for completion of XX Calendar days.

The Contractor is contractually bound to follow the directives and orders laid down by the Country’s
relevant authorities and this resulted to delays and disruptions. By virtue of Sub-Clause 8.5 [Delays
Caused by Authorities] of the General Conditions of Contract (GCC), the Contractor is entitled for an
extension of Time for Completion due to these governmental actions.

We expect to receive the Engineer’s fair and reasonable determination of the above claim in
accordance with Sub-Clause 3.5 [Determinations] and Sub-Clause 20.1 [Contractor’s Claims].
