UNIVERSITY OF GHANA SCHOOL OF LAW LAW OF TORTS 1 FLAW 207,317,307) UNIVERSITY OF GHANA SCHOOL OF LAW LAN TSI COURSE OBJECTIVES AND OUTLINE ‘The basic objective of the LL.B Programme at Legon is to make students technically competent in the law, as well as the assumptions, the strengths and weaknesses of law. It is also important that students are made to understand that the rules of law are actually part of the instruments available to society for the treatment of the issues confronting it; and that they are not mere abstract statements o be memorised for the sake of satisfying human vanity. Hopefully, this will complement the professional training to produce first class law professionals able to hold their own and be productive in this fast developing world. TORTS is a branch of law, This branch deals with obligations essentially created by law. These obligations are not dependent on agreement between parties, though such agreement may have some consequences, as, for example, with the defence of Consent. It is also important for the student to keep in mind that the rules we shall study in are largely judge-made. So we will be reading a lot of decisions by courts. For historical reasons, these courts will cut across all countries which have previously come under British colonial rule as well as decisions of UK courts. However, there are alse some relevant statutory interventions which we will study. ‘The main topics into which the Course is broken are as follows: 1. Nature, History, Aims of the Law of Torts 2. General principles of liability in Torts 3. Choice of law in Torts Cases in Ghana 4. Intentional interference with person and property a. Trespass to the person — battery, assaultunlawful arrest, false imprisonment, malicious prosecution b. The rule in WILKINSON v, DOWNTOWN ¢, Trespass to land 4. Trespass to chattel — Conversion, Detinue, Replevin, etc. @, Defences to the intentional Torts Nuisance ‘The rule in RYLANDS v, FLETCHER 1, Economic Torts 8. The principle of Sir K. Kumado/Mir, K.
